To the City Council and City Staff ‐ While the residents on Ocean Front Walk were glad to have item 13B pass, we are  concerned that there were several comments that this item was only a concern about the Pier Deck. When one has a  cold, blowing your nose might give you some relief but it does cure it.    The vendors on the Pier Deck are all interconnected with the many off‐Pier activity and they are directly relate to the  other vendors and their supply trucks that enter the area.     In the North Beach Parking (Number 1N and in the area that was called the 1440 lot & sometimes in the 3N lot) there is  major activity that relates to the Vendors that are on the Pier Deck. This is one of the prime areas (between the Broad  Overpass and the homes) where the various trucks will come and unload the carts that end up on the pier (they also  have the additional supplies to restock). This is also one of the main areas they are doing their prepping of the food and  dumping in the city trash cans before the carts move on to the Pier Deck. At the end of the day when the carts return  from the Pier there is again plenty of dumping on the beach and trash cans before loading the carts back on to the  trucks.    Item 14 12/14/21 8 of 24 Item 14 12/14/21 14.A.a Packet Pg. 3881 The vendors have educated themselves on where there is no enforcement on dumping, where to park, and what types  of trucks they can use to transport carts.    To find a complete and long‐term solution to this issue, the report and proposed actions from it need to encompass all  of the city being effected by unlicensed vendors.    Thank you The residents on Ocean Front Walk/PCH have had to deal with the Unlicensed Vendors and their effects on the  neighborhood for the last few years. While this area is a public beach it is also a residential area, and the city should  provide resources to protect residents here like in any other residential area in the city.     The residents want to make sure that the report that is being requested from the City Manager covers the following  points.    1. Oversize Trucks – Oversize trucks continue to enter the parking lots and take the time to unload and leave. The  parking lot attendants are not calling parking enforcement to alert them.  I know as when I call enforcement,  they say they have not received any calls. Some residents have witnessed them getting paid to look the other  way. Once unloaded they leave the North Beach 1N lots, 1440/1550 lots, and park in other lots or on PCH in the  red zones. Stopping these trucks from even entering is a key to the supply chain.    2. Parking Enforcement – Most of the trucks and vendors arrive at approximately the same time of the day. I have  requested several times that the parking enforcement make a few schedule rounds at these times so they can  catch and ticket the trucks, rather than waiting for a call. The area for these rounds is less then a quarter mile  north and south of the pier, and not that far from police department building. In a matter of minutes the area  could be patrolled. This past weekend when I called to ask for parking enforcement to come and ticket, I was  asked several times if someone was in the truck. The Police have now declared that it is too dangerous to send  parking enforcement to ticket if someone is in or around the truck. So now the Police are allowing a declared  dangerous situation to be in a residential area. Most of the trucks have had dozens of tickets issued from the  efforts of residents calling.    3. Code Enforcement – Even though the residents have been calling for the last six months, Code Enforcement has  been restricted to the Pier deck. No Code Enforcement has been seen north of the pier for months. North of the  Pier is where most of the trucks come to unload the carts that end up on the Pier. We either need more Code  Enforcement in the area or a change in the daily rounds of the current ones.     4. Dumping – The unlicensed vendors continue to dump in trash cans and on the beach. It is typical at the end of  their day for them to dump as much as they can anywhere before loading their cart(s) into the trucks. If code  enforcement came at the end of the day more often to areas like the Broadway overpass, they would catch  them. As one Code Enforcement person said if we don’t see it then it has not happened. All one has to do is walk  north of the Pier to see the damage done by these vendors. The area with the new palm trees is a dumping area,  the beach is being dumped on, and Ocean Front Walk after spending all that money to rebuild is a dumping  ground.  It smells and is stained badly. The maintenance workers have increased their spray washing of the area,  but they are as frustrated as others in wasting time and resources that could be used in other areas.  