R-9495 CA:f:\atty\m uni\laws\mox\montana. bia City Council Meeting 03-28-00 Santa Monica, California RESOLUTION NUMBER 949S(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO CHANGE THE ASSESSMENT FEE LEVIED IN THE MONTANA AVENUE BUSINESS IMPROVEMENT ASSESSMENT DISTRICT WHEREAS, Ordinance Number 960 (CCS) of the City of Santa Monica, adopted on July 9, 1974, as amended by Ordinance Number 1531 (CCS), adopted July 10, 1990, Ordinance Number 1558 (CCS) adopted November 13, 1990, and Ordinance Number 1805 (CCS), adopted June 13, 1995 (hereinafter collectively "Ordinance No. 960") established a business improvement area along a portion of Montana Avenue and set forth procedures governing the levy of an assessment (the "Fee") for the general promotion of business and professional activities in the Montana Avenue Business Improvement Assessment District (the "District"), such Fee to be payable by all business license holders occupying business premises in the District; and WHEREAS, such District was established pursuant to the provisions of Part 5 of Division 18, commencing with Section 36000 of the Street & Highways Code (the "Law"); and 1 WHEREAS, the City Council desires to changes in the amount of the Fee levied in the District in order to provide for expanded promotion of retail trade and business and professional activities in the District; and WHEREAS, the Law provides that any change in rate or levy of the Fee requires that the City Council adopt a resolution of intention to change such rate or levy at least fifteen (15) days prior to a hearing on an ordinance pertaining to such changes; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby declares its intention to change the Fee levied in the District. For failure to pay said assessment on the due date thereof, penalties shall be exacted as set forth in Section 6.04.160 of the Santa Monica Municipal Code. SECTION 2. A public hearing on the proposed changes in the Fee for the District will be held at 7:00 p.m. on Tuesday, April 18, 2000, or as soon thereafter as the matter may be heard, in the City Council Chambers located at 1685 Main Street, Santa Monica, California, pursuant to Section 36061 of the Streets & Highways Code of the State of California. At such public hearing the City Council will hear public testimony on the proposed Fee changes, including any protests or objections to the changes. 3 SECTION 3. That the City Clerk shall cause this Resolution to be published once in the New Times Section of the Los Angeles Times, a newspaper, of general circulation in said City, and shall cause a completed copy of this Resolution to he mailed, postage prepaid, to each business License holder in the District, at his or her business address. The City Clerk shall also cause a copy of this Resolution to be posted at three (3) public places in the District. Such publication, mailing and posting shall be completed at least ten (10) days prior to the time of the hearing. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM 11 r. A I .IU .1.
