(CITY COUNCIL SERIES) DEED NO. 213 (CCS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AUTHORIZING THE PURCHASE OF
CERTAIN PROPERTY AND DIRECTING THE CITY MANA-
GER TO DO ALL THINGS NECESSARY TO EFFECTUATE
SAID PURCHASE.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The City Manager is authorized to forthwith
purchase from the Pacific Electric Railway Company, a California
corporation, the real property hereinafter described for the
price of $36,109.50, reserving unto the grantor the mineral
rights below 500 feet without the right of surface access. Said
property is described as follows:
All of that certain real property, situate in the
City of Santa Monica, County of Los Angeles, State of
California, described as follows:
That portion of Block D of Vawter's Subdivision, in
the City of Santa Monica, County of Los Angeles, State of
California, as per map recorded in book 6 page 217 of
Miscellaneous Records, in the office of the County Recorder
of said County, together with that portion of the Rancho
La Ballona, in said City, County and State, described as a
whole as follows:
Beginning at the most easterly corner of Lot 20 of
South Santa Monica Wharf Property, as per map recorded
in book 26 page 56 of Miscellaneous Records, in the Office
of said County Recorder; thence southeasterly along the
southeasterly prolongation of the northeasterly line of
said Lot 20 to the northwesterly line of Hollister Avenue
50 feet wide; thence southwesterly along said Avenue to a
line parallel with and 100 feet southwesterly from the
boundary line connecting Stations 5 and 6 of the Meander
lines of the Inner Bay; thence northwesterly parallel
with the said boundary line to the southeasterly line
of Lot 19 of said Santa Monica Wharf Property; thence
northeasterly along the said southeasterly line to the

SECTION 2. The City Manager is instructed to do all
things necessary to effectuate the transfer of the above-

right of said Grantor, its successors and assigns, of ingress and
egress beneath the surface as is necessary or useful in connection
therewith, and other use thereof, which uses may include lateral
or slant drilling, digging, boring or sinking of wells, shafts or
tunnels to other lands not subject to those reservations and ease-
ments; provided, however, that said Grantor, its successors and
assigns, shall not use the surface of said land in the exercise of
any of said rights and shall not disturb the surface of said land
or any improvements thereon or remove or impair the lateral of sub-
jacent support of said land or any improvements thereon, and shall
conduct no operations within five hundred feet (500') of the surface
of said land.
In the exercise of said reserved exclusive easements,
mineral rights and reservations, Grantor may pool said lands with
other lands. The rights of Grantor shall include, but shall in
no way be limited to, all subterranean rights necessary, incidental
or convenient to the full exercise of the rights reserved by Grantor
below five hundred feet (500'> of the surface of said land, and
shall include the right to drill and maintain well holes through
the said land below five hundred feet (500') from the surface thereof
for the purpose of removing oil, gas and other hydrocarbon substances
from other lands, whether such other lands be adjacent, contiguous
or distant from said lands.
The above described land hereby conveyed is not necessary
or useful in the performance of the duties of said Grantor to the
public.
