A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ACCEPTING A QUIT
CLAIM DEED FROM THE UNITED STATES OF
AMERICA TO CERTAIN WATER FACILITIES.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1. That certain Quit Claim Deed dated the
13th day of May~ 1955, wherein the United States of America
quit claims to the City of Santa Monica~ the following des-
cribed property:
Parcell. A perpetual easement to construct~
operate and maintain~ with all necessary valves
and other appurtenances" a twenty-inch (20")
pipe line along those certain streets and
portions of streets in the City of Los Angeles
described as follows:
Bundy Drive from the southeasterly line
of Rochester Avenue to the northwesterly line
of the Arcadia ReserVOir located on Lot38~
Tract No~_8038~ as per map recorded iii-BooK
118, pages 46-and 47 of Maps, Records of
Los Angeles County;
Rochester Avenue from the northeasterly
line of Bundy Drive to the northwesterly line
of Santa Monica Boulevard; Santa Monica Boulevard
from the common boundary between the Cities of
Los Angeles and Santa Monica to the southwesterly
prolongation of the southeasterly line of that
portion of Rochester Avenue extending north-
easterly from Santa Monica Boulevard.
Parcel 2:
A: Perpetual easements to construct~ maintain~
operate, patrol~ recon8truct~ repair" remove"
replace, increase and/or change the number and/
or size of pipes" pipelines" hydrants, accessor-
ies and appurtenances for the conveyance and
distribution of water over, under" along and
upon, from property line to property line in
each of the hereinafter designated roads,
streets, alleys and pUblic ways within the
incorporated area of Santa Monica, together
with the right to connect to and utilize for
any and all of the above enumerated purposes,

l. Santa Monica Boulevard from the easterly
limits of Santa Monica to the westerly
line of Franklin Avenue;
2. Franklin Avenue from the southeasterly
line of Santa Monica Boulevard to the
southeasterly line of Nebraska Avenue;
3. A strip of land ten feet (10') in width
crossing Olympic Boulevard at right angle
to the nODtherly line of Olympic Boulevard,
the center line of which is 454.86 feet
from the southwesterly line of Centinela
Avenue measured along the northerly line
of Olympic Boulevard.
4. Exposition Boulevard from the westerly
line of Dorchester Avenue to the easterly
line of Warwick Avenue as shown on Official

EXPosition Boulevard to the Northwesterly

line of Ocean Park Boulevard;

the Housing and Home Finance Administrator conveying all of the
Government's ri ght, ti tIe, and int.erest in an d to the subject water
facilities to the City of Santa Monica. The conveyance is made
pursuant to Section (1) of Contract No. WAbky-1158 between the
Uni ted States of America and the Ci ty of Santa Monica.
As you know, it was necessary to delay deli very of the deed unti 1
such time as the City obtained consents or made other appropriate
arrangements with the City of Los Angeles and the Southern Pacific
Railroad respecting certain easements involved in the project.
Satisfactory arrangements now having been completed, the Quitclaim
Deed should be recorded at your convenience.

KNOW ALL MEN BY THESE PRESENTS: that THE CITY
OF LOS ANGELES, a municipal corporation of the state of
California, does hereby grant to the UNITED STATES OF
AMERICA the right to construct, operate and maintain,
with all necessary valves and other appurtenances, a
twenty-inch (20") pipe line to be used for the purpose
of transporting water under and along those certain
streets and portions of streets in the City of Los An-
geles described as follows:
Bundy Drive from the southeasterly line of
Rochester Avenue to the northwesterly line of the
Arcadia Reservoir located on Lot 38, Tract No. 8038,
as per map recorded in Book 118, pages 46 and 47 of
Maps, Records of Los Angeles County;
Rochester Avenue from the northeasterly line
of Bundy Drive to the northwesterly line of Santa
Monica Boulevard;
Santa Monica Boulevard from the common bound-
ary between the Cities of Los Angeles and Santa Monica
to the southwesterly prolongation of the southeasterly
line of that portion of Rochester Avenue extending
northeasterly from Santa Monica Boulevard.
The herein grant is made, however, subject to
the following conditions:
(1) That no greater width of said streets shall
be excavated than is reasonably necessary for the in-
stallation of said pipe line;
(2) That existing utilities in said streets
shall at all times be fully protected from damage or
interruption;

(3) That no service connections shall be made
from said water main to property within the Oity of Los
Angeles;
(4) That upon the completion at the installa-
tion ot sald pipe 11ne the excavation shall be retilled
and said streets reconditioned and re-surfaced in acoord-
ance wlth the specifications at the 0ity ot Los Angeles
so that the same shall be in as good condition as imme-
diet.ly prior to the installation of said pipe;
(5) That any trench made for the installation
ot said pipe shall not remain open for an unreasonable
length of ti_;
(6) That said pipe line shall be located in said
streets as directed by the Oity Engineer;
(7) That ingress and egress be provided at all
times for residents of property abutting upon such con-
struction work; and
(8) The rights and privileges hereby granted
Ire for the exclusive use of the United states of A_rica
end the grantee shall not sell, transfer, or assign any
ot said rights or privileges, in whole or in part, withat
the consent ot the ctty. Any such sale, lease, or assign-
ment shall ~ evidenced by duly exeouted instrument in
writing tl1ed in the ottice of the Oity Olerk.

Agent under and by virtue of an ordinanoe adopted by the

the City entered into a certain lease of War Public Works, dated as of July

during the term of the lease, if it was not in default under said lease and
