Recommended Action
Staff recommends that the City Council:
1. Introduce for first reading the attached ordinance to amend Chapter 4.68 of the
Municipal Code to add one additional 5K, one additional 10K race route, and to
adjust the start time for races to begin at 7a.m.; and
2. Adopt a finding of Categorical Exemption pursuant to CEQA Guidelines Section
15304 (minor alterations to land)
Summary
The proposed adjustment to the race routes would require an amendment to Chapter
4.68 of the Municipal Code. The proposed ordinance amendment allows for one
additional 5K and one additional 10K race route to be added to the Municipal Code, and
moves the earliest start time of a race from 7:30 a.m. to 7:00 a.m.
Discussion
The Community Event Policy and Municipal Code 4.68 were adopted by City Council in
June 2000. In adopting these policies, the Council recognized the substantial
community benefits that result from community events, including cultural enrichment,
promotion of economic vitality, health and wellness, and enhancement of community
identity. Community events may also provide critical funding support for local service
organizations. Administrative Instructions accompany the Municipal Code provisions to
provide a coordinated process for managing community events to ensure the health and

safety of event patrons, residents, workers, and other visitors; to prohibit illegal activities
from occurring at community events; and protect the rights of the community event
permit holders.
Each year the traditional foot races held in Santa Monica have proven to be highly
popular. As the popularity of the sport grows, desire by local organizers and avid
runners to increase opportunities for participation both in terms of the number of runners
and the frequency of races also grows. City staff and event organizers have been
working together to come up with creative solutions to how best to increase race
participation while mitigating any possible negative impacts upon traffic, city services,
local businesses, residences and neighborhoods along the race routes. Revising
current race routes was identified as a way to increase the number of race participants
by enabling races to be run on wider streets along the route. In addition to the proposed
changes to race routes, incorporating early start times would also create greater
opportunities for participation; both proposed changes support local race events to be
more lucrative and economically sustainable for local event producers who have
struggled in recent years to make ends meet during the Covid crisis and subsequent
economic downturn.
City staff have received an inquiry from an organization to add the new race routes and
earlier start time to allow for more race participants. There are currently three race
routes authorized per Chapter 4.68, Section 4.68.160 (SMMC), as listed below:
1. The ten-kilometer route (10K Ocean Route) begins at Beach Park No. 1 (Barnard
Way at Ocean Park Boulevard) and continues south to Barnard Way, follows the
bend to go east on Marine Street, north on Main Street, west on Colorado
Avenue, north on Ocean Avenue, east on San Vicente Boulevard to 14th Street
where participants will turn around and go west on San Vicente Boulevard, south
on Ocean Avenue to end at the 1500 block of Ocean Avenue (before the
entrance to the Pier ramp).

2. The first five-kilometer route (5K North City Route) begins at Seventh Street and
California Avenue, west on California Avenue to Ocean Avenue, north on Ocean
Avenue to San Vicente Boulevard, east on San Vicente Boulevard to Seventh
Street, south on Seventh Street to Georgina Avenue, west on Georgina Avenue
to Fourth Street, south on Fourth Street to California Avenue, east on California
Avenue to Seventh Street.
3. The second five-kilometer route (5K Ocean Route) begins at Beach Park No. 1
(Barnard Way at Ocean Park Boulevard) and continues south on Barnard Way,
follows the bend to go east on Marine Street, north on Main Street, west on
Colorado Avenue, north on Ocean Avenue to the 1000 block where participants
will turn around and continue south on Ocean Avenue to end at the 1500 block of
Ocean Avenue (before the entrance to the Pier ramp). The third five-kilometer
route (5K Ocean-City Route) begins at the 1400 block of Ocean Avenue, north
on Ocean Avenue, east on San Vicente Boulevard to 4th Street where
participants will turn around and go west on San Vicente Boulevard, south on
Ocean Avenue to end at the 1400 block of Ocean Avenue (at Santa Monica
Boulevard).
In addition, races/runs may be permitted on other streets in the City so long as the
majority of the race/run occurs outside of the City and that portion of the race/run within
the City does not exceed one-half mile in length. The City has historically issued a
permit for one such race per year, the Santa Monica -Venice Christmas Run, in early
December.
The proposed additional routes are as follows:
1. 10K route (10K Ocean-City Route) begins at the 1400 block of Ocean Avenue,
south on Ocean Avenue, east on Colorado Avenue, south on Main Street, west
on Pier Avenue, south on Nielson Way, east on Barnard Way, north on Main St,
west on Colorado Avenue, north on Ocean Avenue, east on San Vicente

Boulevard to 4th Street where participants will turn around and go west on San
Vicente Boulevard, south on Ocean Avenue to end at the 1400 block of Ocean
Avenue (at Santa Monica Boulevard).
2. 5K route (5K Ocean-City Route) would begin at the 1400 block of Ocean Avenue,
north on Ocean Avenue, east on San Vicente Boulevard to 4th Street, where
participants will turn around and go west on San Vicente Boulevard, south on
Ocean Avenue to end at the 1400 block of Ocean Avenue (at Santa Monica
Boulevard).
With these two new routes race organizers could host pre-race events nearby in Tongva
Park and host the finishing events on Third Street Promenade or surrounding
Downtown area. These new routes also allow for participants to park in Downtown
parking structures or take the Metro into Santa Moncia and walk to the race.
Based on safety considerations, the specific portions, or lanes of the roadway to be
used will be determined by City staff prior to issuance of the Community Event Permit.
Lane or street closures, when required, will be re-opened immediately after the last
participants pass through and police determine it is safe to re-open them. Efforts will
also be made to preserve access to businesses and scheduled activities along the
route. As with all City-authorized race routes, the hours and days of use and the number
of races per year will be restricted. Race organizers will be required to pay for all traffic
control services, bus rerouting supervisors, buying out metered spaces along the route,
and the mailing of neighbor notices. They would also be required to provide general
liability insurance as well as indemnification and participant release waivers.
To minimize impacts on residents and businesses along the route, and as is the case
with the other approved routes, staff proposes to restrict the day and time of the week
that the new route can be used. Races may only occur on Saturday and Sunday
mornings from 7:00 a.m. until 11:00 a.m. There shall be no more than a total of three (3)
5K and/or 10K races per year in the City regardless of route, with one of these races
occurring in May, and two in September, October, or November separated by at least

seven weeks. The use of both the 5K and 10K Ocean Routes on the same day by the
same organizer with simultaneous or staggered starts shall be considered as one race.
Impacts to Residents and Businesses Along the Race Routes
At present, street closures associated with 5K and 10K race routes can begin as early
at 6:30 a.m. with a race start time at approximately 7:30 a.m. Staff recommend
changing the race start time to 7:00 a.m. Streets are re -opened on a rolling basis when
deemed safe to do so by the Police Department. Streets can begin to be re-opened at
approximately 8:00 a.m. and continue until the end of the race, typically around 11:30
a.m.
Residents and businesses along the race routes are impacted by the street closures.
For residents, vehicle egress and ingress is limited or can be completely restricted
during street closures. For businesses, employers may need to make special
arrangements to determine where and how their employees can access work and if
special parking arrangements need to be made. Some businesses have also expressed
concern about negative impacts upon their customers who may be temporarily unable
to easily access their establishments.
Residents and businesses within 250’ along approved race routes must be notified in
writing prior to an event. In addition, as part of the Traffic Management Plan, race
organizers will be required to schedule and pay applicable fees for use of the electronic
messaging boards.
The Community Events Office will mail out the above notices on standard City forms
and pass the full cost of the notice and mailing service to the event organizer. City
Communications post Road Closure notices on the City website and inform residents
and businesses using social media channels.
Impacts to Race Organizers
Applications are accepted on a first-come, first-served basis and no more than one year
in advance. These additional race routes and expanded time will let race organizers,

including the Santa Monica Classic, to allow for more runners to participate in the race.
Additionally, race organizers could work closely with Downtown Santa Moncia Inc, to
host pre and post-race events on the Third Street Promenade and surrounding
businesses.

Environmental Review
The amended ordinance to allow for changes to the race routes is categorically exempt
pursuant to Section 15323 (Class 23 Normal Operations of Facilities for Public
Gatherings) of the California Environmental Quality Act (CEQA) guidelines. Class 23
consists of the normal operations of existing facilities for public gatherings for which the
facilities were designed, where there is a history of the facility being used for the same
or similar kind of purpose in where there is a past history of the facility being used for
the same or similar kind of purpose. The City’s street network has been previously used
for race events, and therefore, the amended ordinance to amend race routes is
categorically exempt from CEQA.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SECTION 4.68.160 RELATED TO 5K AND 10K RACE
ROUTES IN SANTA MONICA
WHEREAS, on May 8, 2001, the City Council adopted Ordinance No. 2008 (CCS),
adding Chapter 4.68 to the Santa Monica Municipal Code, the Community Events Law;
and
WHEREAS, the Community Events Law has been amended and refined on
several occasions to ensure the law conforms to constitutional requirements and to enact
appropriate modifications to the law based on experience, changing conditions in the City,
and community feedback; and
WHEREAS, the Council recognizes substantial community benefit in community
athletic events, including cultural enrichment, promotion of economic vitality, and
enhancement of community identity; and
WHEREAS, the Community Events Law has been highly successful in establishing
a coordinated process for community events thereby ensuring the health and safety of
event patrons, residents, workers, and other visitors and protecting the rights of
community event permit holders; and
WHEREAS, adding a new 5K and 10K race route and changing the start time for
races from 7:30 a.m. to 7:00 a.m. will allow for more race participants, will allow organizers
to stagger start times more efficiently, and will expedite reopening streets for public
access at the conclusion of the event; and

WHEREAS, other provisions of the ordinance remain unchanged, including a
restriction on the hours and days of use and the number of races per year.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 4.68.160 is hereby amended
to read as follows:
The procedures and criteria for conducting races/runs shall be as follows:
(a) There shall be one two ten-kilometer routes, and two three five-kilometer
routes;
(1) The first ten-kilometer route (10K Ocean Route) begins at Beach Park No. 1
(Barnard Way at Ocean Park Boulevard) and continues south to Barnard Way, follows the
bend to go east on Marine Street, north on Main Street, west on Colorado Avenue, north
on Ocean Avenue, east on San Vicente Boulevard to 14th Street where participants will
turn around and go west on San Vicente Boulevard, south on Ocean Avenue to end at the
1500 block of Ocean Avenue (before the entrance to the Pier ramp).
(2) The second ten-kilometer route (10K Ocean-City Route) begins at the 1400
block of Ocean Avenue, south on Ocean Avenue, east on Colorado Avenue, south on Main

(b) 5K North City Route races may only occur on Saturday mornings from seven-
thirty a.m. until eleven a.m.
(c) 5K Ocean Route, and 10K Ocean Route, 5K Ocean-City Route, and 10K
Ocean-City Route races may only occur on Saturday and Sunday mornings from seven-
thirty a.m. until eleven a.m.
(d) There shall be no more than a total of three 5K and/or 10K races per year in
the City regardless of route, with one of these races occurring in May, and two in

September, October, or November separated by at least seven weeks. The use of both the
5K and 10K Ocean Routes on the same day by the same organizer with simultaneous or
staggered starts shall be considered as one race.
(e) With the exception of one 5K race on the Saturday following Thanksgiving Day
using the 5K North City Route, there shall be no races on holidays or holiday weekends
including Memorial Day and the preceding weekend, Labor Day and the preceding
weekend, and Thanksgiving Day and the subsequent weekend including the Friday
following Thanksgiving Day.
(f) No vehicular races shall be permitted.
(g) Events which include multiple modes of travel (e.g., running and bicycling) shall
be permitted so long as the start times for different modes of travel are staggered.
(h) Prior to the issuance of a community event permit, City staff shall determine
the specific portions or lanes of the roadway that may be used by the participants. This
determination shall be based on safety considerations and the preservation of access to
businesses and other scheduled activities along the route.
(i) In addition to the routes established by subsection (a) of this Section,
races/runs may be permitted on other streets in the City so long as the majority of the
race/run occurs outside of the City and that portion of the race/run within the City does not
exceed one-half mile in length. Races permitted pursuant to this subsection shall not be
subject to the time/frequency requirements established in subsections (b) and (c) of this
Section.