Where  there use to be just one trash can at the Broadway overpass, there are now four to deal with all the extra  dumping. All of them are filthy and stink of rotting food and grease.     5. Combustible Fuel Restriction – This needs to be extended to all parking lots, unless the city is saying that tailing  gating with BBQs is legal. The cooking of corn can be dangerous as they set‐up is next to other parked cars.  There is plenty of grease on the parking lot surface to catch fire. The cooking of corn is one of the biggest  dumping issues as they dump at the end of the day the remaining dirty water and corn it in the plants, the  beach, or the parking lot.     Item 14 12/14/21 10 of 24 Item 14 12/14/21 14.A.a Packet Pg. 3883 Attachment: Written Comments (4881 : Written Public Comment) 4 6. Coordinated City Efforts – There has been little coordination between departments when called, as each  department indicates what they can do and tell you to call the other ones for other issues. Making residents  make multiple calls is not the most effective method to helping the city deal with this issue.  There needs to be  ONE phone number to call and then that dispatch coordinates the required city resources to address the  unlicensed vendor issue(s).    7. Beach Definition – There needs to be a more definitive definition of “Beach” / “Beach Area” as none is found in  the current code. Several codes refer to these words (“Beach” and “Beach Area”) but there is no definitive  definition found of the geographical area covered. We want to ensure that all areas west of these streets are  covered by the various new and existing ordinances/codes. I would propose that “Beach Area” is defined as the  area west of the street boundaries of Palisades beach Road (PCH), Appian Way, Ocean Ave, and Barnard Way.  This definition would then help to include all the target areas for enforcement (Parking Lots, OFW, Bike Path,  and Pier). This area is part of the Beach Overlay District (Chapter 9.20) and Oceanfront District (Chapter 9.14).  SMMC 9.14.010. While the current city vendor ordinance outlines where you can vend in this area we can agree  that unlicensed vendors are not an enhancement to the beach area.  SMMC 9.14.010 Purpose ‐ The purposes of the “Oceanfront” District is to:  A.    Maintain and enhance the beach area as an important visitor‐serving destination with lodging, restaurants,  shopping, and recreation that support it as a regional, national, and international tourist destination.  B.    Preserve the unique scale, character, and uses along the Ocean Front Walk and on the Santa Monica Pier.  Item 14 12/14/21 12 of 24 Item 14 12/14/21 14.A.a Packet Pg. 3885 Attachment: Written Comments (4881 : Written Public Comment) 6 C.    Protect the existing residential mix in the area while providing for coastal‐related, lodging, dining,  recreation, and shopping needs of tourists and others in the oceanfront area. Conditionally permit other uses such as  office, new residential, and cultural uses.                  D. Avoid the deleterious effects of uncontrolled growth and preserve the unique and diverse character of the  Santa Monica oceanfront by limiting the proliferation of excessive hotel, motel, and large restaurant development in the  oceanfront area. (Added by Ord. No. 2486CCS §§ 1, 2, adopted June 23, 2015)’  The City has the obligation to the State under the operating agreement (see excerpt attached) to maintain this  area. The unlicensed vendors and their activities are costing the city money and resources just to clean‐up and  at times due to lack of staff put the city out of compliance with the level of maintenance indicated in the  agreement.    2. Combustible Fuels ‐ Expand the Combustible Fuel restriction to include the Beach Parking Lots, Ocean Front  Walk (OFW), Bike Path, and Beach (SMMC 4.55.100 – Park and Beach – Fire Hazards see below). As mentioned in  point 1 above the definition of “Beach Area” should include the Pier, Beach Parking, OFW, and Bike path (with of  course city permitted event/activity in these allowed under Fire Department judgement). There is a safety issue  with unpermitted fuels used for cooking and fire next to parked cars, near homes, and pedestrians (see cooking  photos attached). At the lease the 25‐foot zone should be the distance from any home, car, or pedestrian  walkways.     SMMC 4.55.100 Park and beach—Fire hazards.                   