SR 10-10-2023 5E City Council Report City Council Meeting: October 10, 2023 Agenda Item: 5.E 1 of 3 To: Mayor and City Council From: David Martin, Director, City Planning Subject: Adoption of Resolution Approving Final Map for Condominium at 2002 21st Street Recommended Action Staff recommends that the City Council: 1. Adopt a finding that the proposed project was previously analyzed in the certified 2002 21st Street Project Environmental Impact Report (State Clearinghouse No. 2007031019), and no further review is required pursuant to the California Environmental Quality Act; and 2. Adopt the attached resolution approving Final Tract Map No. 66625. Executive Summary This report transmits for City Council approval a Final Tract Map for the following condominium project. The Vesting Tentative Tract Map was approved by the Planning Commission on May 15, 2019. A timely filing of the Final Map was made to the County or City prior to the Map’s expiration date. According to Section 66452.6(d) of the Subdivision Map Act, once a timely filing is made to the County or City, subsequent actions of the local agency, including, but not limited to, processing, approving, and recording of a map, may lawfully occur after the map’s expiration date. Discussion TRACT MAP ADDRESS SUBDIVIDER UNITS 66625 2002-2018 21st St Park Virginia, LLC 19 The following table provides a brief summary of the project: 5.E Packet Pg. 338 2 of 3 Zoning District R2 (Low Density Residential) Parcel Area 28,935 SF Parcel Dimensions 203’ x 142.5’ Existing On-Site Improvements (Year Built) Six one-story residential buildings comprised of 15 rent-controlled dwelling units totaling approximately 8,985 SF and three garage structures constructed between 1935-1951 Rent Control Status 15 rent-controlled units, pending Ellis Act withdrawal. Historic Resources Inventory Status 2002 21st St designated Structure of Merit 2008 21st St designated Structure of Merit AHPP Compliance Payment of Fee A Vesting Tentative Tract Map application (06TM-021) was submitted to the City Planning Division on July 12, 2006, to create 19 residential condominium air space parcels on one land lot in the R2 Zoning District. After a public hearing and careful review of the record and staff recommendations, the Planning Commission approved a Vesting Tentative Tract Map for the above project on May 15, 2019. The action of the Planning Commission was based on its findings that the proposed subdivision will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, and is in conformance with all state and local laws and regulations, and applicable General Plan Elements. The Final Map conforms to the Tentative Map. As a vesting tentative tract map application, its associated approval confers a vested right to proceed with development in substantial compliance with the ordinances, policies, and standards in effect at the time the vesting map is deemed complete by the City. In this case, the application was deemed complete on July 12, 2006, and therefore the development is subject to the development standards of the Zoning Ordinance in effect at that time. The developer will be required to show proof of payment of the condominium tax of $19,000 prior to issuance of building permit. The Final Map has been approved by the Los Angeles County Engineer’s Office and certified by the City Engineer for 5.E Packet Pg. 339 3 of 3 conformance with the Tentative Map and conditions thereon, the Subdivision Map Act, and local ordinances pertaining to the subdivision. The City Engineer’s office indicates that there are no required off-site public improvements. Environmental Review In accordance with CEQA, this project was analyzed in the 2002 21st Street Project Environmental Impact Report (State Clearinghouse No. 2017031019) that was certified by the City on May 15, 2019. No substantial changes have occurred warranting the preparation of a subsequent EIR as set forth in Section 15162 of the CEQA Guidelines. Therefore, no further environmental documentation is required pursuant to CEQA. Financial Impacts & Budget Actions There is no immediate financial impact or budget action necessary as a result of the recommended action. Final Map Resolution - 2002 21st St 5.E Packet Pg. 340 1 City Council Meeting: October 10, 2023 Santa Monica, California RESOLUTION NUMBER _________ (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ACCEPTING AND APPROVING THE FINAL SUBDIVISION MAP FOR TRACT NO. 66625 TO SUBDIVIDE A PROPERTY AT 2002-2018 21st STREET WHEREAS, on May 15, 2019, the Santa Monica Planning Commission approved a vesting tentative tract map to create 19 residential condominium airspace parcels on one land lot at 2002-2018 21st Street; and WHEREAS, a timely filing of a final tract map was made to the County of Los Angeles prior to expiration of the vesting tentative tract map; and WHEREAS, pursuant to Section 66452.6(d) of the Government Code, if a timely filing of a final map is made to the City or County, then the City may process, approve, and record a final map after the expiration of the vesting tentative map; and WHEREAS, the final tract map conforms to the vesting tentative tract map; and WHEREAS, the City Council finds that the proposed subdivision is consistent with the applicable general and specific plans. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Final Map for Tract No. 66625 in the City of Santa Monica is hereby accepted and approved. SECTION 2.