SECTION 2. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
effect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed
this Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective 30
days from its adoption.

SUBJECT: Amendment to Municipal Code Section 4.68.160 Establishing a New
5/10K Race Route, Eliminating a 5/10K Race Route, and Modifying the
Permitted Race Time and Frequency Parameters
Introduction
This proposed Ordinance would authorize establishing a new 5/10K race route in Santa
Monica, eliminating a 5/10K race route that is no longer feasible, and modifying the
permitted race time and frequency parameters.
Backoround
City staff receives numerous inquiries from individuals and organizations interested in
holding 5K or 10K races near the ocean in Santa Monica. There are currently four race
routes authorized per the Events Ordinance (SMMC 4.68.160) and none is near the
ocean. The 5K and 10K routes in the southern part of the City, near Santa Monica
College, have never been used and the landscaped medians on the Pico Boulevard
section of the route, which were installed after the route was established, have created
problematic conditions for runners alongside traffic. The 5K and 10K routes in the
northern part of the City, near St. Monica's Church, are used annually by two different
groups in the same general time frame.

Discussion
Recognizing the need for a more appropriate and appealing race route and prompted by
a recent request to produce a race near the ocean, City staff (including representatives
from Community and Cultural Services, Police, Fire, Transportation Management,
Resource Management, and Big Blue Bus) have identified a proposed route that will
provide a "signature" Santa Monica route with an ocean view while minimizing impacts
to traffic circulation, businesses and residents. Similar to the limits applied to other
routes, races on the proposed route would be limited in number and to certain times and
days to address neighborhood and business district concerns.
The new route, described in detail in the proposed ordinance, starts in the south beach
area in Beach Park #1 at Ocean Park Boulevard, where there is plenty of adjacent
parking. The route should appeal to runners as it goes east on Barnard Way/Marine
Street, north on Main Street to Colorado Avenue, west to Ocean Avenue, continues
north on Ocean Avenue along Palisades Park to San Vicente and loops back to end
near the Pier entrance. Based on safety considerations, the specific portions or lanes of
the roadway to be used will be determined by City staff prior to issuance of the Event
Permit. Lane or street closures, when required, will be re-opened immediately after the
last participants pass through and Police determine it is safe to re-open them. To the
extent possible, efforts will be made to preserve access to businesses and scheduled
activities along the route. As with the other City-authorized race routes, the hours and
days of use and the number of races per year would be restricted. Race organizers

To minimize impacts on residents and businesses along the route, and as is the case
with the other approved routes, staff proposes to restrict the day and time of the week
that the new route can be used. A minimum number of weeks will be required between
races for both the new and existing routes. The current restriction, allowing one race
per quarter, is problematic because, although technically occurring in different quarters,
it is possible to have two races on the same route within one week of each other. This
practice has generated numerous complaints from affected neighbors.
The proposed Ordinance would authorize the use of the new 5/10K race routes near the
ocean, eliminate the 5K and 10K routes near Santa Monica College, and modify the
permitted race time and frequency parameters as follows:
Limit the number of races on Routes A and D (new 5K and 10K Ocean routes) to
no more than two races between January 1 and the weekend prior to Memorial
Day weekend and no more than two races between the weekend atter Labor Day
and the weekend before Thanksgiving with no less than 8 weeks between each
race. Races would be limited to Saturdays and Sundays; races would not be
allowed at other times.

Limit the number of races on Routes Band C (the existing routes which will now
be referred to as 5K and 10K North City routes) to one race per quarter on
Saturdays only, with no less than 8 weeks between each race;
All races must start no earlier than 7:30 a.m. and conclude no later than 11 :00
a.m.
Staff will carefully monitor race events and their impacts over the next 12 months and, if
necessary, return to Council to modify race routes and/or time/frequency parameters.
Budget/Financial Impact
The adoption of the attached, proposed Ordinance would have no financial impact.
Recommendation
It is respectfully recommended that the accompanying ordinance be introduced for first
reading.

of Los Angeles to the north, east, and south;
WHEREAS, the City's land area is small, being just 8 square miles and the City's
population is approximately 90,000; and

place to work or visit; and

with the City's ability to provide services to the entire community, and the impacts on
neighbors and others are minimized; and
WHEREAS, the City receives numerous inquiries from individuals and organizations
interested in holding 5K and 10K races near the ocean; and
WHEREAS, there are currently four race routes authorized by the Community
Events Ordinance; and
WHEREAS, none of these routes are currently near the ocean; and
WHEREAS, the 5K and 1 OK routes in the southern part of the City have never been
used and the landscaped medians on the Pico Boulevard section ofthe route installed after
the route was established would create conflicts between race participants and vehicles;
and
WHEREAS, the City has evaluated a proposed new official route in order to provide
a "signature" Santa Monica route with an ocean view while minimizing impacts to traffic
circulation, businesses and residents; and
WHEREAS, race organizers would be required to pay all City costs associated with
the race; and
WHEREAS, to minimize impacts on residents and businesses along the route, and
consistent with other approved race routes, the City will restrict the day and time of the
week that the new route can be used and establish a minimum number of weeks between
races for both the new and existing routes,
NOW. THEREFORE. THE CITY COUNCil OF THE CITY OF SANTA MONICA

SECTION 1. Santa Monica Municipal Code Section 4.68.040 is hereby amended to
read as follows:
4.68.160 Races-Runs-Walks.
The procedures and criteria for conducting
races/runs/walks shall be as follows:
a) There shall be two ten kilometer routes and two five
kilometer routes:
1) The first ten kilometer route (route A10K Ocean
Route) felfte begins at Beach Park #1 (Barnard Way at Ocean
Park Boulevard) and continues south to Barnard Way. follows

races between the weekend after Labor Dav and the weekend
before Thanksgiving each year. There shall also be a minimum
of 8 weeks between each race. Route B and Route C races may
occur on Saturday mornings from eight a.m. until two p.m.
d) No vehicular races shall be permitted.
e) Events which include multiple modes of travel (e.g.,
walking, running and bicycling) shall be permitted so long as the
start times for different modes of travel are staggered.
ill Prior to the issuance of a Community Event Permit.
City staff shall determine the specific portions or lanes of the
roadway that may be used by the participants. This
determination shall be based on safety considerations and the
preservation of access to businesses and other scheduled
activities alonQ the route.

streets in the City so long as the majority of the race/walk/run
occurs outside of the City and that portion of the race/walk/run

the time/frequency requirements established in subsections (b)
and (c) of this Section,

SECTION 2. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
affect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed this
Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective thirty
days after its adoption.

Recommended Action
Staff. recommends that the City Council introduce for first reading the attached
Community Events Ordinance establishing a marathon route segment and parameters
for authorizing and conducting a marathon utilizing this marathon route segment;
approve modifications to the City's Extended Event Policy to include large scale, single-
day commercial events in the 1550 Lot, and authorize the City Manager to negotiate
and execute all necessary event permits and license agreements for the 2010 LA
Marathon:
Executive Summary
On July 28,2009, Council received a staff report outlining a proposal to hold a portion of
the 2010 LA Marathon and the post-event festivities in the City of Santa Monica.
Council heard from over 40 members of the public supporting the LA Marathon and
directed staff to return with revisions to the City's Community Events Ordinance that
would establish a marathon race route in Santa Monica. Council also gave direction to
designate the south beach parking lots for licensure for commercial events based on a
proposed plan to use those lots for post-race activities. This report recommends
revisions to the Community Events Ordinance to establish a marathon route segment
and associated conditions for such races in the City. Since post-race activities are now
proposed for the beach parking lot at 1550 Pacific Coast Highway ("1550 Lot"),
designation of the south beach lots for licensure is no longer necessary.
Background
At its July 28th meeting, Council expressed its support for the LA Marathon, which will
be celebrating its 25th anniversary in 2010. The race, scheduled for Sunday, March 21,
2010, is being developed as a marquis running -event which will attract both elite,
international runners as well as runners from all over the country who want to participate

in a world-class event. Council heard from over 40 speakers who acknowledged the
prestige of the event and the attendant benefits it will bring to Santa Monica. The LA
Marathon garners extensive international, national and local media exposure. Race
organizers have identified several local service organizations that will receive
contributions from the 2010 race. They include: Heal the Bay, Sojourn Services of
OPCC, and Students Run LA. The 2010 LA Marathon will be the world's first major-city
marathon to achieve green certification with the Council of Responsible Sport. While
race organizers estimate that the economic benefit to the City over five years is $21
million (hotels, parking, meals), staff is unable to project an estimated benefit at this
time.
The City's Community Events Ordinanceallows 5 and 10K races within the City and
specifies times, routes and frequencies to minimize impacts. Current law also allows
10K races on a portion of the route proposed by the LA Marathon. And current law
allows races on undesignated routes so long as most of the race occurs outside of the
City as the LA Marathon would. However, the law allowing portions of races on
undesignated routes only applies if the portion of the race that is in the City does not
exceed a half mile, which the LA Marathon would.
In developing the Community Events Ordinance, it was the intent of the Council to protect
the rights of people to engage in expressive activities in the City's public places and to
establish the least restrictive and reasonable time, place and manner regulation of these
activities. However, races are not classified as expressive activities; they are athletic
events. Council further intended to create mechanisms for cost recovery and use
charges, to the extent authorized by law, while not unduly impacting the viability of
events.
Regarding the LA Marathon's proposal to use the 1550 Lot for post-event activities, use of
the City's beach lots for commercial purposes is regulated in two ways. The Community
Events Ordinance and regulations establish limits on usage, including limits on the
frequency, duration and number of spaces that can be used for permitted community

events. However, use of the 1550 Lot, specifically, is administered differently because
Council designated that lot for commercial activities pursuant to licenses negotiated by
the City in its entrepreneurial capacity. The City's guidelines for extended commercial
events promulgate policies that governs these activities. The 1550 Lot is also used for
community events when it is not licensed for commercial use.
Discussion
Proposed Route
At its July 28th meeting, Council directed staff to work with the race organizers to end
the race in Santa Monica as opposed to Vehice (Los Angeles) and return with a revised
marathon route. The LA Marathon organizers have proposed a new race route for 2010
dubbed "The Stadium to the Sea." This will be the first year that the marathon runs
through multiple jurisdictions including Los Angeles, West Hollywood, Beverly Hills, and
Santa Monica. The race begins at Dodger Stadium in Los Angeles and proceeds
through downtown Los Angeles, Hollywood, West Hollywood, Beverly Hills, and West
Los Angeles. The route enters Santa Monica orr San Vicente Blvd. at 26th Street. The
runners proceed west on San Vicente Blvd. to Ocean Avenue. The route continues
south on Ocean Avenue and instead of finishing in Venice, the finish line is now
proposed to end on Ocean Avenue immediately north of Santa Monica Blvd.
Upon crossing the finish line, racers continue walking south along Ocean Avenue where
they receive water, snacks, Mylar blankets and their medals. First aid tents will be
positioned on the west side of Ocean Avenue to provide assistance to runners.
With the finish line on Ocean Avenue, race organizers revised their original plan to hold
the post-event activities (family reunion/festival) in the south beach lots .and are now
proposing use of the 1550 Lot. Following the race, runners will proceed to the 1550 Lot
directly north of the Pier to be reunited with family and friends and for the post-race
festival.

