THIS INDENTURE made the~l day of June, 1945, at the
City of Los Angeles, County of Los Angeles, state of Calif-
ornia, by and between THOMAS JONES, the duly appointed, quali-
fied and acting Executor of the Will of JOSEPHINE SIMMEN,
deceased, the party of the first part, and the CITY OF SANTA
MONICA, a municipal corporation, the party of the second part,
WIT:NESSETH: ' That
\v.HEREAS, the SUperior Court of the state of California,
in and for the County of Los Angeles, upon due and legal notice
given, did on the 12th day of June, 1945, make an order auth-
orizing and directing said party of the first part to compro-
mise and settle that certain action ~o. 496955 in the Superior
Court of the state of California, in and for the County of Los
Angeles, filed by the CITY OF SANTA MONICA against said Exe-
cutor to quiet title to the real property hereinafter desoribed,
in consideration of the payment to said estate of the sum of
$50.00, and further authorizing and directing said party of
the first part to execute and deliver to the party of the second
part a deed or conveyanoe of all of the right, title and in-
terest of said decedent, of said estate, and of said THOMAS
JONES, as such Exeoutor, in and to the real property herein-
after described, upon reoeipt of said sum of $50.00, whioh order
is now on file and of reoord in said Court and is h~reby re-
ferred to and made a part of this Indenture,
NOW, THEREFORE. the said THOMAS JONES, Executor of the
Will of JOSEPHINE S!M1rEN, deceased, the party of the first part,

of the first part, as such Executor, in and to all that real
property situated in the City of Santa Monica, County of Los
Angeles, state of California, and more particularly described
as follows:
Lot 2, Block 31 of East Santa Monica, in the City of
Santa Monica, County of Los Angeles, state of California,
as per map recorded in Book 17 Page 95 et seq., Miscel-
laneous Records in the office of the County Recorder of
said County,
EXCEPTING from said lot that portion thereof, described
as follows: .
Beginning at the most Westerly corner of said Lot 2,
thence Northeasterly along the Northwesterly line of
said Lot 2, 32 feet to point, thence Southeasterly
along a line 32 feet Northeasterly from and parallel
to Southwesterly line of said Lot 2, said 32 feet meas-
ured along Northwesterly line of said Lot 2 to an inter-
section with the Southeasterly line of said Lot 2;
thence Southwesterly along Southeasterly line of said
Lot 2 to most Southerly corner of said Lot 2, thence
Northwesterly along the Southwesterly line of said Lot
