RESOLUTION NO. 5028(CC5)

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AUTHORIZING THE
TRANSFER OF CERTAIN PROPERTY OF THE
PARKING AUTHORITY TO THE CITY.
WHEREAS, on March 28, 1978, the C~ty Council of the City
of Santa Monica authorized the Redevelopment Agency of the C~ty
of Santa Monica to issue a $3,700,000 Promissory Note: and
h'HEREAS, in order to complete t:oe issuance of e1e Dote,
it is necessary to transfer t~tle of certain Parking Author~ty
owned land to the C~ty; and
h'HEREAS, the Park~ng Law of 1949 (Sect~on 32500 et seq.
of the California Streets and Highways Code), and particularly
Sect~on 32667 thereof, states that "at any t~me after the activation
of a parking authority, the legislative body by a two-thirds vote
may adopt a resolution transferring the property of the authority
to the city," prov~ded that such transfer shall not be made in
contravention of any covenant or agreement made with the holders
of bonds of the authority issued and outstanding."
NOh', THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION l. That the City Manager and Executive Director
of the Park~ng Authority of the City of Santa Monica be and hereby
are authorized to effect a transfer of ownership to the C~ty of

Santa Mon~ca of that property described as:
EXHIBIT A (Attached)
SECTION 2. That transfer of said property by the Park~ng
Authority does not contravene any agreement or covenant made with
the holders of Parking Authority bonds ~ssued and outstand~ng.
SECTION 3. The City Clerk shall cert~fy to the adopt~on
of thlS resolution, and thenceforth and thereafter the same shall
be in full force and effect.