Commercial Use of 1550 Lot
In December 2008, Council approved modifications to policies for licensing extended
events in the 1550 Lot. The intent of this policy was to generate substantial net revenue
to the Beach Fund by licensing part of the parking lot for commercial activities when
parking demand is seasonally low. To facilitate issuance of licenses for these events,
Council approved an on-going process allowing continuous application from event
producers. While the policy provides parameters and maximum timeframes for
extended commercial events, it does not specifically address large scale single or
multiple day commercial events, many of which meet the same criteria and have the
same impacts as longer. term events. For purposes of the LA Marathon, staff
recommends that Council modify the. existing extended events policy to include large
scale single or multiple day commercial events.
Revisions to Community Events Ordinance
The proposed revisions to the Community Events Ordinance expand the parameters for
conducting races by establishing one marathon route segment that begins on San
Vicente Boulevard at 26~h Street (the City limits) and continues west on San Vicente to
Ocean Avenue and south on Ocean Avenue to the end of the 1500 block Of Ocean
Avenue (before the entrance to the Pier Ramp).
In order to utilize this route segment, the marathon must be regional in scope (involve a
route that runs through multiple jurisdictions), attract elite and international runners, and
receive extensive national and international media exposure. Marathon organizers
must be able to demonstrate the capability to organize and operate a large, successful
marathon including possessing sufficient funding to finance the costs incurred in
organizing and holding the race and sufficient staffing to ensure its safe and efficient
operation.
The proposed revisions to the Community Events Ordinance allow marathons to only
occur on Sunday from 7:30 am to 6:00 pm and only one marathon per year will be

allowed to utilize the route segment. Preference will be given to applicants proposing
reoccurring marathons traditionally or historically associated with a particular date or
dates.
Financial Impacts & Budget Actions
Staff will negotiate a license agreement for use of the 1550 lot with LA Marathon, LLC.
All direct City staff time and expenses will be reimbursed by LA Marathon to achieve full
cost recovery by the City. Any other revenue generated from use of the 1550 Lot as
part of the license agreement will benefit the Beach Fund. A portion of this revenue will
offset the estimated loss in 1550 lot parking revenue due to spaces occupied by the to
Marathon however parking revenues at the south beach lots and the Civic Center
parking Structure are projected to increase since these will be locations to which
runners will be directed. While race organizers estimate that the economic benefit to
the City over five years is $21 million (hotels, parking, meals), staff is unable to project
an estimated benefit for 2010 at this time.

CCS), adding Chapter 4.68 to the Santa Monica Municipal Code, the Community Events
Code; and
WHEREAS, the Community Events Code provides a coordinated process for
managing community events to ensure the health and safety of event patrons, residents,
workers, and other visitors, to prohibit illegal activities from occurring at community events,
and to protect the rights of community event permit holders; and

WHEREAS, on weekdays, approximately 300,000 people are present within the City
and on weekends the number swells to as high as 500,000 people; and
WHEREAS, the density of the City and the number of people working or visiting the
City on a daily basis significantly impacts the ability of traffic to circulate on the City's
existing street network; and
WHEREAS, the City's street network is a grid system bisected by the Santa Monica
Freeway; and
WHEREAS, streets within this network are categorized into four functional
classification types, arterial streets, collector streets, feeder streets and local residential
streets; and
WHEREAS, arterial streets are generally the commercial arteries that keep traffic
moving throughout the City and have as their primary function the movement of vehicles
into and through the City and the service of adjacent commercial land uses; and
WHEREAS, the locations of the freeway interchanges and over crossings, as well
as the inter-relationships of City streets with those of the surrounding network in Los
Angeles, causes traffic to be concentrated on the City's arterial streets; and
WHEREAS, local residential streets are designed to serve adjacent residential uses
only; and
WHEREAS, arterial streets are expected to handle traffic volumes ranging from
34,000 to 61,000 average vehicle trips per day while local streets are desighed to carry
2,500 average trips per day; and

WHEREAS, due to the nature of the grid system, if an arterial street is blocked or
heavily congested, traffic will be diverted onto the nearest street which is typically a local
residential street; and
WHEREAS, residential streets are overwhelmed when traffic is diverted from arterial
streets and residents' peace and quiet enjoyment are significantly impacted; and
WHEREAS, since the arterial network already carries a significant volume oftraffic;
diverting or stopping the traffic will further deteriorate the levels of service for these
intersections and result in increased traffic into residential neighborhoods and degradation
of the vitality of commercial districts; and
WHEREAS, community events are, by definition, atypical and not necessarily
anticipated by or appropriately regulated by existing citywide ordinances; and
WHEREAS, the City regulates community events for the same reasons it regulates
land uses: to protect the health, safety and public welfare by regulating traffic, noise,
aesthetics, and other impacts; and
WHEREAS, community events often require the provision of public services,
including police, fire, transportation, and public works and additional maintenance of the
facilities they use; and
WHEREAS, community events often use facilities thatwould otherwise be available
to the public or generate revenue to the City; and
WHEREAS, managing community events requires ensuring that these events are
compatible in size and type of use with their sites, adequate services are provided for the
events, adequate cost recovery for these services is achieved, the events do not interfere

with the City's ability to provide services to the entire community, and the impacts on
neighbors and others are minimized; and
WHEREAS, there are currently four race routes authorized by the Community
Events Ordinance; and
WHEREAS. two of the race routes are for five-kilometer races and two are for ten-
kilometer races; and
WHEREAS, there are presently no routes for a marathon race; and
WHEREAS, the City has received a proposal to hold a portion of the 2010 L A
Marathon in the City; and
WHEREAS, participating in a race of this stature presents the City with a unique.
opportunity to be part of ainternationally-known, first-class event and receive significant
benefits therefrom including substantial economic benefits to local businesses and a
unique entertainment opportunity for City residents and visitors; and
WHEREAS, a race of this nature raises a number of public safety issues related not
only to race participants and spectators but potential impacts on the community at large,
including issues concerning the availability of assistance from and coordination with other
cities, the logistics and timing of closing and re-opening streets, traffic control and
management strategies, parking contingencies, and resident, visitor and emergency
access; and
WHEREAS, due to the significant impacts that such a race can generate, it is
essential that such races provide substantial benefit to the City and be significantly limited
in number and time of occurrence and that the race only be undertaken by a marathon

entity with the demonstrated capability to organize and operate a large, successful

WHEREAS, race organizers would be required to pay full cost recovery for all City
services and expenditures associated with or in any way connected to the race,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 4.68.160 is hereby amended to
read as follows:
4.68.160 Races-Runs-Walks.
The. procedures and criteria for conducting races/runs/ walks shall be as follows:
a) There shall be two ten-kilometer routes and two five-kilometer routes, and
one marathon route segment;
1) The first ten-kilometer route (10K Ocean Route) begins at Beach Park No. 1

two races between January 1 st and the weekend prior to Memorial Day weekend and no

bicycling) shall be permitted so long as the start times for different modes of travel are
staggered.
Prior to the issuance ofi a community event permit, City staff shall
determine the specific portions or lanes of the roadway that may be used by the
participants. This determination shall be based on safety considerations and the
preservation of access to businesses and other scheduled activities along the route.
g)am In addition to the routes established by subsection (a) of this Section,
races/walks/runs may be permitted on other streets in the City so long as the majority of
the race/walk/run occurs outside of the City and that portion of the race/walk run within the
City does not exceed one-half mile in length. Races permitted pursuant to this subsection
shall not be subject to the time/frequency requirements established in subsections (b) and
c) of this Section.
SECTION 2. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
affect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining

Executive Summary
This report supplements the staff report recommending proposed revisions to the policyforlicensingextendedcommercialuseofthe1550lot. Supplementary information
includes clarification of the review process and additional proposed guidelines which
reflect recommendations of the Pier Restoration Corporation (PRC) OperationsCommitteeandBoard. The PRC Board approved the revised policy which incorporatestheseadditionsatitsmeetingonDecember3, 2008.
Discussion
In response to the discussion with the PRC Operations Committee on November 20 and
its subsequent letter, staff recommends that the process for review of extended events
be clarified to include meeting with the PRC and Pier Lessees Association prior to
recommending final approval to the City Council. The PRC expressed concern that
decisions about extended events need to balance the size of the event footprint with the
duration of the event. For example, use of a small portion of the lot might be warranted

for a seven month stay while an event that occupies a large portion of the lot might be
limited to four months.
Proposed Additions to the Guidelines
The recommended guidelines for evaluating eligible events are modified from the
original report to those listed below. The additions, which reflect the recommendations
by the PRC Board on December 3, are underlined. Staff recommends that eligible
proposals be evaluated on the degree to which the event:
Offers a unique cultural or entertainment experience
Demonstrates clear measurable economic benefit to the City and local
businesses, including Pier lessees
Contains a rental fee that significantly contributes to the City's Beach
Fund.
Balances the amount of space allocated in the 1550 lot with the duration
of the event.
Addresses traffic and parking impacts through the provision of nearby
replacement parking, parking shuttles, public transportation, event
signage or similar mitigations.
Addresses neighborhood impacts such as noise and crowd control.
Includes a neighborhood communications plan that is sensitive to the
impacts and information needs of adjacent neighbors.
Minimizes environmental impacts and promotes sustainability through the
use of low-impact products and practices in the production and
management of the event
Limits concessions or services that are in direct competition with adjacentPierbusinessesandprovidesforcrossmarketingopportunitieswithlocal
businesses, including Pier lessees.

