Subject: Filling of an Unscheduled Vacancy on the City Council
Recommended Action
Staff recommends that Council either:
1. Consider the applicants that have declared their interest in being appointed to
the unscheduled vacancy on the City Council and make an appointment to fill
the City Council vacancy and serve until the next General Municipal Election in
November 2022; or
2. If the appointment cannot be made, adopt resolutions adding the partial-term
seat to requested services and consolidation with the County's November 2,
2021 election.
Executive Summary
At the June 2, 2021 Council Meeting, Council adopted a resolution declaring former
Councilmember Kevin McKeown’s seat vacant as of June 11, 2021 (the effective
date of his retirement). The City Clerk was directed to publish a legal notice for the
vacancy and invite online applications of those interested to be presented to the
Council at this meeting for possible appointment. 35 applications were received by
the 12 p.m. June 22, 2021 deadline (see Attachment A).
As provided for in Section 603 of the City Charter: (a) should Council appoint
someone to fill the vacancy, that person to serve through the next General Municipal
Election in November 2022; or (b) should Council fail to fill the vacancy within 30
days of June 11 (the effective date of the vacancy), Council shall forthwith cause an
election to be held to fill the vacancy, the person elected to serve out the remaining
term of the vacancy, through the next General Municipal Election in November 2022.

Background
California Elections Code Section 10220 provides that the filing period for any
elective office may be no earlier than the 113th day nor later than the 88th day
before a municipal election. Santa Monica Municipal Code Section 11.04.180
provides that the City Council may set the date of a special election on an
established election date as provided for by the California Elections Code or on any
other date as the City Council may select as permitted by law. Additionally,
California Elections Code Section 1002 requires that, except as provided in Section
1003, notwithstanding any other provisions of law, all municipal elections shall be
held on an established date as set forth in Elections Code Section 1000. For 2021,
the only possible election date is November 2, 2021.
Discussion
35 applications were received by the deadline set by Council, and of those 35
applicants, 34 met the minimum requirements to serve on the Council, which are to
be 18 years of age or older, residents and registered voters of the City of Santa
Monica. The list of applicants received by the noon deadline was posted on the
City’s website with a disclaimer explaining that the timestamp shown on each
application was the time that the applications were uploaded online, and not the
time received.
If Council makes an appointment to the vacant seat at this meeting, then the
appointee may be sworn in immediately and assume their seat or may be sworn in at
the next regularly scheduled meeting on July 13, 2021; after being sworn in, the
person appointed would serve until a new Councilmember is elected at the next
general municipal election, which will be November 8, 2022, as required under City
Charter Section 603.
If no appointment is made at this meeting, then in accordance with City Charter
Section 603, Council would be required to “forthwith cause an election to be held to
fill such vacancy.” As noted above, the only election date available in 2021 on
which such an election could be held is November 2, 2021, absent any earlier

special election that may be required in connection with the pending litigation in
Pico Neighborhood Association et al. v. City of Santa Monica. The Nomination
Period for this election would start on July 12, 2021. The person elected at any
special election would serve out the balance of the unexpired term, which runs
through the next general municipal election, which will, as noted above, be
November 8, 2022.
Financial Impacts and Budget Actions
Appointment of an applicant to fill the unscheduled vacancy will have no financial
impact. If Council does not make an appointment and calls for a special election to fill
the vacancy, then the cost of the election to consolidate with the County on their
November 2 election is estimated at $528,000. The costs associated with the
November election are not currently included in the City’s FY 2021-22 Budget. Staff
would return to Council at FY 2021-22 Midyear to request funding to cover the
election costs. The cost of the consolidated election will be pro-rated by the County
amongst participating cities and will depend on the number of cities that are
consolidating with the County.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
CALLING AND GIVING NOTICE FOR THE HOLDING OF A SPECIAL MUNICIPAL
ELECTION TO BE HELD ON TUESDAY, NOVEMBER 2, 2021, FOR ELECTION OF
A CITY COUNCILMEMBER TO FILL A VACANCY AS REQUIRED BY
THE CALIFORNIA ELECTIONS CODE AND PROVISIONS OF
THE SANTA MONICA CITY CHARTER
WHEREAS, a vacancy in the office of the City Council was created by the
resignation of Councilmember Kevin McKeown effective June 11, 2021; and
WHEREAS, the term of the office of the City Council in which the vacancy occurs
ends in November 2022; and
WHEREAS, Section 603 of the City Charter provides that a vacancy in the City
Council from whatever cause arising, shall be filled by appointment by the City Council,
such appointee to hold office until the first Tuesday following the next general municipal
election and until the appointee’s successor is elected and qualified, and that at the next
general municipal election following any vacancy, a Councilmember shall be elected to
serve for the remainder of any unexpired term; and
WHEREAS, Section 603 of the City Charter provides that in the event the City
Council shall fail to fill a vacancy by appointment within thirty days after such office shall
have been declared vacant, it shall forthwith cause an election to be held to fill such
vacancy; and

