A RESOLUTION OF THE CITY COm~CIL
OF THE CITY OF SANTA MONICA DECLARING
ITS INTENTION TO GRANT A FRANCHISE TO
THETA CABLE OF CALIFO&~IA FOR A
CO~lm~ITY &~D TELEVISION SYSTEM
WHEREAS, the City of Santa Mon~ca granted a
franch~se for a community antenna television system to
Theta Cable of Californla on or about October 24, 1967;
and,
WHEREAS, said franch1se ~s about to expire; and,
\~EREAS, the C~ty Counc~l of the City of Santa
Mon1ca has rece~ved from Theta Cable of Californ1a an
application, under and pursuant to the provis~ons of the
City Charter of the City of Santa Monica, and Ordinance No.
734 (CCS) of the City of Santa Mon1ca, for a franch1se,
wh~ch sa1d appl~cat1on states that the purpose for whlch
the franch~se there~n applied for 1S desired 1S to prov1de
a complete cable antenna telev~sion serv~ce for the C~ty of
Santa Monica ~ncluding ~, FM and aux~l1ary serv~ces; and
that the term for which the franch1se therein appl~ed for 1S
for a period of ten (lO) years, pursuant to said Ord~nance
No. 734 (CCS}i and,
WHEREAS, said applicat~on further states that the

appl~cant, ~f granted the franch~se there~n applied for, w~ll
pay to the C~ty of Santa Monica dur~ng the life of such
franchise, three (3%) percent of the gross annual receipts
of applioant arislng from the use, operation or pos1tlon
of sald franchise.
NOW, THEREFORE, the City Council of the C1ty of
Santa Monica does resolve as follows:
SECTION 1. That the city Council of the City
of Santa Mon~ca, pursuant to the C~ty Charter of the City
of Santa Monica and Ord~nance No. 734 (CCS) does hereby declare
1tS 1ntentlon to grant a franch1se for a complete cable
antenna television serv~ce for the City of Santa Mon~ca,
inclUding TV, FM and auxlllary services in the Clty of
Santa Monlca to Theta Cable of Callfornia.
SECTION 2. That said franch~se ~s proposed
to be granted for a term of ten (10) years, pursuant to
the Santa Mon1ca C~ty Charter and Ord1nance No. 734 (CCS).
SECTION 3. That November 22, 1977, at 7:30
o'clock p.m., at the Santa Monica C1ty Councll Chambers ~s
the place and tlme hereby fixed for a hearing on sa~d proposed
grant of franchlse whereat any persons having an lnterest
therein or any obJection to the grantlng thereof may appear
before the City Counc1l and be heard thereon. (The time
be~ng so flxed for such hearing be1ng not less than twenty
(20) or more than s~xty (60) days after the passage of th~s
resolut~on) .

SECTION 4.
That the appl1cation for sa~d
contract states, and Theta Cable of Cal~fornia w111, 1f the
franch~se ~s granted, dur~ng the l~fe of said franchise,
pa~d to the City of Santa Mon1ca, three (3%) percent of
the gross annual receipts of Theta Cable of Cal~fornia
ar~s1ng from the use, operation or possess~on of sa~d
franch1se. Further, sa~d percentage will be paid annually
from the date of grant~ng of said franch~se, and ~n the
event that such payment shall not be made such franch~se
w~ll be forfeited.
SECTION 5.
The C~ty Clerk is hereby directed
to publ~sh this resolut~on at least once with~n f1fteen (l5)
days of the passage hereof ~n the official newspaper. To
w~t: The Santa Mon~ca Even~ng Outlook, pursuant to Section
l60l of the Santa Mon~ca C1ty Charter.
SECTION 6.
The City Clerk shall cert~fy to the
adopt~on of th~s Resolut~on and thenceforth and thereafter
the same shall be in full force and effect.