Provides educational outreach to regional school children.
Provides activities throughout the day (exhibition style events versus timed
performances):
Maintains as small a physical footprint as possible to preserve onsite
parking, maintain view corridors, and sites facilities to minimize neighborimpacts.
Allows for sufficient time to provide for comprehensive plan review and for
adequate coordination with City services and stakeholder groups.
In addition, staff recommends the following requirements of all licensees:
No extended event licenses shall be granted between Memorial Day and
Labor Day weekends annually.
The licensee must pay for all City costs and services associated with the
event, including but not limited to, police services for crowd/traffic control,fire safety officers, event licensing /liaison and location supervision,
parking staff, utility charges, sanitation services and
custodial/maintenance services. The City division responsible for the
service shall determine the costs to be borne by the licensee.
The licensee must meet standard City requirements for insurance,
indemnification, security, Police, Building and Safety, Fire Department,
recycling, clean-up, waste disposal and accessibility and receive all other
necessary governmental approvals.
The event must have aCity-approved traffic and off-site parking plan.

ROUTE SEGMENT
WHEREAS, on May 8, 2001, the City Council adopted Ordinance Number 2008
CCS), adding Chapter 4.68 to the Santa Monica Municipal Code, the Community Events
Code; and
WHEREAS, the Community Events Code provides a coordinated process. for
managing community events to ensure the health and safety of event patrons, residents,
workers, and other visitors, to prohibit illegal activities from occurring at community events,
and to protect the rights of community event permit holders; and
WHEREAS, Santa Monica is a coastal city in a prime location, bordered by the City
of Los Angeles to the north, east, and south;
WHEREAS, the City's land area is small, being just 8 square miles and the City's
population is approximately 90,000; and
WHEREAS, in addition to its large residential population, the City is a very desirable
place to work or visit; and

Recommended Action
staff recommends that the City Council introduce for first reading the attached
ordinance amending Santa Monica Municipal Code Chapters 3.36, 4.08, 4.55, 4.68 and
6.36 relating to permitted community events in the City's public spaces and parks.
Executive Summary
The City Council last amended the City's Community Events Law on September 22,
2009. Since then and primarily resulting from experience, community feedback, and
changes in City department organizations and titles, staff has identified a number of
event and park - related laws that need to be amended or rescinded. The attached
ordinance would accomplish this purpose by revising sections of the present Events
Code without substantially altering its substance, and by revising relevant sections of
the vending, fire and miscellaneous codes as they relate to events in public spaces and
parks.
Background
The City's Community Events Law, adopted on May H, 2001, was carefully crafted to
conform to rigorous First Amendment standards intended to protect rights of expression
in public places. As case law has continued to develop, the City has made a diligent
effort to ensure that its law conforms to constitutional requirements. This effort has
been very successful. The City's Community Events Law withstood a major legal
challenge and was upheld by the Ninth Circuit Court of Appeals. First readings for
previous changes to the Community Events Law were held October 23 2001, April 08
2003, July 26 2005, and September 22, 2009.

Discussion
Staff proposes that existing provisions of the Municipal Code be amended or rescinded
as noted below in an effort to clarify conditions, venues, and permit processes.
Unauthorized event participants (3.36.270). Rescind this section as it is
duplicative of another Code Section. Existing Section 4.68.100(b) (Prohibition
against interference with a community event) can be applied to unauthorized
participants at permitted events.
Ball playing on the sand (4.08.010). This section prohibits throwing, batting,
hitting, striking, or kicking any ball of any kind within 300 feet of the mean high
tide line of the Pacific Ocean. Modify this section to 1) allow ball playing on the
beach at permitted events; and 2) allow permittees, with City authorization, to
erect courts, diamonds or areas for the playing of ball on the public beaches.
The City regularly issues Event Permits for events on the sand such as sand
soccer, beach volleyball, and beach tennis.
Use of fire (4.55.100). Add barbeque grills to the list of City- provided cooking
devices allowed for community events. The code currently refers to "a City -
provided masonry, concrete hearth or fire circle" as places where making kindling
or using fire in a park is permitted. Event permittees need to be allowed to use
fire in City provided barbeque grills.
Community Events Committee - Membership (4.68.020) 1) Revise the list of
Event Committee members to include additional members and current
department names; and 2) delete reference to "Executive Committee." The
City's larger Event Committee is no longer structured to include an Executive
Committee.
Permit Required (4.68.040(d)). Add "Annenberg Community Beach House" to
the list of City facilities predominately used and approved by the Fire Department
or the Building Department as assembly spaces and exempt from the event
permit process.

Permit Required (4.68.040(f)). Rescind this section. The option of applying for
an Annual Event Permit to cover a specified number of "repeat, like" events at a
particular event venue was included in the initial events ordinance (2001). Due
to the complex nature of events and their many aspects, this is not a feasible
model and, as such, it was never implemented. Reviewing and responding to
individual event applications one at a time has proven to be a more practical
approach.
Use of Live Animals (4.68.060(f). 1) Eliminate language prohibiting animals in
parks and modify to allow only animals in parks when on leash. A number of
annual events in parks include the use of animals on leash and there has not
been a negative impact on the event or park users. 2) The Community Events
law currently does not address animals on the beach. Change to say "proposed
events will not include animals on the beach."
Review Process (4.68.060(0)). 1) Change to reflect that a permitted event's
transportation management/parking plan requires City approval by the City
division or division's as specified in the event's Requirements Letter provided to
applicant; and 2) delete reference in this section to a specific Division providing
the approval.
Denial /Revocation of Event Permits (4.68.070). Add the following as a reason for
denying an event permit: "The applicant has damaged City property and has not
paid in full for such damage or has other outstanding and unpaid debts related to
a prior community event issued by the City."
Departmental Service Charcles (4.68.080(d). To reflect current practice, add a
section stating "A permit application fee and /or administrative fee shall not be
required for permittees of events produced or co- produced by the City or by City -
funded entities contractually required to operate or oversee specific public
venues used for community events.
Appeals (4.68.090). 1) Change so that appeals to denial of community events
permits can be made to the Director of Community and Cultural Services and not

to the Chairperson of the Events Committee (unlike the Chairperson, the Director
is not involved in the processing of applications and will be impartial in rendering
a decision); and 2) change the number of days by which a decision will be made
to 10 calendar days for Category 1 events (recreation, spectator sports,
competition /contests, athletic events, circuses /fairs /carnivals, food related
events, sales /trade shows /business promotions, beach /park clean -ups, training
activities) and 1 working day for Category 2 & 3 events (expressive /First
Amendment events).
Temporary Event Siqnaqe (4.68.130). 1) Expand the permitted size of the logo
of a commercial sponsor or vendor at certain event sites. At park and beach
events, the logo may be included on a small area of the temporary sign, not to
exceed one square foot or five percent of the sign area, whichever is smaller. At
other events sites, including the Pier lot, beach lots, Third Street Promenade and
at the start and finish of race and walk routes, the logo of a commercial sponsor
or vendor is not to exceed 30% of the sign area. Continue to prohibit the logo of
tobacco sponsors; and 2) Add "to the extent possible" after "internally oriented"
This is to accommodate events whose site configurations do not make internally-
oriented signs possible.
Departmental Service Charges (4.68.140(a). Change language to reflect the
current practice which is that all departments charge the department producing a
City or City co- produced event for personnel /services. Change to: "In addition to
the payment of any applicable permit application and /or administrative fees, and
as detailed in the administrative guidelines adopted pursuant to this Chapter, all
permittees shall pay the for City departmental service charges incurred in
connection with or due to the permittee's activities under the permit ".
Parades (4.68.150). Change title from "Parade routes" to "Parades, Marches,
Processions, Walks" since this section applies to more than just parades.
Parades (4.68.150(a). Add "walks" to the list of activities and clarify that parade
routes must be used in one direction only. To minimize impacts on residents,

businesses and commuters, parade routes are intended for use in one direction
only so that the streets can be promptly re- opened as soon as the last participant
passes through.
Parades (4.68.150(d). Add "parades and walks" to list of activities and change
peak hours, during which the use of arterial streets is prohibited, from 4:00 to
6:00 p.m. to 3:30 to 7:00 pm. The City's Traffic Engineering Group has
recommended modifying the peak traffic hours based on current traffic patterns
in order to protect circulation.
Races (4.68.160). 1) Change title of this section to "Athletic Events." 2) Delete
reference to walks throughout section. Walks are typically fundraising or leisure
events and tend to use sidewalks so as not to incur the cost of Police traffic
control required for street closures. Walks also take longer to complete, making
it difficult to promptly reopen streets; and 3) Rescind the 10K North City Route.
The 10K North City Route (north of Reed Park) proved to be problematic by
creating challenges related to resident ingress and egress to the neighborhood.
The remaining routes include a 10K and 5K Ocean Route, a 5K North City Route,
and one Marathon Route.
Block Parties (4.68.190). 1) Change the title of the section to "Neighborhood
Street Events;" and 2) distinguish between the two types of street events and the
permit type that is required for the street closure as follows:
Residential Block Parties utilize a "neighborhood" street, as defined in the Land
Use and Circulation Element, for a block party for neighbors only. A "Permit to
Close a Public Street" is required
Widely- publicized and /or Public Street Events utilize a "neighborhood" street for a
non - moving event organized by a resident or business living or located on the
street to be closed and are publicized broadly. A "Permit to Close a Public Street"
and a "Community Events Permit" are required.

Vending Exemptions (6.36.030(b)). Rescind this section as it currently exempts
Any approved participant in any cultural arts and crafts show (pursuant to
Chapter 6.44)" from the no vending in the parks law. Section 6.44 was rescinded
in 2003. Vendors at permitted events are authorized via Section 6.36.030(d)
which states "Any approved participant in any community event authorized by the
City" is exempt from the no vending in the parks law.
Public Outreach
Event Committee members representing various City departments, as well as staff from
Downtown Santa Monica, Inc. and the Pier Restoration Corporation recently conducted
a thorough review of and suggested a number of changes to the Events Administrative
Instruction (AI). Many of the recommended changes to the Events Al shaped the
ordinance changes proposed in this report.

