SR 04-11-2023 5F City Council Report City Council Meeting: April 11, 2023 Agenda Item: 5.F 1 of 2 To: Mayor and City Council From: Douglas Sloan, City Attorney, City Attorney's Office, Administration Subject: Adoption of Amended Conflict of Interest Code to Revise the Designated Positions as Required by California Law To File Statements of Economic Interest Recommended Action Staff recommends that the City Council update the City’s Conflict of Interest Code by adopting the proposed corrected Exhibit 1 reflecting positions subject to reporting requirements. Executive Summary On March 14, 2023, the Council adopted a Resolution adopting an amended City Conflict of Interest Code. Exhibit 1 to that Resolution outlined the various positions and reporting categories for each City department. That Exhibit inadvertently omitted the Finance, Fire, and Human Resources Departments. This Council action will adopt a corrected Exhibit 1 to attach to the Conflict of Interest Code resolution. Background The Political Reform Act of 1974 requires every state and local governmental agency to review and adopt a conflict of interest code every two years in order to help government employees avoid financial conflicts. This biannual review includes updating the City’s list of designated positions that are required to file Statements of Economic Interest, as reflected in the proposed resolution and Exhibit 1. The Council adopted an update to the Conflict of Interest Code on March 14, 2023, but that version inadvertently omitted three departments, so the Council is now being asked to approve a corrected Exhibit 1. 5.F Packet Pg. 558 2 of 2 Discussion A local agency’s conflict of interest code must reflect the current structure of the organization and properly identify officials and employees who should be filing Statements of Economic Interests (Form 700s). To ensure conflict of interest codes remain current and accurate, each local agency is required to review its code at least every even-numbered year. To comply with these requirements, the Office of the City Clerk and City Attorney’s Office, in conjunction with Human Resources, have conducted a review to update the list of designated positions that are required to file Statements of Economic Interest. Exhibit 1 contains the updated list of designated positions, including current titles and job duties, as well as disclosure categories. Environmental Review The update to the Conflict of Interest Code is not a project for the purpose of CEQA.
