I am in full support of 16D! I would like to comment on the Hotel11 Union sound issues. The amount of noise that they have been creating for hotel guests at the Fairmont, locals and residents in the area is way out of hand. The city needs to do something immediately ! Over this past holiday weekend the union had musicians blasting there so called music with horns and drums so loud that my wife and I while in the hotel attempting to talk with the front desk person had to talk at a very high volume and lean over the desk so they could hear us and so we could hear them. This is with the doors closed to Ocean Ave while in the Fairmont. Would any of you tolerate such a thing ?  Then we had lunch outside on the property and once again we had to lean over and talk very loud just so my wife and I could have a conversation. When we have been in Fig with all the windows closed we had to talk very loud to hear each other. This is NOT right and not acceptable!!!! They are playing games with the city in that I think there has to be 10 min of sound hitting a certain level on a city sound meter and if they stop for just 1 second the clock starts all over. They are play games with the city on this 10 min issue.   During this past holiday weekend I clocked the sound time and they did not stop and just keep going with the extremely loud noise well over the 10 minute limit for the city to monitor the noise. I called the SMPD on a number of occasions while on the Fairmont property and all that I’m told is that they have the right to picket. I have no issue with them picketing… it’s the level of noise disturbance that is my issue.   So I’d like to know from the city what my rights are along with others that are living in the neighborhood, for those staying the hotel, for those that eat at the hotel, for those that work at the hotel with regards to the sound issue???   Hotel 11 Union clearly have no boundaries… no respect for others… My wife and I will NOT stop going to the Fairmont under any circumstances – the city needs to take a stand with them. Picketing is one thing – loud noise that is disturbing others is a whole other issue ! Even when they went way over the 10 min limit I didn’t see anyone from the city telling them to turn the noise level down nor did I hear the noise level being reduced. In the past I have noticed that they will sometimes stop the noise at the 9 min mark and then as you all know the clock for monitoring starts all over again. They know how to manipulate the system.  So what is the city going to do about Hotel 11 Union… what can I do about the noise level and how they block the side walks with no respect for people walking on the city side walks… what can the Fairmont do about it…what can other hotels and business do about it… what can the neighbors do about it..? What if you lived in the area and were ill or elderly – how would you deal with it ? I feel really bad for everyone having to deal with this issue and not seeing the city doing anything about it.    The other thing is that if the city would look at various postings on the web you’d see that Hotel 11 Union is hurting business in our city. That means the city is getting a bad reputation – and is losing tax revenue because of them ! That is NOT good for our city and could cut into city services for those of us that live in the city… that work in the city.. that have a business in the city…    Thanks for all that you do for our city. It is much appreciated and I am so glad the city has the noise issue on the agenda. If you have any questions please let me know. I love our city – we have had our business in SM for decades – we are property owners – I’ve gone through the entire school system growing up and really don’t like what’s been going on with the Hotell11 Union people creating so much noise and disturbing a lot of people. Their leader Rick Berman, who embraces the nickname Dr. Evil, is a notorious corporate lobbyist who has fought against raising the minimum wage and expanding sick leave, represented tobacco companies in opposing limits on smoking in restaurants and bars, and fought environmental protections on behalf of oil and gas companies, among others. I urge that Mayor Pro Tem Negrete and Councilmember Brock listen to Santa Monica residents like me instead of wealthy corporations and the CUF. Santa Monica should not be doing the bidding of Rick Berman. I stand with the workers who are fighting for a dignified contract by expressing themselves in the ways they can. Research and experience show again  and again the same thing: protected bike lanes are good for everyone and reduce collisions and injuries for all road users  (including drivers) by 30‐50%.     Item 16E prioritizes measures to improve the efficacy of these road safety investments for both current and future  projects.     The City’s investments in Protected Bike Lanes encourage healthier active transportation options, provide a choice to  move around Santa Monica without driving a car and reduce GHG emissions helping move us toward our climate  goals.

At its core SB423 is a good governance bill;it prevents cities from delaying or denying projects that already comply with local zoning and design standards determined through local governments.SB423 does not upzone or rezone new land; furthermore,the bill only applies to cities that don't have a compliant housing element or are behind on their housing goals.It is in Santa Monica’s best interest to ensure that our neighboring cities are held accountable to build their fair share of housing. My primary concern with this proposal is the very real impact that it would have on workers who are currently striking in support of a fair contract for fair wages for their labor.     However, I do agree that we should continue utilizing and pursuing the ability to use (where we are not currently permitted to use) sound-activated devices to enforce vehicle noise limits. I personally live one block off of a major thoroughfare in the city and frequently experience disruptions as a result of very loud vehicles zooming down that street. It is a good idea to explore how we can better enforce California Vehicle Code 27150 and 27151 to improve the quality of life for Santa Monica residents and improve how Santa Monica workers and visitors experience our City.     I understand the desire to deploy sound-activated devices on the Promenade, but I urge the Council to consider the potential impacts on businesses on the promenade that emit more noise simply due to the nature of their business.
