will and testa:ment bears date May 8th. 1896, and was admitted to
. l)robate by the order of the Superior Court of said County, mde
on the 16th day of October, 1901, in Case No. 4746 Probate in the
Register of Actions in &tid Court.- the said party of the first

IJart sold to the said ~l of Santa Monica, a municipal corpora-
tion. the party of the second part hereto, the right of way over
the real property hereinafter described. for the price of FIVE
DOI.LARS, subject to the condi Mon hereinafter contained; and,
WJtEIDjAS on or about the 21st day of April. 1902, the
party of the first part made a return of said sale to the said
Superior Court of the County and State aforesaid, which said
return was duly set for hearing on the 2nd day of !vfuy, 1902, and

the hearing thereof continued to the 6th day of ~~Yt 1902, and
on said day the said Superior Court, it being proved to it that
due and legal notice of more than ten days had been given as
required by law. of the hearing of said return.- made an order
confirming said sale and directing a conveyance to be executed
to the party of the second part, a certified copy of which order
of eonf'::lro..lltion was recorded in the office of sa,1dOounty Recor-
