A RESOLUTION OF n:E CITY COU:ICIL OF THE CITY OF
SANTA MONICA ORDERING THE VACATION OF THAT PORTION
OF THAT CERTAIN ALLEY KNOWN AS ~10NTAIIA PLACE NORTH
FROM FOURTEENTH STREET TO FIFTEENTH STREET. IN THE
CITY OF SANTA MONICA. CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Santa Monica
having heard the evidence offered in relation to the proposed vacation of
that certain alley known as Montana Place North between Fourteenth St. and
Fifteenth St., as shown on the map of Tract No. 5119. Block 3, in the City
of Santa Monica, County of Los Angeles, State of California. recorded in

Book 53, Page 64 of Maps. in the office of the Recorder of said County,

hereby finds from all of the evidence submitted that the alley above referred
to and proposed to be vacated by Resolution No. 4996 (City Council Series)
is in its present location for street purposes. For full particulars
reference hereby is made to said Resolution No. 4996 (City Council Series)
and to Drawing No. 4200 on file in the office of the City Clerk of said
City; which map is entitled. "~1ap showing portion of Montana Place North
to be vacated under the provisions of the Street Vacation Act of 1941, and
establishment of an easement for Public Access," dated 14arch 28.1978.
SECTION 2. The City Council of the City of Santa Monica, in
vacating said portion of said Montana Place North hereby reserves an easement
over the full width of said alley for utility purposes and further hereby
restricts the right of any buildlng construction over said alley.

portIons of Montana Place North 1S dependent on the

dedlcatlon and constructIon of a 20-foot-wlde easement for
publlc access, sald 20-foot-wlde easement to be located
flve (5) feet Northwesterly of the alley to be vacated,
as lndIcated on sa~d Map No. 4200.
SECTION 4. The City Councll of the City of
Santa MOlllca further stlpulates that the vacatlon of the
above-ment~oned portIon of Montana Place North lS dependent
on compliance wlth certaln conditlons stIpulated by the
Clty Englneer.
SECTION 5. The City Council of the City of
Santa Mon1ca further condltlons said vacatlon upon the
development of the park1ng lot to be created substantially
in accordance wlth the plan subm~tted as part of the
appl~catlon for vacat~on.
SECTION 6. The City Council of the C1ty of
Santa Monlca further condltions sald vacatlon upon the
establishment of a twenty (20) foot easement for publlc
access through the parklng lot alsles, both east and west,
WhlCh will guaranty unimpared access to both Fourteenth
Street and Fifteenth Street from the North-South alley,
which lS Fourteenth Court.
SECTION 7. The Clty Counc~l of the Clty of
Santa Monlca further condltlons sald vacatlon upon the
prov~slon of an aesthetlcally screened trash enclosure,

sufflclent to hold the dlscarded trash from the buslnesses;
Slze and locatlon to be acceptable to the Department of
General Servlces.
SECTION 8. The Clty Councll of the Clty of
Santa MOTIlca further conditlons sald vacatlon upon the
prOV1S1on of an irrlgated, landscaped area three (3) feet
in wldth and clea~ of overhang by cars along the northwest
lot Ilnes of Lot 4 and Lot 29 or an aesthetlc equallvent
approved by the Architectural ReVlew Board.
SECTION 9.
The Clty C6uncll of the Clty of
Santa Monlca further condltlons sald vacatlon upon the
submlSSlon to and approval by the Archltectural ReVlew
Board of llghtlng and screenlng of rooftop equlpment.
SECTION 10. The Clty Councll of the Clty of
Santa Mon~ca further condltlons sald vacation upon the
retentlon of eXlstlng street trees, or 1n the event ~f-the
imposslblllty of so dOlng, the replacement thereof wlth
good s~zed trees on both Fourteenth and Fifteenth Streets.
SECTION ll. It lS therefore ordered that sald
portion of sald alley be and the same hereby lS vacated.
SECTION l2. The C~ty Clerk shall certIfy to
the adoptlon of thlS resolutlon and the same shall be ln
full force and effect after the condit~ons contained in thlS
resolutlon have been satlsfled. The Clty Clerk shall also
cause a copy of thls resolutlon to be recorded In the offlce
of the County Recorder of the County of Los Angeles.