AMENDING SECTIONS 4.68.020, 4.68.040, 4.68.060, 4.68.070, 4.68.080, 4.68.090,
4.68.130, 4.68.140, 4.68.150, 4.68.160, 4.68.190, 3.36.270, 4.08.010, 4.55.100, AND
6.36.030 OF THE SANTA MONICA MUNICIPAL CODE RELATING TO PERMITTED
EVENTS IN PUBLIC SPACES AND CITY PARKS
WHEREAS, on May 8, 2001, the City Council adopted Ordinance Number 2008
CCS), adding Chapter 4.68 to the Santa Monica Municipal Code, the Community Events
Law; and
WHEREAS, the Community Events Law has been amended and refined on several
occasions to ensure that the law conforms to constitutional requirements and to enact
appropriate modifications to the law based on experience, changing conditions in the City
and community feedback on the operation of the law; and
WHEREAS, the Community Events Law provides a coordinated process for
managing community events to ensure the health and safety of event patrons, residents,
workers, and other visitors, to prohibit illegal activities from occurring at community events,
and to protect the rights of community event permit holders; and
WHEREAS, Santa Monica is a coastal city in a prime location, bordered by the City
of Los Angeles to the north, east, and south;

WHEREAS, the City's land area is small, being just 8 square miles and the City's
population is approximately 90,000; and
WHEREAS, in addition to its large residential population, the City is a very desirable
place to work or visit; and
WHEREAS, on weekdays, approximately 300,000 people are present within the City
and on weekends the number swells to as high as 500,000 people; and
WHEREAS, the density of the City and the number of people working or visiting the
City on a daily basis significantly impacts the ability of traffic to circulate on the City's
existing street network; and
WHEREAS, the City's street network is a grid system bisected by the Santa Monica
Freeway; and
WHEREAS, streets within this network are categorized by classification types
including Boulevard, Special Street, Commercial: Downtown, Commercial: Neighborhood,
Avenue: Major, Avenue: Secondary, Avenue: Minor, Avenue: Industrial, Neighborhood
Street, Shared Street, and Parkway; and
WHEREAS, Boulevard, Commercial: Downtown, Commercial: Neighborhood, and
Avenue: Major street are generally the commercial streets that keep traffic moving
throughout the City and have as their primary function the movement of vehicles into and
through the City and the service of adjacent commercial land uses; and
WHEREAS, the locations of the freeway interchanges and over crossings, as well
as the inter - relationships of City streets with those of the surrounding network in Los
Angeles, causes traffic to be concentrated on the City's commercial streets; and

WHEREAS, neighborhood streets are designed to serve adjacent residential uses
only; and
WHEREAS, due to the nature of the grid system, if a blocked or heavily congested,
traffic will be diverted onto the nearest street which is typically a neighborhood street; and
WHEREAS, neighborhood streets can be overwhelmed when traffic is diverted from
commercial streets and residents' peace and quiet enjoyment can be significantly
impacted; and
WHEREAS, since the street network already carries a significant volume of traffic,
diverting or stopping the traffic will further deteriorate the levels of service for these
intersections and result in increased traffic into residential neighborhoods and degradation
of the vitality of commercial districts; and
WHEREAS, community events are, by definition, atypical and not necessarily
anticipated by or appropriately regulated by existing citywide ordinances; and
WHEREAS, the City regulates community events for the same reasons it regulates
land uses: to protect the health, safety and public welfare by regulating traffic, noise,
aesthetics, and other impacts; and
WHEREAS, community events often require the provision of public services,
including police, fire, transportation, and public works and additional maintenance of the
facilities they use; and
WHEREAS, community events often use facilities thatwould otherwise be available
to the public or generate revenue to the City; and
WHEREAS, managing community events requires ensuring that these events are
compatible in size and type of use with their sites, adequate services are provided for the

events, adequate cost recovery for these services is achieved, the events do not interfere
with the City's ability to provide services to the entire community, and the impacts on
neighbors and others are minimized; and
WHEREAS, the City's Community Events Law has been in place for over a decade
and has been highly successful in establishing a coordinated process for community
events thereby ensuring the health and safety of event patrons, residents, workers, and
other visitors and protecting the rights of community event permit holders; and
WHEREAS, based on experience, community feedback and changes in City
department organizations and titles, staff has identified a number of non - substantive,
minor, or clean -up revisions to the Community Events Law that need to be made in an
effort to clarify conditions, venues, and permit processes, to ensure consistency between
various sections of the Municipal Code, and to improve the operation of this regulatory
system,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 4.68.020 is hereby amended to
read as follows:
4.68.020 Community Events Committee — Membership.
There is hereby created a Community Events Committee to carry out the
provisions of this Chapter. This Committee is comprised of representatives of City

departments, including, but not limited, to the following departments: Big Blue Bus, City
Manager's Office, Community and Cultural Services, EnViFGRmental aR4 Public Works

ntHousing and Economic Development. The Committee may also include
representatives from City- funded entities whose contractual obligations with the City
include operation or oversight of public venues used for community events. The

SECTION 2. Santa Monica Municipal Code Section 4.68.040 is hereby amended to
read as follows:
4.68.040 Permit required.
Except as otherwise provided by this Chapter or other applicable law, rule or
regulation or any permit or license issued hereunder or pursuant to the terms of a permit,
lease, or contract which has been specifically authorized by the City Council, a Community
Event Permit shall be required to be obtained from the Community Event Committee for
the following activities:
a) A parade, procession, march or assembly consisting of persons, animals,
vehicles, or any other combination thereof, which is to assemble or travel in unison on any
public street, highway, alley, sidewalk or other City- designated public way and which either
1) may impede, obstruct, impair or interfere with free use of such public street, highway,

alley, sidewalk, or other public way owned, controlled, or maintained by the City or (2) does
not comply with normal or usual traffic regulations or controls;
b) Any activity or event involving one hundred fifty or more persons on City
owned, controlled, or maintained property not subject to the requirements of subsection (a)
of this Section;
c) Any activity or event on public property which requires the placement of a
tent, canopy, or other temporary structure if that placement requires a permit from the
City's Fire Department or Building and Safety. Division.
d) Notwithstanding the above, events at facilities located on City property that
are predominately used and approved by the Fire Department or the Building Department
as assembly spaces do not require a Community Event Permit so long as such events do
not require a street closure or traffic diversion or require the use of other public property
that does not constitute an assembly space. For purposes of this subsection, assembly
spaces include, but are not limited to, the Civic Auditorium, the Pier Carousel, City park
buildings, Annenberg Community Beach House, and Miles Memorial Playhouse.
e) School grounds and other property owned by the Santa Monica Unified
School District and the Santa Monica College are exempt from the requirements of this
Chapter.

M{g} Spontaneous events which are occasioned by news or affairs coming. into
public knowledge less than forty -eight hours prior to such event may be conducted on the
lawn of City Hall without the organizers first having to obtain a Community Event Permit. If
practicable, the organizers should give notice to the City' s Community Events Office at
least four hours prior to the event informing the City of the date and time of the event and
providing an estimate of the approximate number of persons who will be participating.
Events which require advance planning such as recreation events,
competition /contests /spectator sports, fairs, festivals, carnivals, ticketed events, sales /trade
shows or events which require a permit from Building and Safety or the Fire Department for
the placement of structures shall not be considered to be spontaneous events.
Departmental service charges may still be incurred for events undertaken
pursuant to this subsection to the extent otherwise authorized by this Chapter and the
administrative guidelines adopted pursuant to this Chapter.
SECTION 3. Santa Monica Municipal Code Section 4.68.060 is hereby amended to
read as follows:
4.68.060 Review process.
Subject also to Section 4.68.070, the Community Events Committee shall issue a
Community Events Permit, if it is determined that all of the following criteria have been met:
a) The proposed use of the property is not governed by or subject to any other
permit procedures provided elsewhere in this Code or other applicable laws, rules, or
regulations.

b) The preparation for or the conduct of the proposed use, event or activity will
not unreasonably or unfeasibly burden City resources necessary to preserve the public's
use of the street in the area contiguous to the street or other public property.
c) The preparation for or the conduct of the proposed use, event or activity will
not unduly impede, obstruct, or interfere with the operation of emergency vehicles or
equipment in or through the particular permit area or adversely affect the City's ability to
perform municipal functions or furnish city services in the vicinity of the permit area.
d) The proposed use, event, or activity does not otherwise present a
substantial or unwarranted safety, noise, or traffic hazard.
e) The proposed event will be of a nature and size appropriate to the proposed
venue, location, or site, will occur during a time period approved for that venue, location, or
site, and will fall within the frequency limitations established by administrative guidelines
adopted pursuant to this Chapter.
f) The proposed event will not include We animals on the beaches and will not
include animals in parks except on leashes.
g) A transportation management/parking plan has been approved by the City
for the event to the extent such a plan is
required by implementing regulations.
h) The proposed event will not cause other adverse impacts on health or safety
to surrounding residential or commercial uses, which cannot be effectively mitigated.

In deciding whether to approve an application, no consideration maybe given to
the message of the event, the content of speech, the identity or associational relationships
of the applicant, or to any assumptions or predictions as to the amount of hostility which
may be aroused in the public by the content of speech or message conveyed by the event.
SECTION 4. Santa Monica Municipal Code Section 4.68.070 is hereby amended to
read as follows:
4.68.070 Denial /revocation of permit.
The Community Events Committee shall deny an application for a Community
Events Permit or revoke a permit if the Committee finds any of the following:
a) One or more of the approval criteria specified in Section 4.68.060 is not met;
b) The applicant has knowingly made a false, misleading or fraudulent
statement of fact to the City in the application process;
c) The application does not contain the information required by this Chapter;
d) The application does not satisfy the requirements of this Chapter or the
administrative regulations adopted thereto;
e) The applicant fails to comply with any conditions of approval including, but
not limited to:
1) Remittance of fees, charges or deposits,
2) Submittal of an indemnification agreement and /or proof of insurance to the
extent required,
3) Timely receipt of all required approvals;

f) The applicant fails to agree as a condition of permit issuance that if City
property is destroyed or damaged by reason of permittee's use, event or activity and the
damage or destruction is directly attributable to the permittee, the permittee shall reimburse
the City for the actual replacement or repair cost of the destroyed or damaged property.
g) The applicant has damaged City property and has not paid in full for such
damage or has other outstanding and unpaid debts related to a prior community event
permit issued by the City.
SECTION 5. Santa Monica Municipal Code Section 4.68.080 is hereby amended to
read as follows:
4.68.080 Permit fees.
a) Except as otherwise provided by this Code or any other applicable law, rule
or regulation, or by the terms of a permit, license, lease or contract which has been
specifically authorized by the City Council, the permit application fees and other additional
fees and charges, including neighborhood notification fees, for the use of city streets or
other city -owned or controlled property pursuant to this Chapter shall be established by the
City Council by resolution.
b) An indigent natural person who cannot apply for a permit because of an
inability to pay the application fee due to such indigence may not be required to pay the fee
in accordance with administrative regulations or guidelines adopted pursuant to this
Chapter. Application for indigent status shall be made at the time of permit application and
shall be accompanied by such relevant information and documentation as may, in the

opinion of the City Manager or designee, be reasonably necessary to verify such status.
For purposes of this Section 4.68.080, "indigent natural person" means:
1) A person who is receiving benefits pursuant to the Supplemental Security
Income (SSI) and State Supplemental Payments (SSP) programs (Sections 12200 to
12205, inclusive, of the California Welfare and Institutions Code), the California Work
Opportunity and Responsibility to Kids Act (Cal WORKs) program (Chapter 2, commencing
with Section 11200 of Part 3 of Division 9 of the California Welfare and Institutions Code),
the Food Stamp program (7 U.S.C. Sec. 2011 et seq.) or Section 17000 of the Welfare and
Institutions Code;
2) A person whose monthly income is one hundred twenty -five percent or less
of the current monthly poverty line annually established by the Secretary of Health and
Human Services pursuant to the Omnibus Budget Reconciliation Act of 1981, as amended;
c) An organization in which a majority of its members meet the criteria for
indigent status, as established in subsection (b) of this Section, may also be eligible for
application fee waiver.
d) A permit application fee and /or administrative fee shall not be required for
permittees of events produced or co- produced by the City or by City funded entities
contractually required to operate or oversee specific public venues used for community
events.

