18 This Court made and granted a Judgment in Condemnation,
19 entered on October 16, 1973, in Book No. 6865, p. 269, of Judg-
20 ments, in the Office of the County Clerk of the County of Los
21 Angeles, State of California, adjudging that plaintiff is entitled
22 to condemn, as prayed for in its complaint against defendants
23 COMARCO, INC. , COUNTY OF LOS ANGELES, and FRANCHISE TAX BOARD OF
24 THE STATE OF CALIFORNIA, the real property described in Paragraph
25 XI of the Complaint herein, hereinafter more particularly
26 described, on payment to'said defendant COMARCO, INC. , of the sum
27 of Sixty Six Thousand Seven Dollars and Twenty Five Cents
28 ($66,007.25) , together with accrued interests and costs of suit.

1 In accordance with said judgment, plaintiff has paid
2 to COMARCO, INC. , the sum of Sixty Six Thousand Seven Dollars and
3 Twenty Five Cents ($66,007.25) , plus all interest due and owing,
4 totaling the sum of Seventy One Thousand Four Hundred Dollars and
5 Forty One Cents, ($71,400.41) , plus an additional Forty Two Dollars
6 ($42.00) for reimbursement of costs and disbursements. Said amount
7 was paid on November 7, 1973.
8 A disclaimer and consent to dismissal has been filed
9 herein by the FRANCHISE TAX BOARD and said defendant having thereby
10 disclaimed all right, title and interest in and to any of the real
11 property described and designated in the summons and complaint in
12 the above-entitled action and pursuant to the Final Pretrial Con-
13 ference Order herein, said defendant FRANCHISE TAX BOARD is not
14 entitled to any sums of said money.
15 Said defendant COUNTY OF LOS ANGELES did not appear at
16 the Trial of the Legal Issues nor the Valuation Trial, and Judgment
17 was entered in favor of CITY OF SANTA MONICA as hereinabove stated
18 and against COMARCO, INC. , and FRANCHISE TAX BOARD and COUNTY OF
19 LOS ANGELES, and said Judgment provided payment only to COMARCO,
20 INC.
21 It appearing to the satisfact~on of the Court that the
22 plaintiff has paid all sums due under the terms of the Judgment,
23 Nmv, THEREOFRE, IT IS ORDERED, ADJUDGED AND DECREED that
24 all right, title, interest, claim and lien of any kind and
25 description of said defendants COMARCO, INC. , COUNTY OF LOS ANGELES
26 FRANCHISE TAX BOARD OF THE STATE OF CALIFORNIA, ln, to or against
27 the hereinafter described property and all improvements thereon
28 pertaining to the realty deed and the same is hereby condemned and

1 appropriated for the public use of plaintiff as specified in said
2 Judgment and the title thereto, on the date of recording a certi-
3 fied copy of this Final Order of Condemnation with the Recorder of
4 Los Angeles County, California, shall vest in fee simple absolute
5 in City of Santa Monica, a municipal corporation, of the County of
6 Los Angeles, State of California, plaintiff above-named, free and
7 clear of all claims, right, title, interest or liens in or to,
8 on or against said property which said defendants COMARCO, INC. ,
9 COUNTY OF LOS ANGELES, FRANCHISE TAX BOARD OF THE STATE OF
10 CALIFORNIA, may have thereto or therein.
11 The fee simple absolute title to the real property is
12 herein taken and condemned for the following public use: mainly,
13 for the opening and improving of a certain public right-of-way in
14 the City of Santa Monica, to wit: the eastbound on ramp to the
15 Santa Monica Freeway and the northbound on ramp to the Pacific
16 Coast Highway and other public improvements appurtenant thereto and
17 for such other public uses as may be authorized by law.
18 On filing a copy of this Final Order of Condemnation
19 with the County Recorder of the County of Los Angeles, State of
20 California, the fee simple absolute title to the real property
21 described as follows shall vest in the plaintiff, its successors
22 and assigns. Said real property is described as follows:
23 "All of lots 18,. 19, 20 and the portion of Lot 17
24 described as follows: Beginning at the most
25 easterly corner of Lot 17; thence southwesterly
26 along the southeasterly line of said Lot 27.60
27 feet, more or less, to the northeasterly line of
28 the tract of land conveyed to the City of Santa

17 easterly line of said Lots 10 and 11 and those
18 portions of Lots 12 and 13 described as follows:

20 Lot 12; thence northwesterly along the southwesterly
21 line of said Lots 12 and 13, 37.56 feet to a point
22 in said southwesterly line, thence northeasterly
23 along a line parallel to the southeasterly line
24 of said Lot 13, 67.50 feet to a point; thence
25 easterly in a direct line to a point in the
26 southeasterly line of said Lot 13, distant thereon
27 18 feet northeasterly from the most southerly
28 corner of said Lot 13; thence easterly in a
