BIRCH INVESTMENT, INC., a corporation, grants
to the CITY OF SANTA MONICA, a municipal corporation, a
permanent easement and right-of-way for the construction,
reconstruction, replacing, enlarging, inspection, maintenance,
operation, and repair of an underground storm drain in the
following described property:
A ten (10) foot strip f land across a
portion of Rancho San Vic nte y Santa Monica
in the City of Santa Moni a, County of Los
Angeles, State of Califor ia, as per map
reccrded in Book 55, Page 13 and 50 of
Miscellaneous Records, in the office of the
Recorder of said County, the centerline of
said strip is described a$ follows:
Commencing at the mas southerly corner
of Lot 13, Block 200 of s id tract; thence
northeasterly along the s utheasterly line
of said Lot 13 a distance of 94.05 feet more
or less to a point, said oint being 65 feet
northwesterly, measured a right angles to
said southeasterly line, rom the northerly
line of Southern Pacific ailroad Companyls
Yards, as shown on the ma of Villa Farms
recorded in Book 70 pages 54 to 56 inclusive
of Miscellaneous Records, in the office of
said county recorder; thepce southeasterly
at right angles to the soptheasterly line of
said Lot 13 a distance of! 65 feet to a point
in the northerly line of $aid Southern
Pacific Railroad Company. Yards, said point
being the True Point of B ginning; thence
southwesterly along a lin parallel with and
65 feet distant southeast rly, measured at
right angles, from the so theasterly line of
said Lot 13, a distance 0 19.63 feet to the
beginning of a curve conc ve easterly, tangent
to said last mentioned co rse and having a
radius of 45 feet; thence southerly along
said curve through a cent, al angle of 74 441
48", an arc distance of 5r3.70 feet to a point;
thence southeasterly tangent to said curve a
distance of 18.7 feet more or less to the
northwesterly line of Olympic Boulevard, 117
feet wide, as said Olympic Boulevard was de-
scribed in Parcel I of the final decree of
condemnation entered in Case No. 496651,
Superior Court, recorded on July 27, 1945, as
Instrument No. 1283 in Book 22205, Page 147
of Official Records of said County, said
northwesterly line being the terminus of the
centerline of the easement.

to be lengthened or shortened to terminate on the
north at the northerly line of said Southern Pacific
Railroad Company's Yards and on the southeast at the
northwesterly line of said Olympic Boulevard.
Reserving and excepting unto Birch Investment,
Inc., a corporation, its nominees, successors and
assigns, the right to the use of thesurface,of the
aforesaid property, provided that in connection with
such use of the surface said grantor shall not place
any building thereupon nor interfere with the right
of the grantee to use said surface in order to reach
the aforesaid storm drain.
