ARTICLE I WITNESSETH: That for and in consideration of the
payments and agreements hereinafter mentioned; to be made and
performed by the said party of the first part, and under the
conditions expressed in the two bonds, bearing even date with
these presents, and hereunto annexed, said party of the second
part agrees with the said party of the first part, at his own
proper cost and expense, to do all the work and furnish all the
ma terials, except such as are mentioned in the special provisions
to be furnished by said party of the first part, necessary to
complete in a good workmanlike and substantial manner, for the
Remodeling of a Flood Lighting System on Little League Field
No. 1 in Memorial Park in the City of Santa Monica, in strict,
conformity with the Standard Specifications of the City of Santa
Monica, Department of Engineering, dated JUly, 1951; Drawing
No. 30l3A in 1 sheet and Special Provisions No. 663, all of which
Standard Specifications, Special Provisions and Plans hereby are
referred to and made a part hereof the same as though set forth
in full herein.
ARTICLE II: And the said Contractor agrees to receive'and
accept the following prices as full compensation for furnishing
all materials and doing all the work contemplated and embraced in
this agreement; also for all loss or damage arising out of the
nature of the work aforesaid, or from the acts of the elements,
or from any unforeseen difficulties Qr obstructions which may ,
arise or be encountered in the prosecution of the work until its
acceptance by the City of Santa Monica and for all risks of every
description connected with the work; also for all expenses incurred
by or in consequence of the suspension or discontinuance of work
and for well and faithfully completing the work, and the whole
thereof, in the manner and according to the plans, Specifications,
Special Provisions and requirements of the Engineer under them,
to wit:

ARTICLE III: The said party of the first nart hereby
promises and agrees with the said Contractor to employ, and here-
by does employ the said Contractor to provide the materials and
equipment and to do the .vork according to the terms and con-
ditions herein contained and referred to, for the prices afore-
said, and hereby contracts to pay the same at the time, in the
manne r , and upon the conditions above se t forth; and the said
parties for themselves, their heirs, executors, administrators,
successors, and assigns do hereby agree to the full performance
of the covenants herein contained.
ARTICUI; IV: It is further expressly agreed by and between
the parties hereto that should there be any conflict between the
terms of this instrument and the bid or proposal of said Contrac-
tor, then this instruraent shall control and nothing herein shall
be considered as an, acceptance of the said terms, of said proposal
conflicting herewith.
IT IS T'URTHER AGREED that in case the work called for under
the contract is not finished and completed in all parts and
requirements within the number of working days specified, the
City shall have the ri3ht to increase the number of working days
or not, as may see~ best to serve the interest of the City,
excepting that the contract time s~all be extended for the length
of time of W1Y delay beyond the time nmaed for the completion of
the lvork caused by Acts of God or the public enemy, acts of the
City, fire, flooc, epidemics, quarantine restrictions, strikes,
and freight erl1bare;;oe s; ~rovided that the Contractor shall notify
the Engineer in 't..rri ting the causes of delay lJi thin ten r~::'JS from
the beginning of any such delay.
IT IS FURTHER AGRJ~:-:m that the Contractor shall be subject
to and comply with the provisions of the Labor Code, Section 1775

the estimated amount of the contract, to be paid to the said City
or its certain attorney, its successors and assigns; for which
payment well and truly to be made, we bind ourselves, our heirs,
executors and administrators, successors or assigns, jointly
and severally, firmly by these presents.

THE CONDITION OF THIS OBLIGATION IS SUCH,
That if the above bounden Principal, his or its heirs,
executors, administrators, successors or assigns, shall in all
things stand to and abide by, and well and truly keep and per-
form the covenants, conditions and agreements in the said
contract and any alteration thereof made as therein provided,
on his or their part, to be kept and performed at the time and
in the manner therein specified, and in all respects according
to their true intent and meaning, and shall indemnify and save
harmless the City of S~nta Monica, its officers and agents,
as therein stipulated, then this obligation shall become null
and void; otherwise it shall remain in full force and virtue
and the amount specified herein shall be forfeited to the City
of Santa Monica.
And the said Surety, for value received, hereby stipulates
and agrees that no change, extension of time, alteration or
addition to the terms of the contract or to the work to be
performed thereunder or the specifications accompanying the
same shall in any wise affect its ob~igations on this bond,
and it does hereby waive notice of any change, extension of
time, alteration or addition to the terms of the contract or
to the work or to the specifications.

materials, provisions, provender or other supplies or teams used
in, upon, for or about the performance of the work contract d to
be done, or for any work or labor done thereon of any kind, the

required by the provisions of an act of the Legislature of the
State of California entitled: "An Act to secure the pay ent of
claims of persons employed by contractors upon public w rks,
and the claims of persons who furnish materials, suppli s, teams,
implements or machinery used or consumed by such contra tors 1n
the performance of such works, and prescribing the duti s of
certain public officers with respect thereto" , approve
May 10, 1919, as amended and provided that the persons, com-
panies or corporations so furnishing said materials, pr visions,
provende~ or other supplies, teams, appliances or power used
in, upon, for or about the performance of the work cont acted
to be executed or performed, or any person, company or orpora-
tion renting or hiring teams of implements or machinery or power
for or contributing to said work to be done, or any per on who
performs work or labor upon the same, or any person who supplies
both work and materials therefor, shall have complied w"th the
provisions of said Act, then Surety will pay the same i or to
an amount not exceeding the amount hereinabove set fort , and
also will pay in case suit is brought upon this bond, s ch
reasonable attorney's fee, as shall be fixed by the court,
awarded and taxed as in the above mentioned Statute pro ided.
This bond shall inure to the benefit of any kind a d all
persons, companies and corporations entitled to file claims
under said Act, so as to give a right of action to the or their
assigns in any suit brought upon this bond.
