RESOLUTION NO. 5006 (CCS)

A RESOLUTION OF THE CITY COUrlCIL OF THE CITY OF
SANTA MONICA ORDERING THE VACATION OF THAT PORTION
OF THAT CERTAIN ALLEY KNOWN AS MONTAlIA PLACE NORTH
FROM FOURTEENTH STREET TO FIFTEENTH STREET. IN THE
CITY OF SANTA MONICA. CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Santa Monlca
having heard the evidence offered in relation to the proposed vacation of
that certain alley known as Montana Place North between Fourteenth St. and
Fifteenth St., as shown on the map of Tract No. 5119. Block 3, in the City
of Santa Monica. County of Los Angeles. State of California, recorded in
Book 53, Page 64 of Maps. in the office of the Recorder of said County,
hereby finds from all of the evidence submitted that the alley above referred
to and proposed to be vacated by Resolution No. 4996 (City Council Series)
is in its present location for street purposes. For full particulars
reference hereby is made to said Resolution No. 4996 (City Council Series)
and to Drawing No. 4200 on file in the offlce of the City Clerk of said
City, which map is entitled, "J'>1ap showing portion of Montana Place North
to be vacated under the provislons of the Street Vacation Act of 1941. and
establishment of an easement for Public Access," dated March 2B, 197B.
SECTION 2. The City Council of the City of Santa Monica, in
vacating sald portion of said Montana Place North hereby reserves an easement
over the full width of said alley for utility purposes and further hereby
restricts the right of any building construction over said alley.

SECTION 3. The City Council of the Clty of
Santa Monica further st~pulates that the vacatlng of sa1d
portions of Montana Place North is dependent on the
dedicat10n and construction of a 20-foot-wide easement for
publ~c access, sald 20-foot-wide easement to be located
five (5) feet Northwesterly of the alley to be vacated,
as indlcated on sald Map No. 4200.
SECTION 4. The City Councll of the C~ty of
Santa Monica further stipulates that the vacatlon of the
above-ment~oned portion of Montana Place North is dependent
on compliance witn certaln conditions stipulated by the
City Englneer.

SECTION 6. The C~ty Council of the City of

establishment of a twenty (20) foot easement for publlc
access through the parklng lot alsles, both east and west,
which wllI guaranty unlmpared access to both Fourteenth
Street and Fifteenth Street from the North-South-alley,
which lS Fourteenth Court.
SECTION 7. The City Council of the C~ty of
Santa Monica further conditions said vacation upon the
provlslon of an aesthetically screened trash enclosuxe,

sufflclent to hold the dlscarded trash from th~_-busines5esi

General Services.
SECTION 8. The City Councll of the clty of
Santa Monlca further condltlons sald vacatlon upon the
prov~sion of an irrigated, landscaped area three {3}'. feet
in wldth and clea~ of overhang by car~ along the northwest
lot Ilnes of Lot 4 and Lot 29 Q.rc-an aesthetrc equalivent
approved by the Architectural ReVlew BQ~d. -
SECTJON 9. Th9City Council of" the City of
Santa Monica further conditions said vaeation upon the
s~mlssion to and approval by the Architectural- Review
_Board of llghti~g- and screening of !OOftop equipment.

SECTION 10. The Clty Cauncil"ofc'the City of
Santa Manlca further conditions sald vacation upon the
retentlon of e~isti~g street trees, or in the event of the
imposslblllty of so dOlng, the replacement thereof with
good slzed trees an both Fourteenth and Fifteenth Streets.
SECTION 11. It 15 therefore ordered that sald
portion of said alley be and the same:~ereby is vacated.
SECTION 12. The City Clerk shall certlfy to
the adapt~on of thlS resolution and the same shall be In
full force and effect after the conditlons contained in this