SECTION 6. Santa Monica Municipal Code Section 4.68.090 is hereby amended to
read as follows:
4.68.090 Appeals.
Any applicant aggrieved by an adverse decision under Sections 4.68.060 or
4.68.070 may appeal such decision to the Director of Community and Cultural Services
by filing a written notice of such appeal
with the Committee within five business days of the decision. The Chairperson shall decide
the appeal within one working day unless the event is a Category 1 event as defined in the
Administrative Instruction implementing this Community Events Ordinance in which case
the appeal shall be decided within ten calendar days. The Chairperson's decision shall be
final except for judicial review.
SECTION 7. Santa Monica Municipal Code Section 4.68.130 is hereby amended to
read as follows:
4.68.130 Community event temporary signage.
Temporary or non - permanent sign(s) identifying or pertaining to the community
event may be installed by the permit holder, or designee; within the event site as defined in
the community event permit. At events on the City beach or at City parks, Tthe logo of a
commercial sponsor or vendor may be included on a small area of the temporary sign, not
to exceed one square foot or five percent of the banner area, whichever is smaller,
provided said sign(s) are internally oriented to the extent possible. At other event sites, the
logo shall not exceed thirty percent of the banner area provided the sign(s) are internally

oriented to the extent possible. Howeve;-,tThe logo of tobacco sponsors shall be
prohibited.
Directional signs for walks and races may be installed by the permit holder, or
designee, provided that each sign is less than two square feet in size, attached to a street
light or other utility pole at a height of between five and six feet without damaging the finish
of the pole, and installed less than two hours prior to the start of the event and removed
within one hour of the completion of the event. A plan showing the type and location of the
proposed directional signs must be submitted as part of the community event permit
application and be approved by the City. The City may remove signs that do not meet the
installation and removal requirements of this Section and shall charge the permittee for the
cost of this removal.
SECTION 8. Santa Monica Municipal Code Section 4.68.140 is hereby amended to
read as follows:
4.68.140 Departmental service charge.
a) In addition to the payment of the any applicable non - refundable permit
application fee and administrative fee, and as detailed in the administrative guidelines
adopted pursuant to this Chapter, a all permittees shall pay the City for City departmental
service charges incurred in connection with or due to the permittee' s activities under the
permit unless the event was City produGed or City GG prodUG8d.

b) City departments shall submit the final invoices and billings for department
charges to the permittee no later than ten working days after the expiration date of the
permit.
c) A permittee who claims an inability to pay department service charges due to
indigency may have these charges waived in accordance with administrative regulations or
guidelines adopted pursuant to this Chapter. Application for indigent status shall be made
at the time of permit application and shall be accompanied by such relevant information
and documentation as may, in the opinion of the City Manager or designee, be reasonably
necessary to verify such status. For purposes of this Section 4.68.140, "indigent natural
person" means:
1) A person who is receiving benefits pursuant to the Supplemental Security
Income (SSI) and State Supplemental Payments (SSP) programs (Sections 12200 to
12205, inclusive, of the California Welfare and Institutions Code), the California Work
Opportunity and Responsibility to Kids Act (CaIWORKs) program (Chapter 2, commencing
with Section 11200 of Part 3 of Division 9 of the California Welfare and Institutions Code),
the Food Stamp program (7 U.S.C. Sec. 2011 et seq.) or Section 17000 of the Welfare and
Institutions Code;
2) A person whose monthly income is one hundred twenty -five percent or less
of the current monthly poverty line annually established by the Secretary of Health and
Human Services pursuant to the Omnibus Budget Reconciliation Act of 1981, as amended.
d) An organization in which a majority of the members meet the criteria for
indigent status, as established in subsection (c) of this Section, may also be eligible for
waiver of department service charges.

e) No permittee shall be required to provide for or pay for the cost of public
safety personnel to provide for the protection of a community event and its attendees from
hostile members of the public or counter - demonstrations or for general law enforcement in
the vicinity of the event.
SECTION 9. Santa Monica Municipal Code Section 4.68.150 is hereby amended to
read as follows:
4.68.150 Parades, Marches, Processions. Walks. routes.
a) Subject to the requirements of this Chapter, a community event permit may
be issued for a march, procession, walk, or parade in either one direction only on the
following streets:
1) Ocean Avenue, between Adelaide Drive (northwest City limits) and Pica
Boulevard;
2) Commencing on Ocean Avenue at the intersection of Adelaide Drive
northwest City limits) and continue south on Ocean Avenue to the intersection of Colorado
Avenue, turning easterly on Colorado Avenue to the intersection of Main Street, turning
southerly on Main Street, ending at the intersection of Main Street and Pico Boulevard;
3) Commencing on Main Street, north of the entrance to the Civic Auditorium
parking lot and continue south on Main Street to the intersection of Marine Street, turning
westerly on Marine Street to the intersection of Barnard Way, turning northerly on Barnard
Way to the South Beach parking lot where the parade will disband;
4) Commencing on Main Street, north of the entrance to the. Civic Auditorium
parking lot and continue south on Main Street to the Santa Monica /Los Angeles border.

b) Minor adjustments to the routes established in subsection (a) of this Section
may be authorized by the Community Events Committee to the extent necessary to avoid
construction or other obstructions which would prevent the parade from proceeding on the
established route.
c) Subject to all other applicable requirements of this Chapter, this Section
does not prohibit the issuance of a community event permit for marches or processions on
other streets so long as through and cross - traffic can be preserved and the safety of the
marchers can be maintained.
d) Marches, parades, walks, and processions may not be conducted on streets
classified by the City as arterial streets between the hours of 7:00 a.m. to 9:00 a.m. and
4LO83:30 p.m. to 6:-98 7:00 p.m. on business days unless the march or procession is being
conducted to coincide with another event, not organized or planned by the permittee, which
is occurring on or adjacent to the arterial street upon which the march will be conducted.
SECTION 10. Santa Monica Municipal Code Section 160 is hereby amended to
read as follows:
4.68.160 Races .°.uns '.".arks Athletic Events.
The procedures and criteria for conducting races /runs/ -walks shall be as follows:
a) There shall be two one ten - kilometer routes, two five - kilometer routes, and
one marathon route segment;
1) The f+rst ten - kilometer route (10K Ocean Route) begins at Beach Park No. 1
Barnard Way at Ocean Park Boulevard) and continues south to Barnard Way, follows the
bend to go east on Marine Street, north on Main Street, west on Colorado Avenue, north

b) 5K North City Route and 1014 NGrth City Route races may only occur on
Saturday mornings from seven - thirty a.m. until eleven a.m. There shall be no more than
one race per quarter each year. There shall also be a minimum of eight weeks between
each race.
c) 5K Ocean Route and 10K Ocean Route races may only occur on Saturday
and Sunday mornings from seven - thirty a.m. until eleven a.m. There shall be no more than
two races between January 1 st and the weekend prior to Memorial Day weekend and no
more than two races between the weekend after Labor Day and the weekend before
Thanksgiving each year. There shall also be a minimum of eight weeks between each
race.
d) The marathon route segment shall be limited to the completion of marathon
races that are regional in scope (involve a course that runs through multiple jurisdictions),
attract elite and international runners, receive extensive national and international media
exposure, and are undertaken by a marathon entity with the demonstrated capability to
organize and operate a large, successful marathon including sufficient funding to finance
the costs incurred in organizing and holding the marathon and sufficient staffing to ensure
its safe and efficient operation. Preference shall also be given to applicants proposing
recurring marathons traditionally or historically associated with a particular day or dates.

The marathon may only occur on Sunday from six a.m. until six p.m. There shall only be
one marathon per year that utilizes the marathon route segment.
e) No vehicular races shall be permitted.
f) Events which include multiple modes of travel (e.g., walking, running and
bicycling) shall be permitted so long as the start times for different modes of travel are
staggered.
g) Prior to the issuance of a community event permit, City staff shall determine
the specific portions or lanes of the roadway that may be used by the participants. This
determination shall be based on safety considerations and the preservation of access to
businesses and other scheduled activities along the route.
h) In addition to the routes established by subsection (a) of this Section,
races /walks/runs may be permitted on other streets in the City so long as the majority of
the race /walk /run occurs outside of the City and that portion of the race /walk /run within the
City does not exceed one -half mile in length. Races permitted pursuant to this subsection
shall not be subject to the time /frequency requirements established in subsections (b) and
c) of this Section.

inconsistencies and no further, is hereby repealed or modified to that extent necessary to
affect the provisions of this Ordinance.

SECTION 17. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed this
Ordinance and each and every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether any portion of the ordinance
would be subsequently declared invalid or unconstitutional.
SECTION 18. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective thirty
days after its adoption.

Recommended Action
Staff recommends that the City Council:

5K and /or 10K race frequencies from a maximum of 8 races to a maximum of 3
races per year.
2. Review and comment on proposed options for expanding the neighbor
notification process to residents and businesses along the 5K and 10K race
routes from a 100' radius to a 250' radius.
Executive Summary
In response to Council direction, staff has reviewed the permitting process for 5K and
10K races in Santa Monica and developed a proposal to reduce race event frequencies.
The proposed adjustment to the race event frequencies would require an amendment to
Chapter 4.68 of the Municipal Code. This report also proposes expanding the current
neighbor notification process to residents and businesses along the 5K and 10K race
routes and throughout Santa Monica. The neighbor notification process is determined
administratively.
The proposed ordinance amendment allows for one 5K and /or 10K race using the
Ocean Route or one 5K race using the North City Route in the months of May,
September and November with restrictions on days, hours, holidays, and holiday
weekends. This proposed amendment would limit the number of 5K and /or 10K races
possible in the City from a maximum of 8 to a maximum of 3 per year not including a
race using the marathon segment. Staff also proposes to increase the neighbor
notification process from a 100' radius to a 250' radius along the race routes as well as
expand notification through the use of electronic media.
The proposed revisions would not apply to complete applications filed prior to October
22, 2013.

