RESOLUTION NO. 4790(CCS)

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA URGING
THE CALIFORNIA STATE LEGISLATURE
TO AMEND THE CALIFORNIA VEHICLE
CODE ESTABLISHING SPEED ZONES IN
RESIDENTIAL AREAS AND REQUEST THE
LEAGUE OF CALIFORNIA CITIES TO
LOBBY FOR SPEED ZONES.
WHEREAS, Section 40802(b) of the Californla Vehlcle
Code as construed by the courts, effectlvely precludes radar
enforcement where a speed l~mit is not justif~ed by a trafflC
and engineering survey and whereas such surveys generally
establish a speed lim~t WhlCh ~s e~ther at or flve (5)
miles per hour below the elghty-fifth (85th) percentile of
vehlcles travelllng on a highway with some adJustment for
accldent records and highway trafflc and roadslde conditions
not readily apparent to the driver; and,
WHEREAS, in residential zones there are other factors
which should be considered, such as noise, the quality of life
of residents, hlghway traffic and roadslde conditions, WhlCh,
although, readily apparent to the driver, are ln fact 19nored,
and roads~de condltions which are readlly apparent, but the
significance of which the average person does not understand ln
terms of hlghway safety; and,
NHEREAS, the needs of local government and thelr varYlng
resldentlal areas demand local control; and,
WHEREAS, radar enforcement ln residentlal areas will
save llves, conserve energy, and reduce air and noise pollutlon

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The League of Ca1ifornla Clt~es Rego1ut~on
Comm~ttee is hereby urged to adopt a resolutlon for the League
to support legislation to perm~t citles more fleXlbllity in
lowering the speed 11mits in residentlal areas.
SECTION 2. The City Clerk shall certify to the
adopt~on of this resolution, and thenceforth and thereafter the
same shall be ln full force and effect.
