NOTICE OF COMPLETION hereby is given that Contract No. 1150
(City Council Series), between the CITY OF SANTA MONICA, a municipal
corporation, whose address is City Hall, Santa Monica, California, as
owner, and ALPHA CONSTRUCTION COMPANY, INC., whose address is 1666
Euclid Street, Santa Monica, California, as contractor, for the fol-
lowing work, to wit:
Construction of Recreation Building and Facilities
at Corner of Marine Street and Sixteenth Street in
the City of Santa Monica;
was completed on September 24, 1959.
The name of the surety on said contract is United Pacific
Insurance Company.

THIS AGREEl1ENr, entered into this ( day of uf;/1'i'Jj
between the City of Santa Monica, party of the first part, and

Contractor, party of the second part.
ARTICLE 1 WITNESSETH: That for and in consideration of the
payments and agreements hereinafter mentioned, to be made and performed
by the said party of the first part, and under the conditions expressed
in the two bonds, bearing even date with these presents, and hereunto
annexed, said party of the second part agrees with the said party of th
first part, at his own proper cost and expense, to do all the work and
furnish all the materials, except such as are mentioned in the special
provisions to be furnished by said party of the first part, necessary
to complete in a good workmanlike and substantial manner for the con-
struction of the Marine Park Recreation Building, Marine Street at
Sixteenth Street, in the City of Santa Monica, in strict conformity
with Plan No. 2797, the Standard Specifications of the City of Santa
Monica, Department of Engineering, dated July, 1951 and Special
Provisions No. 450 on file in the office of the City Engineer, all of
whi.ch Plans, Standard Specifications and Special Provisions hereby are
referred to and made a part hereof the same as though set forth in
full herein.
ARTICLE II: And the said Contractor agrees to receive and
accept the following lump sum as full compensation for furnishing all
materials and doing all the work contemplated and embraced in this
agreement, also for all loss or d~~age arising out of the nature of
the work aforesaid, or from the acts of the elements, or from any un-
foreseen difficulties or obstp~ctions which may arise or be encountered
in the prosecution of the work until its acceptance by the City of
Santa Monica and for all risks of every description connected with the
work; also for all expenses incurred by or in consequence of the
suspension or discontinuance of work, and for well and faithfully
completing the work, and the whole thereof, in the manner and aocording
to the plans, specificat~ons, special provisions and requirements of
the Engineer under them, to wit:

tained and referred to, for the prices aforesaid, and hereby con-

ditions above set forth; and the said parties for themselves, their
heirs, executors, administrators, successors, and assigns do hereby
agree to the full performance of the covenants herein containe9.
ART I CT_,~;; I V: It is further expressly agreed by and between the
parties hereto that should there be any conflict between the terms
of this inst~~ment and the bid or proposal of said Contractor, then
this instrument shall control and nothing herein shall be considered
as an acceptance of the said. terms of saie proposal conflicting
herewith.
IT IS ~URTHER AGREED that in case the work ca1~ed for under
the contract is not finished and completed in all parts and require-
ments within the number of working days specified, the City shall
have the right to increase the number of working days or not, as
may seem best to serve the interest of the City, excepting that the
contract time shall be extended for the length of time of any delay
beyond the ~i=r.e n.ome f Jl~ the completion of the '^lork caused by Acts
of Cod or tr...e.mblic ener.If, acts of the City, fi.:>e, flood, epidemics,
quararltine res-cric tlcr..c, ~trikes, and freight embargoes; provided

'rHE CONDITION OF THIS OBLIGATION IS SUCH,.
That if 'the 8aid Contractor, hl150r its heirs, executors,
administrators, succeSsors or assigns shall fail ~o pay for any
materials, provisions, provender or other supplies or teams used
in, upon, for or about the performance of the work contracted to
be done, or for any work or labor thereon of any kind, as required
by the provisions of an act of the Legislature of the State ,of
of California entitled: "An Act to secure the payment of claims of
persons employed by contractors upon public works, and the claims
of persons who furnish materials, supplies, teams, implements or
machinery used or consumed by such contractors in the performance
of such works, and prescribing the duties of certain public officers
with respect thereto", approved May 10, t9l9, as amended and pro-
vided that the persons, companies or corporations so furnishing
said materials, provisions, provender or other supplies, teams,
appliances or power used in, upon, for or abO.lt the performance of
the work contracted to be executed or performed, Qr any person,
company or corporation renting or hiring teams or implements or
machinery or power for or contributing to said worK to be done, or
any perso~ who performs work or labor upon the sa~~, or any person
who supplies both work and materials therefor, shall have com:;>lied
with the provisions of said Act, then Surety will pay the same in
or to an amount not exceeding the amount hereinabove set forth, and
also will pay in case suit is brought upon this bond, such reason-
able attorney's fee, as shall be fixed by the court, awarded and
taxed as in the above mentioned Statute provided.
This bond shall inure to the benefit of any kind and all per-
sons, companies and corporations entitled to tile claims under said
Act, so a,s to give a right of action to them or, their ass,igns in any
suit broup.ht upon this bond.
And the said Surety, for value received, hereby stipulates and
agrees that no change, extension of time, alterations or addition
to the terms of the contract or to the work to be performed there-