Background
At the June 1_1_ %01 I meeting, City Council approved Item 13 -B directing staff to review
the permitting process for 5K and 10K races in Santa Monica and consider adjusting
permitted race frequencies. In addition, Council requested that staff consider expanding
notification practices to include nearby and affected residents and businesses that may
not be located directly on the race routes.
To determine whether or not race event frequencies should be adjusted and neighbor
notifications expanded, staff reviewed existing relevant City codes and guidelines that
pertain to Community Events; reviewed past race event frequencies; researched race
frequencies and notification practices of surrounding cities; and conducted a public
meeting inviting race organizers, residents and businesses to discuss potential
changes.
Existing City Code
The Community Event Policy and Municipal Code 4.68 were adopted by City Council in
J ner 2000. In adopting these policies the Council recognized the substantial community
benefits that may result from community events, including cultural enrichment, promotion
of economic vitality and enhancement of community identity. Community events may
also provide funding opportunities for service organizations. Administrative Instructions
accompany the Municipal Code provisions to provide a coordinated process for managing
community events to ensure the health and safety of event patrons, residents, workers,
and other visitors, to prohibit illegal activities from occurring at community events and
protect the rights of the community event permit holders.
Per Chapter 4.68, Section 4.68.160 (SMMC), Athletic Events (races and runs) allows
street closures on the four routes listed below and detailed in Attachments A and B1 —

Race Event History from FY 2008/09 to Present
Over the past six years, there has been an increase in the number of race events that
have occurred in Santa Monica. Races using the 5K and 10K Ocean Routes on the
same day, by the same organizer, using a simultaneous or staggered start, are
considered one race. Between FY 2008/09 and FY 2012/13, race events increased from
two 5K /10K races per year to five races, including three 5K/10K races and two 5K
races. Two additional race events also received permits, including the LA Marathon
added in FY 2009/10) and the annual Santa Monica/Venice Christmas Run which
begins and ends in the south beach park and is primarily run in Venice.
Specific 5K and 10K race history is summarized below with more detail provided in
Attachment C:

To date, staff has received one application for a 5K/10K race using the Ocean Route
and one application for a 5K race using the North City Route for FY 2013/14, as well as
applications for the LA Marathon and Santa Monica/Venice Christmas Run. Staff has
also received inquiries from several other race organizers who expressed interest in
conducting new race events in Santa Monica.
Impacts to Residents and Businesses Along the Race Routes
Street closures associated with 5K and 10K race routes can begin as early as 6:30am
with a race start time at approximately 7:30am. Streets are re- opened on a rolling basis
when deemed safe to do so by Police and Traffic Service Officers. Streets can begin to
be re- opened at approximately 8:OOam and continue until the end of the race, typically
around 11:30am.
Residents and businesses along the race routes are impacted by the street closures.
For residents, vehicle egress and ingress is limited or can be completely restricted
during street closures. For businesses, employers may need to make special
arrangements to determine where and how their employees can access work and if
special parking arrangements need to be made. Businesses have also expressed
concern about customers not being able to easily access their establishments. Staff
receives several complaints each year regarding the impacts to parking and street
access that occur due to street closures associated with races. Residents, especially
along the race routes, are experiencing "race fatigue" due to the increased number of
race events over the past several years. Occasionally staff receives complaints

regarding the use of amplified sound at the start of races but mainly the complaints are
related to the frequency of races and the parking and access limitations for residents.
Portions of Ocean Avenue and San Vicente Boulevard are affected by each of the 5K
and 10K race routes, plus the Marathon Route Segment, consequently most of the
complaints received are from residents along these streets.
Other Cities' Practices
Staff researched surrounding cities including several beach communities to determine if
they permit race events, and if so, how many they allow. The number of race permits
issued varies for neighboring cities. The City of Los Angeles issues permits for
approximately 15 races per year to be held on the Westside while the City of Beverly
Hills permits only the LA Marathon to occur within its borders. Culver City permits one
5K/10K race while Hermosa Beach and Manhattan Beach permit between three and
five race events each year. Neighbor notification practices for other cities include
mailings, ads in local papers, hand - delivery of notices, and /or use of electronic message
boards. (Attachment D)
Public Outreach
On August 28, 2013, staff held a community meeting inviting race organizers, residents
and business owners, Staff also received written comments from people who were not
able to attend the meeting. Outreach regarding the meeting included distribution of
meeting notices to neighborhood associations, business improvement districts,
residents who had contacted the City regarding race events, current and past race
event organizers, ads in the Santa Monica Daily Press and the Santa Monica Mirror,
City TV, and via social media outlets Facebook and Twitter. Staff received comments at
the meeting and in writing from 21 people including three race organizers, sixteen
residents, one business owner, and one Convention and Visitors Bureau staff person.
At the meeting staff presented the current Community Events Ordinance, reviewed the
approved race routes outlining the courses, frequencies, days and times allowed, race
route history from FY 2008/09 to the present, and summary of other municipalities'

practices. Staff then presented the proposed option to reduce the race frequencies and
increase the distribution of neighbor notices along the race routes.
Although not exclusively, most residents that provided input were supportive of a
reduction in the number of race events or even elimination of race events. Comments
included:
loud noise generated on Sundays from bystanders cheering along routes
impact to traffic flow and access to parking in the downtown area
disruption to public transportation and the re- routing of buses
disruption and cancellation of tour bus services for foreign tourists
routes impact the same streets including Ocean Avenue and San Vicente and do
not allow egress or ingress to their residences
expanding neighbor notifications would be helpful
better and more traffic control to allow for frequent breaks and allow for cars to
move through intersections
continue race events as they are beneficial to the community bringing it together
in a positive manner, promote a healthy and active lifestyle
do not reduce the number of race routes however expand the notification system
to include use of social media and Google maps
Race organizers that attended the meeting acknowledged the impacts to residents
along the routes that occur as a result of the street closures. They were not supportive
of eliminating any of the approved race routes but were open to reducing the
frequencies. Specifically, they supported reducing the number of races allowable per
year using the 5K North City Route. Better use of social media to make residents aware
of the street closures and traffic impacts was suggested as well as canvasing the
neighborhoods along the routes with flyers one to two weeks before each race.

Races using the 5K and 10K Ocean Routes on the same day, by the same organizer,
using a simultaneous or staggered start, are considered one race.
Current law allows for a maximum of eight 5K and /or 10K races in a year, with five
having occurred in FY 2012/13. The proposed reduction in race event frequencies
would allow for a maximum of three 5K and /or 10K races and a race using the marathon
segment to occur in a year. (Attachment E) The proposed revisions would not change
subsection (h) of the ordinance that allows for races /runs to occur on other streets in the
City as long as the majority of the race /run occurs outside the City and that portion of
the race /run within the City does not exceed one -half mile in length. Staff has issued
one such permit each year in the past.
Impacts to Race Organizers
Restricting the number of races that can occur and to specific months may make it more
competitive between race organizers interested in conducting a race in Santa Monica.
Applications are accepted on a first -come, first -serve basis and no more than one year
in advance. If the proposed ordinance is approved, some of the long standing races
may not make it onto the schedule and will need to find other venues for their races.
Expanding Notification to Residents and Businesses
Current practice requires City staff to print and mail neighbor notices (postcards) two
weeks in advance to residents and businesses 500 ft. from the start and end point of
races. In addition, staff mails notices to residences and businesses within 100 ft. of the
race route. Race organizers are responsible for actual costs associated with the
neighbor notices including printing and postage charges per piece. However, staff print
and mail the notices. Staff proposes to expand mailing of neighbor notices to residents
and businesses within 250 ft. of the race route. This would require that the organizer
pay additional fees for printing and postage with estimated costs shown in the table
below and shown in Attachment F:

In addition, staff proposes the following to notify residents and businesses of street
closures due to 5K and 10K race events:

Alternatives
As an alternative to staff recommendations above, Council could consider the following
changes in race frequencies while maintaining proposed holiday and holiday weekend
restrictions.
Race Routes and Frequencies
No change in 5K and 10K race frequencies (maximum allowable 8). This
alternative may continue to draw complaints from residents and business owners
that experience race fatigue, especially if the maximum number of races
allowable is reached.

Allow one 5K and /or 10K race event in May and one 5K and /or 10K race

would likely reduce concerns from residents and business owners along the race
routes however may result in complaints from residents that participate in these
races and business owners that benefit from the races. This alternative would
reduce options for race organizers.

to promoters with a race having less than 1/2 mile of the route in the City.
Residents interested in participating in 5K and /or 10K races would need to find
races in other cities.
With regards to neighbor notifications, Council could consider the following alternatives
to staff's recommendation:

Achieve an expanded notification radius by requiring race organizers to take
responsibility for hand - delivering notices beyond the current 100' radius for City -
mailed notices. This alternative may result in notices left at doorsteps becoming
litter and does not ensure all households and business owners in the affected
area receive the notice.
Financial Impacts & Budget Actions
There is no immediate financial impact or budget action necessary as a result of the
recommended action. Race events will continue to be required to reimburse the City for
direct service costs associated with holding the race, including Police and Fire
personnel costs. Staff will return to Council if specific budget actions are required in the
future.

MUNICIPAL CODE 4.68.160 ATHLETIC EVENTS (CURRENT LAW)
The procedures and criteria for conducting races /runs shall be as follows:
a) There shall be one ten - kilometer route, two five - kilometer routes, and one
marathon route segment;
1) The ten - kilometer route (1 OK Ocean Route) begins at Beach Park No. 1
Barnard Way at Ocean Park Boulevard) and continues south to Barnard Way, follows the
bend to go east on Marine Street, north on Main Street, west on Colorado Avenue, north
on Ocean Avenue, east on San Vicente Boulevard to Fourteenth Street where
participants will turn around and go west on San Vicente Boulevard, south on Ocean
Avenue to end at the 1500 block of Ocean Avenue (before the entrance to the Pier ramp).
2) The first five - kilometer route (5K North City Route) begins at Seventh Street
and California Avenue, west on California Avenue to Ocean Avenue, north on Ocean
Avenue to San Vicente Boulevard, east on San Vicente Boulevard to Seventh Street,
south on Seventh Street to Georgina Avenue, west on Georgina Avenue to Fourth Street,
south on Fourth Street to California Avenue, east on California Avenue to Seventh Street.
3) The second five - kilometer route (5K Ocean Route) begins at Beach Park
No. 1 (Barnard Way at Ocean Park Boulevard) and continues south on Barnard Way,
follows the bend to go east on Marine Street, north on Main Street, west on Colorado
Avenue, north on Ocean Avenue to the 1000 block where participants will turn around
and continue south on Ocean Avenue to end at the 1500 block of Ocean Avenue (before
the entrance to the Pier ramp).
4) The marathon route segment begins on San Vicente Boulevard at Twenty -
Sixth Street (the City limits) and continues west on San Vicente to Ocean Avenue and
south on Ocean Avenue to end at the 1500 block of Ocean Avenue (before the entrance
to the Pier ramp).
b) 5K North City Route races may only occur on Saturday mornings from
seven - thirty a.m. until eleven a.m. There shall be no more than one race per quarter each
year. There shall also be a minimum of eight weeks between each race.
c) 5K Ocean Route and 1 OK Ocean Route races may only occur on Saturday
and Sunday mornings from seven - thirty a.m. until eleven a.m. There shall be no more
than two races between January 1 st and the weekend prior to Memorial Day weekend
and no more than two races between the weekend after Labor Day and the weekend
before Thanksgiving each year. There shall also be a minimum of eight weeks between
each race.

