ation of' the performance by second party of the terms and con-
ditions herein contained on its part to be performed, does hereby
give to second party the right and permission to lay and maintain
pipe lines under and along the streets hereinabove described.
Said second party, for and in consideration of the said

~ight and permission to lay and maintain pipe lines as afore-
said, does hereby agree to locate such pipe lines in such
manner as to interfere as Ii ttle as possible with existing pipe
lines, conduits and other underground structures in said streets,
and shall conduct the laying, placing and maintaining of said
pipe lin~s .with due regard to the safety and convenience of per-
sons using the streets in which said pipe is being laid.
Second party further agrees to restore to its former
state of usefulness each of said streets under or along which
it lays or\maintains such pipe lines, and to save first party
harmless from any and all claims or damages arising out of the
laying or maintaining of said pipe lines.
IN WITNESS WHEREOF, the respective parties hereto
have caused these presents to be executed by their officers
thereunto duly authorized, and their corporate seals to be
hereunto affixed the dayand year first hereinabove wri tten.

of Ca 11 forn ia , and that the Commissioner of Public Safety as ex-
10 officio Mayor o~ said City of Santa Monica, and the Commissioner of
public Works of said City be and they hereby are authorized and
11 directed to execute the S~le in behalf of the City of Santa Monica.