WHEREAS, on June 29, 2021, the City Council met and attempted to fill the
vacancy on the City Council by appointment but was unable to do so; and
WHEREAS, pursuant to Santa Monica Municipal Code Section 11.04.180, the City
Council is authorized to set the date of a special election by resolution and may set the
date of a special election on an established election date as provided for by the California
Elections Code or on any other date as the City Council may select as permitted by law;
and
WHEREAS, Section 12109 of the Elections Code authorizes the City Council to
provide that all ballots cast at the General Municipal Election be counted at a central
counting place;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. A Special Municipal Election shall be held in the City of Santa
Monica on November 2, 2021, which is the election required for the purpose of electing a
member of the City of Santa Monica City Council to fill the vacancy created by the
resignation of Councilmember Kevin McKeown with a term ending November 2022
(subject to change depending on the outcome of the California Supreme Court’s review
of the Court of Appeal’s ruling in Pico Neighborhood Association, et al. v. City of Santa
Monica, Los Angeles Superior Court Case No. BC616804, Court of Appeal Case No.
B295935, Supreme Court Case No. S263972).
SECTION 2. The ballots to be used at the Special Municipal Election shall be
both as to form and matter contained therein such as may be required by law.

SECTION 3. The City Clerk is authorized, instructed, and directed to procure and
furnish any and all official ballots, notices, printed matter and all supplies, equipment, and
paraphernalia that may be necessary in order to properly and lawfully conduct the
General Municipal Election.
SECTION 4. The polls for the Special Municipal Election shall be open at 7:00
a.m. on the day of the election and shall remain open continuously until 8:00 p.m. of the
same day when the polls shall be closed except as provided in Elections Code Section
14401.
SECTION 5. The notice of the time and place of holding of the Special Municipal
Election is hereby given; and the City Clerk is authorized, instructed, and directed to give
such further or additional notice of the election in the time, form, and manner required by
law.
SECTION 6. Pursuant to Elections Code Section 12109, the City Clerk is
authorized, instructed, and directed to give notice of the central counting place in the time,
form, and manner required by law.
SECTION 8. The City Clerk is directed to send a copy of this Resolution to the
Board of Supervisors and to the Registrar of Voters/County Clerk of the County of Los
Angeles.
SECTION 9. In the event the Special Municipal Election is consolidated with the
State, Local Municipal Election on the same date, the provisions of this Resolution which
are applicable only in the event the election is conducted by the City shall be of no force
or effect.

SECTION 10. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.

CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF
LOS ANGELES TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE
CITY OF SANTA MONICA TO BE HELD ON NOVEMBER 2, 2021, WITH THE
STATE, LOCAL MUNICIPAL ELECTION TO BE HELD ON SAID DATE PURSUANT
TO ELECTIONS CODE SECTION 10403, AND TO RENDER SPECIFIED SERVICES
TO THE CITY RELATING TO THE SPECIAL MUNICIPAL ELECTION
WHEREAS, the City Council of the City of Santa Monica has called a Special
Municipal Election in the City of Santa Monica to be held on November 2, 2021, for the
purpose of electing an officer of the City of Santa Monica; and
WHEREAS, it is desirable that the Special Municipal Election be consolidated with
the State, Local Municipal Election to be held on the same date; that within the City of
Santa Monica, the precincts, polling places and election officers of the two elections be
the same; that the Registrar of Voters of the County of Los Angeles canvass the returns
of the Special Municipal Election; and that the State, Local Municipal Election and
Special Municipal Election be held in all respects as if there were only one election; and

WHEREAS, in the course of conduct of the Special Municipal Election and in
relation thereto, it will be necessary to mail sample ballots and polling place information
to the registered voters of the City of Santa Monica; and
WHEREAS, it will facilitate the mailing of sample ballots if the Registrar of Voters
of the County of Los Angeles makes available to the City of Santa Monica the computer
record of the names and addresses of all eligible registered voters so that labels may be
printed for attaching to self-mailer sample ballot pamphlets; and
WHEREAS, the City of Santa Monica desires the Registrar of Voters to furnish
such other election assistance as may be authorized by state law; and
WHEREAS, all necessary expense in performing these services shall be paid by
the City of Santa Monica.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE, DECLARE AND ORDER AS FOLLOWS:
SECTION 1. Pursuant to the requirements of Elections Code Section 10403, the
Board of Supervisors of the County of Los Angeles is hereby requested to consent and
agree to the consolidation of a Special Municipal Election with the State, Local
Municipal election on Tuesday, November 2, 2021, for the purpose of electing an officer
of the City of Santa Monica. The consolidated election will be held and conducted in the
manner prescribed in Elections Code Section 10418. The office to be voted upon at the
Special Municipal Election is a Member of the City Council (though this is subject to

