REGULATIONS AND PROVISIONS OF ORDINANCE NO. 656

Seotion 1. That PATTEN-BLINN LUMBER CO., a oorporation,
14 as the owner of those oertain premises situated in the City of Santa
15 Monica, County of Los Angeles, State of California, desol~ibed ast

17 nia, desoribed as follows:
Beginning at the most Easterly corner of Colo-
18 rado Avenue and Sixt~ Street, thence North-
easterly along the Southeasterly line of Colo..
19 rado Avenue 150 feet; thence Southeasterly a-
long a line measured at right angles to the
20 last described line 165 feet; thenee South-
westerly along a line measured at right an-
21 gles to the last described line 150 teet to
the Northeasterly line of Sixth Street, thenee
22 Northwesterly along the Northeasterly line of
23 Sixth Street 165 feet to the point of begin-
ning,
24 be, and it is hereby, granted a variance from the rules, regula-
25 tions and provisions of Ordinance No. 656 (Commissioners' Series),
26 entitled: ".An ordinance establishing districts within the City of
27 Santa Monica within which land uses, height of improvements, and re-
28 quisite open spaces for light and ventilation are regulated; adopt-
29 ing a map of said districts; providing for adjustment. and enf'orce-
30 ment of said ordinanoe; providing penal ties for violation of said
31 ordiI1anoe; and repealing Ordinanoe No~ 439 (Comndssioners' Series),

1 amendatory thereof or supplementary thereto, or in conflict with this
2 ordinanoe.", permitting PATTEN-BLINN LUMBER CO., or its lessee or
3 sucoessor in interest to use said premises for the purpose of operat-
4 ing a Boat Yard to be used for the repairing, building and selling
5 of boats and the sale of marine hardware and equipment.
6 The. t the City Council in grantingsa1d var.ianoe makes the
7 following finds of fact:
8 1. That there are exceptional and extraordinary oircum-
9 stances and conditions applicable to the property involved and to the
10 intended use of the premises that do not apply generally to the prop-
11 erty or class of uses in the same district or zone;
12 2. That suoh varianoe is necessary for the preservation
13 and enjoyment of a substantial property right of applioant; and
14 3. That the granting of such variance will not be mater-
15 ially detrimental to the public welfare of injurious to the property
16 or improvements in the district or zone inwhioh the premlses>are
17 located.
18 That the said variance 1s granted upon the foll9vi:tt'lS .co.n-

20 1. The oondi tional varianoe hereby allowed is conditioned
21 on the privileges granted herein being utilized within one hundred
22 and eighty (180) days from and after the effeotive date hereof, and
23 should the privileges authorized hereby fail to be exeoutedor util-
24 ized, or where some form of oonstruction work is involved suoh eon-
25 struot1on or some un! t thereof has not actually oommenoed within suet
26 one hundred and eighty (180) days and thereafter dilisent];,..p~()s.()ut-
27 ed to (lllmpletion, this ordinanoe shall be void and anYPI'~'V~~~g~sof
28 varianoe granted hereby shall lapse.
29 2. That there should be no means
30 said premises from Colorado Avenue.

3. That there should be at all
32 said premises for the purposes hereinabove
1 painted tight rence erected and maintained around the boundary of
2 said premises with the exception of building walls and driveways.

4. That there shall be no loud or unusual noises on said
4 premises especially between the hours of 10:00 P.M. and 6:00 A.M:

5. That no new structures shall be erected upon said
6 premises nor shall the present improvements be expanded.

6. The privileges herein granted applicant are restricte
8 to the building now situated on said premises.

Section 2. This ordinance is hereby declared to be an
10 emergency measure necessary tor the immediate preservation of the
11 public peace, health and safety and shall take effect and be in
12 force immediately upon its publication.

Section 3. The Commissioner of Public Safety, ex-officio