d) The marathon route segment shall be limited to the completion of marathon
races that are regional in scope (involve a course that runs through multiple jurisdictions),
attract elite and international runners, receive extensive national and international media
exposure, and are undertaken by a marathon entity with the demonstrated capability to
organize and operate a large, successful marathon including sufficient funding to finance
the costs incurred in organizing and holding the marathon and sufficient staffing to ensure
its safe and efficient operation. Preference shall also be given to applicants proposing
recurring marathons traditionally or historically associated with a particular day or dates.
The marathon may only occur on Sunday from six a.m. until six p.m. There shall only be
one marathon per year that utilizes the marathon route segment.
e) No vehicular races shall be permitted.
f) Events which include multiple modes of travel (e.g., running and bicycling)
shall be permitted so long as the start times for different modes of travel are staggered.
g) Prior to the issuance of a community event permit, City staff shall determine
the specific portions or lanes of the roadway that may be used by the participants. This
determination shall be based on safety considerations and the preservation of access to
businesses and other scheduled activities along the route.
h) In addition to the routes established by subsection (a) of this Section,
races /runs may be permitted on other streets in the City so long as the majority of the
race /run occurs outside of the City and that portion of the race /run within the City does nol
exceed one -half mile in length. Races permitted pursuant to this subsection shall not be
subject to the time /frequency requirements established in subsections (b) and (c) of this

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AMENDING SECTION 4.68.160 OF THE SANTA MONICA MUNICIPAL CODE
RELATING TO PERMITTED RACES /RUNS ON AUTHORIZED CITY STREETS
WHEREAS, on May 8, 2001, the City Council adopted Ordinance Number 2008
CCS), adding Chapter 4.68 to the Santa Monica Municipal Code, the Community
Events Law; and
WHEREAS, the Community Events Law has been amended and refined on
several occasions to ensure that the law conforms to constitutional requirements and to
enact appropriate modifications to the law based on experience, changing conditions in
the City and community feedback on the operation of the law; and
WHEREAS, the Community Events Law provides a coordinated process for
managing community events to ensure the health and safety of event patrons,
residents, workers, and other visitors, to prohibit illegal activities from occurring at
community events, and to protect the rights of community event permit holders; and
WHEREAS, Santa Monica is a coastal city in a prime location, bordered by the
City of Los Angeles to the north, east, and south;

WHEREAS, the City's land area is small, being just 8 square miles and the City's
population is approximately 90,000; and
WHEREAS, in addition to its large residential population, the City is a very
desirable place to work or visit; and
WHEREAS, on weekdays, approximately 300,000 people are present within the
City and on weekends the number swells to as high as 500,000 people; and
WHEREAS, the density of the City and the number of people working or visiting
the City on a daily basis significantly impacts the ability of traffic to circulate on the City's
existing street network; and
WHEREAS, the City's street network is a grid system bisected by the Santa
Monica Freeway; and
WHEREAS, streets within this network are categorized by classification types
including Boulevard, Special Street, Commercial: Downtown, Commercial:
Neighborhood, Avenue: Major, Avenue: Secondary, Avenue: Minor, Avenue: Industrial,
Neighborhood Street, Shared Street, and Parkway; and
WHEREAS, Boulevard, Commercial: Downtown, Commercial: Neighborhood,
and Avenue: Major streets are generally the commercial streets that keep traffic moving
throughout the City and have as their primary function the movement of vehicles into
and through the City and the service of adjacent commercial land uses; and

WHEREAS, the locations of the freeway interchanges and over crossings, as
well as the inter - relationships of City streets with those of the surrounding network in
Los Angeles, causes traffic to be concentrated on the City's commercial streets; and
WHEREAS, neighborhood streets are designed to serve adjacent residential
uses only; and
WHEREAS, due to the nature of the grid system, if blocked or heavily congested,
traffic will be diverted onto the nearest street which is typically a neighborhood street;
and
WHEREAS, neighborhood streets can be overwhelmed when traffic is diverted
from commercial streets and residents' peace and quiet enjoyment can be significantly
impacted; and
WHEREAS, since the street network already carries a significant volume of
traffic, diverting or stopping the traffic will further deteriorate the levels of service for
these intersections and result in increased traffic into residential neighborhoods and
degradation of the vitality of commercial districts; and
WHEREAS, community events are, by definition, atypical and not necessarily
anticipated by or appropriately regulated by existing citywide ordinances; and
WHEREAS, the City regulates community events for the same reasons it
regulates land uses: to protect the health, safety and public welfare by regulating traffic,
noise, aesthetics, and other impacts; and

WHEREAS, community events often require the provision of public services,
including police, fire, transportation, and public works and additional maintenance of the
facilities they use; and
WHEREAS, community events often use facilities that would otherwise be
available to the public or generate revenue to the City; and
WHEREAS, managing community events requires ensuring that these events are
compatible in size and type of use with their sites, adequate services are provided for
the events, adequate cost recovery for these services is achieved, the events do not
interfere with the City's ability to provide services to the entire community, and the
impacts on neighbors and others are minimized; and
WHEREAS, the City's Community Events Law has been in place for over a
decade and has been highly successful in establishing a coordinated process for
community events thereby ensuring the health and safety of event patrons, residents,
workers, and other visitors and protecting the rights of community event permit holders;
and
WHEREAS, the current Community Events Law provides for one ten - kilometer
route, two five - kilometer routes, and one marathon route segment; and
WHEREAS, over the past six years, there has been a significant increase in the
number of race events that have occurred in the City;
WHEREAS, more specifically, between FY 2008/09 and FY 2012/13, race events
increased from two 5K/10K races per year to five races, including three 5K/10K races

and two 5K races with two additional race events also receiving permits, including the
LA Marathon and an annual Christmas Run; and
WHEREAS, residents and businesses along the race routes are impacted by the
street closures with limited or entirely restricted vehicle egress and ingress and access
impacts for business employees and customers; and
WHEREAS, staff has received numerous complaints regarding these impacts to
residents and businesses; and
WHEREAS, residents are experiencing "race fatigue" due to the increased
number of race events over the past several years; and
WHEREAS, based on this experience, community feedback and input from City
departments, staff has identified proposed revisions to the Community Events Law to
reduce the frequency in which races may occur in an effort to mitigate the impacts
caused by street closures associated with such events of traffic circulation, vehicle
egress and ingress, noise, and access to parking.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 4.68.160 is hereby amended
to read as follows:
4.68.160 Athletic Events.
The procedures and criteria for conducting races /runs shall be as follows:

a) There shall be one ten - kilometer route, two five - kilometer routes, and one
marathon route segment;
1) The ten - kilometer route (10K Ocean Route) begins at Beach Park No. 1
Barnard Way at Ocean Park Boulevard) and continues south to Barnard Way, follows
the bend to go east on Marine Street, north on Main Street, west on Colorado Avenue,
north on Ocean Avenue, east on San Vicente Boulevard to 14th Street where
participants will turn around and go west on San Vicente Boulevard, south on Ocean
Avenue to end at the 1500 block of Ocean Avenue (before the entrance to the Pier
ramp).
2) The first five - kilometer route (5K North City Route) begins at Seventh
Street and California Avenue, west on California Avenue to Ocean Avenue, north on
Ocean Avenue to San Vicente Boulevard, east on San Vicente Boulevard to Seventh
Street, south on Seventh Street to Georgina Avenue, west on Georgina Avenue to
Fourth Street, south on Fourth Street to California Avenue, east on California Avenue to
Seventh Street.
3) The second five - kilometer route (5K Ocean Route) begins at Beach Park
No. 1 (Barnard Way at Ocean Park Boulevard) and continues south on Barnard Way,
follows the bend to go east on Marine Street, north on Main Street, west on Colorado
Avenue, north on Ocean Avenue to the 1000 block where participants will turn around
and continue south on Ocean Avenue to end at the 1500 block of Ocean Avenue
before the entrance to the Pier ramp).
4) The marathon route segment begins on San Vicente Boulevard at
Twenty -Sixth Street (the City limits) and continues west on San Vicente to Ocean

Avenue and south on Ocean Avenue to end at the 1500 block of Ocean Avenue (before

b) 5K North City Route races may only occur on Saturday mornings from
seven - thirty a.m. until eleven a.m. There -;hall he ne mere than one race per quarter

demonstrated capability to organize and operate a large, successful marathon including
sufficient funding to finance the costs incurred in organizing and holding the marathon
and sufficient staffing to ensure its safe and efficient operation. Preference shall also be

given to applicants proposing recurring marathons traditionally or historically associated
with a particular day or dates. The marathon may only occur on Sunday from six a.m.
until six p.m. There shall only be one marathon per year that utilizes the marathon route
segment.
f) With the exception of one 5K race on the Saturday following Thanksgiving
Day using the 5K North City Route, there shall be no races on holidays or holiday
weekends including Memorial Day and the preceding weekend, Labor Day and the
preceding weekend and Thanksgiving Day and the subsequent weekend including the
Friday following Thanksgiving Day.
eg) No vehicular races shall be permitted.
fh) Events which include multiple modes of travel (e.g., running and bicycling)
shall be permitted so long as the start times for different modes of travel are staggered.
gi) Prior to the issuance of a community event permit, City staff shall
determine the specific portions or lanes of the roadway that may be used by the
participants. This determination shall be based on safety considerations and the
preservation of access to businesses and other scheduled activities along the route.
j) In addition to the routes established by subsection (a) of this Section,
races /runs may be permitted on other streets in the City so long as the majority of the
race /run occurs outside of the City and that portion of the race / /run within the City does
not exceed one -half mile in length. Races permitted pursuant to this subsection shall not
be subject to the time /frequency requirements established in subsections (b) and (c) of
this Section.

SECTION 2. This Ordinance shall not apply to any complete race application
filed prior to October 22, 2013.
SECTION 3. Any provision of the Santa Monica Municipal Code or apprendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary
to effect the provisions of this Ordinance.
SECTION 4. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby declares that it would
have passed this Ordinance and each and every section, subsection, sentence, clause,
or phrase not declared invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. The City Clerk shall cause the same to be published once in the
official newspaper within 15 days after its adoption. This Ordinance shall become
effective thirty days after its adoption.

Dear Santa Monica City Council Members;
I am writing on behalf of Downtown Santa Monica, Inc. (DTSM, Inc.) regarding Santa Monica City Council Agenda Item
10B, the Staff recommendation to amend Chapter 4.68 of the Municipal Code to add one additional 5K, one additional
10K race route, and to adjust the start time for races to begin at 7AM.
The DTSM, Inc. Board of Directors has not taken a specific position on this item. However, DTSM, Inc. strongly supports
our local business community and all efforts to have residents and visitors engage in Downtown Santa Monica. Adding
additional routes that begin at the 1400 block of Ocean Avenue will bring thousands of racers and their supporters to
Downtown, and DTSM, Inc. commits to working with race organizers and our local businesses to encourage pre‐race
events and finishing events in Downtown.
