Subject: Award Purchase Order to Xylem Water Solutions USA, Inc for Purchase of
Two (2) Flygt Pumps
Recommended Action
Staff recommends that City Council:
1. Adopt a finding of categorical exemption pursuant to Section 15302
(Replacement or Reconstruction) of the California Environmental Quality Act
(CEQA) Guidelines.
2. Authorize the Procurement Manager to issue a purchase order with Xylem Water
Solutions USA, Inc for the purchase of two (2) Flygt pumps for the Public Works
Department. This recommended award is made as an exception to the
competitive bidding process pursuant to Section 2.24.250(b) and is for a total
amount not to exceed $300,000 with future year funding contingent on Council
budget approval.
Summary
The City of Santa Monica’s Public Works Department, Water Resources Division
collects and disposes of 14 million gallons of wastewater per day in the City; the
majority of the wastewater is conveyed to the City of Los Angeles’ Hyperion Treatment
Plant for treatment. The Moss Avenue Pump Station (MAPS), a critical part of
wastewater infrastructure in the City, is located adjacent to the Santa Monica Pier and
uses four wastewater pumps to convey the City’s wastewater to the Hyperion Treatment
Plant. The current wastewater pumps at MAPS are obsolete and continue to experience
service malfunctions and outages that put the City at risk of a major sewer overflow
event. Staff recommends that Xylem Water Solutions USA, Inc (Xylem) be awarded a
purchase order to provide two (2) Flygt replacement pumps, as an exception to the
competitive process, as the wastewater pumps are proprietary to Xylem and currently

have a long lead time (6-8 months) due to supply chain shortages. The equipment
replacement cost for MAPS is reimbursed by the City of Los Angeles.
Discussion
The City’s wastewater travels approximately nine miles south along the coast to El
Segundo and requires sewer lift stations along the way to convey it to the Hyperion
Treatment Plant. The MAPS is a partnership between the City of Los Angeles and the
City, where the City is responsible for operating the wastewater pump station and the
City of Los Angeles reimburses the City for operation and maintenance costs, including
equipment replacement. The four pumps currently in service at the MAPS are obsolete
and have required significant maintenance and repair due to clogs and corrosion
caused by the harsh environmental elements in the coastal environment. To ensure
reliable service at MAPS, the Water Resources Division has been renting an emergency
standby pump and generator for extended durations as two out of the four available
pumps have experienced prolonged service outages.
To improve operational reliability at the MAPS, staff is proposing to replace the
wastewater pumps at MAPS with Xylem’s proprietary NT 3356 pump, which uses a
patented N impeller to minimize clogging by materials such as rags, baby wipes, and
debris that typically plug conventional wastewater pumps. The Xylem NT 3356 pump
also provides superior corrosion resistance over the existing pumps.
Exception to Competitive Bidding
Staff recommends Xylem Water Solutions USA, Inc to furnish and deliver two (2) Flygt NT 3356
pumps as an exception to competitive bidding per Municipal Code 2.24.250(b). This purchase
meets the City’s exception to competitive bidding criteria (b), as the wastewater pumps
are proprietary to Xylem.
b. When a good or service is copyrighted, patented or only available from one license holder,
including, proprietary goods, original equipment manufacturers and/or exclusive distributors.
Environmental Review
The replacement of wastewater pumps at MAPS is categorically exempt pursuant to
Section 15302 (Replacement and Reconstruction) of the California Environmental
Quality Act (CEQA) Guidelines. Section 15302 exempts Class 2 projects which

“consists of replacement or reconstruction of existing structures and
facilities where the new structure will be located on the same site as the structure
replaced and will have substantially the same purpose and capacity as the structure
replaced”. The new wastewater pumps would replace existing wastewater
pumps with essentially the same purpose and capacity, and therefore, the wastewater
replacement pumps are categorically exempt from CEQA.
Financial Impacts and Budget Actions
Staff seeks authority to approve available funding from the Wastewater Fund to award a
purchase order to Xylem Water Solutions USA, Inc. for the purchase of two replacement
wastewater pumps at MAPS. The cost of purchasing the two replacement pumps will
be reimbursed by the City of Los Angeles as part of the agreement between the City of
Santa Monica and City of Los Angeles to operate MAPS and will be realized in FY
2023-24 when the reconciliation is submitted to City of Los Angeles for reimbursement.
