RESOLUTION NO. 4996 (CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DECLARING ITS INTENTION TO ORDER THE VACATION
OF A PORTION OF A CERTAIN ALLEY KNOWN AS MONTANA PLACE
NORTH FROM FOURTEENTH STREET TO FIFTEENTH STREET, IN
THE CITY OF SANTA MONICA, CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Clty Council of the City of Santa Monica
hereby declares its intentlon to order the vacation of all of that portion
of Montana Place North between Fourteenth Street and Flfteenth Street,
as shown on the map of Tract No. 5119 Block 3 as recorded in Map Book 53,
Page 64, in the City of Santa Monlca, County of Los Angeles, State of
Callfornia.
For further particulars as to the proposed vacatlon and
abandonment of the hereinbefore mentioned alley, reference is made
respectlvely to Map No. 4200, dated March 28, 1978, now on file in the
office of the City Clerk in the Clty Hall, Santa Monica, California.
SECTION 2. The City Council of the City of Santa Monlca, in
vacatlng said portion of said Montana Place North hereby intends to
reserve an easement over said alley to be vacated for utllity purposes.
SECTION 3. The City Council of the City of Santa Monica further
stipulates that the vacating of said portions of t~ontana Place North is
dependent on the dedlcatlon of property and the construction of a 20-foot-
wide easement for public access, said 20-foot-wide easement to be located
five feet Northwesterly of the alley to be vacated, as lndicated on said
Map No. 4200.

SECTION 4. The City Councll of the City of Santa Monica
further stipulates that the vacation of the above mentloned portion of
Montana Place North is dependent on compliance with certain conditlons
stipulated by the City Engineer.
SECTION 5. The City Council of the City of Santa Monica, in
vacating the above mentioned portions of Montana Place north, elects to
proceed under and in accordance with the provislons of the "Street
Vacation Act of 1941," being Divislon 9, Part 3 of the Streets and
Highways Code of the State of Californla.
SECTION 6. That the hour of 7:30 o'clock p.m. of the 25th
day of Aprll, 1978, in the Council Chamber in the City Hall, Santa Monica,
California, be and the same hereby is fixed as the time and place when
and where all persons interested in or objectlng to the proposed vacation
and abandonment may appear before the City Council and offer eVldence in
relatlon thereto.
SECTION 7. That the Street Superintendent of the City of
Santa Monica hereby is directed to cause Notices of Street Vacation to
be posted as requlred by the Street Vacation Act of 1941, being Division 9,
Part 3 of the Streets and Hlghways Code, and the City Council hereby
elects to proceed under the provisions of said act.
SECTION 8. The City Clerk shall certify to the adoption of
thlS Resolution of Intention and shall cause the same to be published twice
in the Evening Outlook, a newspaper pUbllshed and circulated in the City of
Santa Monica, the first of said publications shall be not less than
fifteen (15) days prior to April 25, 1978.

SECTION 9. That the City Clerk shall certify to the adoptlon
of this resolution and thenceforth and thereafter the same shall be in
full force and effect.