change depending on the outcome of the California Supreme Court’s review of the
Court of Appeal’s ruling in Pico Neighborhood Association, et al. v. City of Santa
Monica, Los Angeles Superior Court Case No. BC616804, Court of Appeal Case No.
B295935, Supreme Court Case No. S263972); The names of candidates appearing on
the ballot shall be filed with the Registrar of Voters of the County of Los Angeles no later
than 81 days prior to the Special Municipal Election.
SECTION 2. The Registrar of Voters is authorized to canvass the returns of the
Special Municipal Election which it is hereby requested to consolidate with the State,
Local Municipal Election and said election shall be held in all respects as if there were
only one Election, and only one form of ballot shall be used.
SECTION 3. The Board of Supervisors of the County of Los Angeles is hereby
requested to issue instructions to the Registrar of Voters to take any and all steps
necessary for the holding of the consolidated election.
SECTION 4. The City of Santa Monica recognizes that additional costs will be
incurred by the County of Los Angeles by reason of this consolidation and agrees to
reimburse the County of Los Angeles for any such costs.
SECTION 5. Pursuant to Elections Code Section 10002, the City Council requests
the Board of Supervisors of the County of Los Angeles to permit the Registrar of Voters
to provide the following services to the City to the extent determined necessary by the
City Clerk: (1) prepare and furnish to the City of Santa Monica for use in conducting its
Special Municipal Election the computer record of the names and addresses of eligible

registered voters in the City of Santa Monica in order that the City of Santa Monica may
print labels to be attached to self-mailer sample ballot pamphlets; (2) furnish to the City
of Santa Monica printed indices of the voters to be used by the precinct board at the
polling places; (3) make available to the City of Santa Monica additional election
equipment and assistance according to state law; and (4) provide such other services as
may be deemed necessary to reduce the expense and administrative burden of the
election.
SECTION 6. The City of Santa Monica shall reimburse the County of Los Angeles
for services performed when the work is completed and upon presentation to the City of
a properly approved bill.
SECTION 7. The City Clerk is directed to transmit and file a certified copy of this
Resolution with the Board of Supervisors of the County of Los Angeles and with the
Registrar of Voters.
SECTION 8. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.

I support the appointment of Mario Fonda‐Bonardi to the City Council's vacant position and do so based on the reasons I
voted for him in 2020 and the work I've seen him do for the City as a Planning Commissioner, a member of SMa.r.t. and
a resident of our city. He has the planning knowledge we need at this moment as well as a strong sustainability focus
that we need in the long run. He will be thoughtful and considered in the selection of the many new city management
positions we must hire and has a breadth of knowledge as a long‐term and active resident of Santa Monica. We should
not wait for an election or spend the half‐a‐million dollars to hold it during these difficult times. While the argument has
been made that we should hold an election, I believe that we need a full council to help guide us during the next 15
months and the position will be up for election in 2022.. The "interim" city council member would be no different than
our interim "city management" positions in place. This person will help guide the city to the next election and provide
the stability and focus we need. Mario fills this description to the letter. I fully support his appointment and appreciate
your strong consideration of it.

We support the appointment of Mario Fonda-Bonardi to the City Council's vacant position and do so based on the reasons

We believe Mario to be a moderate and that, analogizing to the U.S. Supreme Court, he would be a "swing" vote in that
he approaches issues on their merits and will vote as he best sees fit and not along so-called "party lines".

I am writing to urge support of candidate Mario Fonda‐Bonardi, someone who I believe will fairly serve the residents of
Santa Monica. At a time when politics feel divisive, there is need for a measured and temperate candidate to fill the seat
left vacant by Councilmember Kevin McKeown.
Mario Fonda‐Bonardi is a long‐time Santa Monica residents who has served this city in many different capacities for
years, including but not limited to serving on the Planning Commission, writing for S.M.art, serving on the Santa Monica

Dear City Council Members:
I am writing to you today to express my support of the appointment of Mario Fonda-Bonardi to fill the vacant City
Council seat. I’ve known Mario for many years, and I believe he has the background needed to tackle today’s
myriad challenges to our City. He has proven knowledge of our city’s ins and outs, as he has demonstrated
citywide knowledge on city commissions and task forces, as well as involvement in a range of citywide issues and
concerns.
As an architect, his business knowledge is as keen as his design knowledge, demonstrated in his work with the
Santa Monica Conservancy. This brings a unique perspective to tackle homelessness, housing affordability and
ever-present development and traffic challenges that are far more in tune with residents than most candidates.
As a long-time Ocean Park resident and a strong neighborhood advocate, Mario will bring a much-needed direct
perspective on Ocean Park, as well as his demonstrated representation of all of our city’s neighborhood interests
to share common goals and move the city forward.

