C O N T R A C T

atian, herei.nafter referred to as "Ci~y", and
LENA Z. GRIFFIN hereinaf'ter referred to as "Seller",

WHEREAS, the parties have agreed to en~er inta a con- '
tract for the sale and purchase of that certain real property herein-
after described for public purposes;
NOW, THERE~'ORE, in consideration of their mutual eov-
enants the parties agree as follows:
1. Seller agrees to sell to City and City agrees to buy
from Seller that ce~tain real property described as follows:
Tha~ portion of Lot 29, Block A, Wavecrest Tract,
as per map reco~rded in Book 18, page 49, of Miscel-
laneous Records in the of£ice of the Recorder of
Los Angeles County, described as follows:
Beginning at the most southerly corner of said Lot
19; ~hence narthwesterly along the southwesterly line
of said Lot to the most westerly corner thereof; thence
~M nartheasterly along the northvaesterly line of said

2. As consideratian for said real property including
land and improvements, City agrees to pay to Seller the sum of
~ 50.00
3. The consideration herein se~ forth shail be pa~d to
Seller within ten days a~'ter City has received at its expense a
policy of title insurance showing titile ~o said property vested in
the City of Santa Monica', a municipal corporation, free and clear
of all liens, encumbrances, assessments, easements and leases
(recorded and~or unrecorded), and taxes, except covenants, conditions
restricGions and reservations of record, if any.
4. City agrees to pay al3 eserow, partial reconveyance,
and recording fees incurred in this transaction, including
dacumentary stamp tax, if required.
5. Any or all rnoneys payable under this contrac'c, up to
and ineluding the total amount of unpaid prineipal and interest on
note(s} secured by mortgage(s), or deed(s), of trust, if any,
together with penalty (if any) for payment in full in advance of
maturity, shall, upon demand(s~ be made payable to the rnortgagee(s)
ar beneficiary{s), entitled thereunder; said mor~gage(s) or
beneficiary(s} to furnish Se11er with good and sufficient receipt
showing said moneys credited against ~he indebtedness secured by
said mortgage(s) or deed{s) of trust.
6. Gity agrees at its expense to adjust any existing
underground utilities which may be disturbed by the widening and to
adjust any presently existing sprinkler system.
7. City agrees at its expense to re-install any exis~ing
curb, gutter and sidewalk at the time the street itnprovement is made,
~o re-install the existing driveway with Portland cement con~rete l~+
feet in width and located 7 feet southerly from the northerly line
of said Lot 19, and if necessary, to adjust the sidewalk and driveway
on Seller's premises to meet the new sidewalk grade for a reasonable

distance ~'rom the new property line, as determined by the City
Engineer and Superintendent of Streets.
8. Where necessary, City agr~;es at its expense to slape
the ground at the new property line to meet the new sidewalk grade.
Said slope shall not be flatter than 2 ta l. City shall have the
right ~o enter upon Seller's remaa.ning property to perfarm any
necessary v~ork.
9• Th3,s contract shall be binding upon and shall inure
to the benefit of the successors and assigns of the parties.
10. Seller shall execute a grant deed to the real
property described in paragraph 1 hereof a~ the time of the
exeeution of this contract.