The following activities shall be deemed to be fire hazards and are prohibited in all parks and beaches:  (a)          Making, kindling or using a fire, barbecue or portable stove, or burning charcoal, except upon a masonry  or concrete hearth, barbeque grills, or fire circle provided by the City for such purpose. The prohibition  contained in this subsection shall not apply to City‐produced events that receive a community event permit  pursuant to Chapter 4.68 authorizing a fire, barbecue or portable stove or burning charcoal.                  (b)          Storing flammable materials or combustible waste matter, as those terms are defined in the Fire Code,  within ten feet of a building or structure, or beneath a building or structure.                  (c)           Discarding any lighted match, cigarette, cigar, or other burning object in a manner that could cause  ignition of flammable materials or combustible waste matter.   (d)          Undertaking any activity in a park or beach area which constitutes a violation of the California Fire Code  as adopted at Section 8.40.010, or which constitutes an imminent and immediate danger to persons or property  in the judgment of authorized Fire Department personnel. (Amended by Ord. No. 2398CCS § 2, adopted  4/24/12)  3. Emergency Right‐of‐Way – An added ordinance (if not already on the books) is to designate that a portion of the  Pier, OFW, and Bike path are emergency fire and safety lanes and cannot be blocked by stationary (non‐moving)  activities. This would be similar to SMMC 3.12.360 3.12.360 Obstructing, leaving, or placing property on, or  sitting or lying on public rights‐of‐way or public property (this is for the Promenade/Downtown between the  hours of 6am and 1am). See attached photos as OFW is regularly used for emergency vehicles and the post  office. Obstruction of Mail is a fine and/or imprisonment up to 6 months.  https://www.law.cornell.edu/uscode/text/18/1701  The ordinance should also include that the OFW stone seats are for the enjoyment of beach area visitors and  that no vending is allowed on the seats as they are blocking public property from the public for the use it was  intended(see attached picture of vendors on seats near Perry’s).  Item 14 12/14/21 13 of 24 Item 14 12/14/21 14.A.a Packet Pg. 3886 Attachment: Written Comments (4881 : Written Public Comment) 7 4. On December 7, 2021 the Council engaged in political manipulation and violated its own resolution when it appointed Ms. Marasco to a Housing Commission seat that she had not applied for, and when it unlawfully "appointed" Ms. Buchanan to a designated seat by fewer that then the five required votes. Neither the Mayor, Mayor Pro Tem, City Clerk, City Attorney nor the Councilmembers reacted to what transpired during these appointments. It appears that the goal of Mayor Himmlerich and Councilmemer Davis (representing the interests of SMRR and SM Forward, respectively) was to neutralize Ms. Marasco as Ms. Buchanan's only challenger for the designated seat for a person with lived experience of homelessness. By appointing Ms. Marasco to a regular seat instead of the one she had applied for, the Mayor and Councilmember Davis figured the path to keeping Ms. Buchanan in her seat for year 11 and 12 of her tenure would be cleared. This was very important as both SMRR and SM Forward are looking to continue their influence on the Housing Commission through their pawn, Chair Buchanan who controls he Commission's agenda. Never mind that Ms. Buchanan had received a clear vote of no confidence from the public, including the homeless or formerly homeless community she's supposed to represent, who submitted about a dozen letters against Ms. Buchanan's reappointment. Ms. Buchanan had not received ONE letter of support from the community for her reappointment... Another applicant, Ms. Gina DeBacca, got caught in the political games played by Mayor Himmelrich and Councilmember Davis as well. Ms. DeBacca had applied for a regular seat on the Housing Commission as she does not qualify for either one of the designated seats. Yet Ms. DeBacca was nominated for the designated seat and pitted against Ms. Buchanan. Ms. DeBacca was not considered for one of the regular seats that she had applied for. This is despite the fact that Ms. DeBacca represents an ethnic minority (diversity is much desired by the Housing Commission), and a family long associated with the history of Santa Monica. The two appointments to the Housing Commission must take place as soon as possible to show respect for the democratic process and the desires of the applicants who had applied for specific seats on the Commission. The Mayor and Councilmember Davis owe the applicants and the public an apology for shamelessly moving the applicants around like pawns on a chessboard in their quest to keep special interest groups in control of the Housing Commission.
