This Indenture, Made the lOth day of December, A. D. 1897
Between John P. Jones and Georgina S. Jones, husband and wife,
of Gold Hill, 'Nevada, and J. J. C!rrillo a widower of Santa
Monica, Los Angeles county, California, the parties of the first
part, and M. H. Kimball and A. M. Guidinger of Santa Monica, Los
Angeles county, California, as trustees, the parties of the sec-
ond part.
Witnesseth: That in and for the consideration of the sum
of T en Dollars, lawful money of the united States of America,
in hand paid to the said parties of the first part, have re-
leased, remised and forever quitclaimed and do by these presents
remise, release and forever quitclaim to the said second parties
all that certain real property located, situated and being in
the Town of Santa Monica, County of Los Angeles, State of Calif-
ornia, and more particularly described as follows: Commencing
at a point in the Southeasterly line of 14th street, bearing
N. 440 45' VI. and distant 165 feet from the intersection of
the Southerly line of the Rancho San vicente, Santa Monica with
the Southeasterly line of 14th street; thence running from said
point of beginning; bearing N. 440 45' W. and distant 552 feet
along the south Easterly line of 14th street to a 3" x 3t1 stake.
Thence N. 450 15' E. and distant 490 feet to a post; thence S.
440 45' E. and distant 552 feet to a post; thence S. 450 15' W.
and distant 490 feet to the place of beginning, containing 6 21/100
acres, In trust never the less for the following uses and purposes.
First. That said grounds shall be used for sundry purposes

and the said trustees shall hold said grounds for the use and
benefit of the Town of Santa Monica, a municipal corporation,
and when said town is authorized by law to receive and maintain
a public cemetery then said trustees shall convey to said cesti-
que the whole of said property not theretofore conveyed by them
under the terms of this trust. That prior to the conveying of

said property to said town, the said trustees herein appointed,
may convey to pu~chasers of lots any such lot so purchased. The
money received therefor to be used in improving and beautifying
, said grounds and by said conveyances they shall provide for the
uniform system of laying out and beautifying said cemetery lots.
It is intended by these conveyances that said second par-
ties as trustees receive said lands as joint tenants and not as

tenants in common. On the death of one of said trustees the sur-
vivor shall hold said property subject to the same trusts as
now held by both, and shall have full power to act as sole
trustee under the powers herein granted.