Among the many fine candidates nominated to assume the Council position left vacant by
Councilmember McKweown’s recent resignation, one nominee stands head and shoulders above the
rest: Mario Fonder-Bernardi. We urge you to appoint Mario to the vacant position.
Mario is by far the most experienced and qualified to serve on the City Council. For over 40 years,
Mario has been on the front lines helping improve our community for ALL of its residents. His
extensive experience as an architect and city planner, as well as his many years serving on the
Planning Commission and with the Santa Monica Conservancy, have given Mario a nuanced and
measured perspective on the many challenges facing our city. Moreover, Mario is a judicious and
compassionate leader who really represents the residents of Santa Monica (of all backgrounds and

It is clear that Mario Fonda‐Bonardi is the logical choice to be appointed to fill the vacant council seat. A long time
resident and community activist as an AYSO coach, Architect and Planner, co‐founder of SMa.r.t (Santa Monica

preservationist and environmentalist, he has given a lifetime of civic participation contributing to the betterment of

I am writing to provide comment on Item 2.A.
I implore you to not try to sift through 35 different candidates and appoint someone into the councilmember vacancy
left by former CM McKeown. I find it impossible to believe that City Council or City Staff has had the time to make a
thorough review and vetting of 35 different applicants. Much less has the average Santa Monican had the time to review
each candidate to be able to provide Public Comment on 35 different people.
Appointing someone to a democratically voted upon seat with such a large pool of applicants will only show the citizens
of Santa Monica one thing:
The privilege of who you know on the City Council outweighs the will of the People.
As a staunch believer in democracy, I believe it is the right of the People to decide who represents them. And that is why
I voice my support in referring the selection of our next City Councilmember to the People in the November
general election.

This is to request that Mayor Himmelrich refrain from nominating or voting for SMRR-endorsed Council
applicant Caroline Torosis due to the appearance of a conflict of interest caused by the fact that Mayor
Himmelrich’s husband, Michael Soloff, is a co-chair of SMRR.
A conflict of interest is a situation in which a person such as a public official has a private or personal interest
sufficient to appear to influence the objective exercise of his or her official duties. Often, this is a financial
interest, but it could also be another sort of interest, for example to provide a special advantage to a family
member. An apparent conflict of interest is one in which a reasonable person would think that the public
official’s judgement is likely to be compromised.
When it comes to conflicts of interest, appearance is as important as reality because it diminishes the public’s
trust in government.
I have previously brought up publicly the issue of Mayor Himmelrich’s apparent conflict of interest relative to
her husband Michael Soloff who serves as Chair of the Santa Monica Housing Commission. At that time,
Mayor Himmelrich promptly recused herself from voting on a commission-related issue.
It is my hope that Mayor Himmelrich will also act properly tonight and recuse herself from participating in any
nomination or vote on the candidacy of Caroline Torosis for the Council seat.
Santa Monica is a small town that for decades now has been plagued by incestuous relationships among the
ruling oligarchy. The two most politically prominent organizations, SMRR and Santa Monica Forward, had been
controlling who ends up on the City Council, either through influence or financial support.
However, in an unprecedented turn of events, during the most recent election in November 2020 the residents
fired three of the Council incumbents. To replace them, regular Santa Monicans were elected in hopes of
saving the city from its progressing deterioration mostly caused by the influence of special interest groups.
The 2020 election proved two things: that the residents were fed up with the special interest groups that had a
firm grip on the City’s politics, and that the residents were able to elect three people who did not have the vast
financial backing of the Urban Growth Machine organization Santa Monica Forward.
I command Mayor Himmelrich on her conviction that Council members are not sorority members and should
not be appointing each other to the Council. A special election is in order. To those frowning at the cost I say
there is no price tag on democracy.
Below is a list of the organizations and individuals who endorsed Caroline Torosis in November 2020. I call on
all the Councilmembers to analyze it from the point of view of a real or apparent conflict of interest, such as
interest peddling, and to act accordingly tonight.
