Mortgage and is the owner and holder thereof and of the note
secured thereby; and
WHEREAS, said Beneficiaries are the Beneficiaries
under said Deed of Trust and are the owners and holders of
said note secured by said Deed of Trust; and
WHEREAS, the City is desirous of acquiring an ease-
ment for storm sewer purposes over said land hereinafter
described;
NOW, TP...EREFORE. in consideration of ONE DOLLAR (;]Pl.OO)
and other valuable considerations passing from the Party of the
Second Part to the Parties of the First Part, receipt whereof
is hereby acknowledged, j said Orlando 4. Sanders and Bertha K.
Sanders. ... his wi fe . and Harold E. I,Hatby and Dorothy S. Maltby,
his wife. hereby grant, bargain, sell and convey unto said
City of Santa Monica. its successorsandabsigns. an easement
to lay and maintain a storm sewer over the land hereinafter
described, together with the right to enter upon said land at
all reasonable times for the purpose of.laying, maintaining and
repairing said sewer; and said Title Insurance and Trust Company,
as Mortgagee under said Mortgage and as Trustee under said Deed
of Trust, and said Charles Depler and Nora B. Depler, husband
and wife, as Beneficiaries under said Deed of Trust and the
owners and holders of the note secured. thereby, join in this
convey!mce to the extent and for the purpose of subordinating
the lien of said mortgage and Deed of Trust to said easement
hereby granted and of enabling the vesting of said easement
in the Party of the Second Part, free of said mortgage and
Deed of Trust.
