Award Bids #SP2393 & #SP2583 to Cinbad Industry, Inc. for construction services for the Tongva Park Pedestrian Improvements and Palisades Park Petanque Courts Repurposing Projects for the Community Services Department; 2. Authorize the City Manager to negotiate and execute a contract with Cinbad Industry, Inc. in an amount not to exceed $325,000 (including a 10% contingency); 3. Authorize the Director of Public Works to issue any necessary change orders to complete additional work within contract authority; and 4. Authorize budget changes as outlined in the Financial Impacts & Budget Actions section of this report. Summary The Tongva Park Pedestrian Improvements and Palisades Park Petanque Courts Repurposing Projects would install an ADA-compliant pedestrian path connecting Tongva Park and Chez Jay and convert approximately 5,200 SF of underutilized and often misused recreational space in Palisades Park to a drought-tolerant garden. The projects are located within a quarter mile of each other and require similar construction services. To maximize efficiencies, staff recommends awarding one contract to Cinbad Industry, Inc. for both projects in an amount not to exceed $325,000 (including a 10% contingency). Discussion These projects would provide capital improvements to Tongva Park and Palisades Park. Project construction requires specialized equipment, contractor licensing, technical 3.B Packet Pg. 24 2 of 7 expertise, and human capital that cannot be provided by in-house staff; therefore, general contracting services would be utilized. Tongva Park Pedestrian Improvements Project Tongva Park is a 6.2-acre park located to the east of Ocean Avenue and west of City Hall, between the I-10 freeway and Olympic Drive. The park features native and locally appropriate plants and is divided into four main sections: Observation Hill, Discovery Hill, Garden Hill, and Gathering Hill. Discovery Hill, found in the southeast quadrant of Tongva Park, currently features a children’s play area, shaded picnic area, children’s splash pad, and an unpaved pedestrian connection between the picnic area and Chez Jay’s rear patio located at 1657 Ocean Avenue. On February 25, 2020, Council authorized a first modification to Chez Jay’s Lease Agreement #7640 (RAS) to provide exclusive concession services for Tongva Park. In support of the City’s executed concessionaire agreement allowing Chez Jay to serve park patrons, the Tongva Park Pedestrian Improvements Project would install wayfinding signage and an ADA- compliant, paved, six-foot wide pedestrian path connecting Discovery Hill’s picnic area and Chez Jay’s rear patio (see Figure 1: Tongva Park – Project Location and Attachment A: Tongva Park – Existing Conditions). In March 2020, the City issued a Letter of Intent with SWA Group Los Angeles to provide landscape design services for the Tongva Park Pedestrian Improvements Project in an amount not to exceed $16,800. The design work is complete. 3.B Packet Pg. 25 3 of 7 Figure 1: Tongva Park – Project Location Palisades Park Petanque Courts Repurposing Project Palisades Park is a 26.4-acre park which runs parallel to Ocean Avenue and extends northwest from Colorado Boulevard to Adelaide Drive. The linear park occupies a narrow strip of land which sits atop coastal sandstone bluffs. The southern end of the park is heavily used by pedestrians, highly visible, and often photographed. This section of the park, near the junction of Ocean Avenue and Colorado Avenue, is directly adjacent to the main point of access between the iconic Santa Monica Pier and Tongva Park to the south, Downtown Santa Monica to the north, and the Colorado Esplanade and Expo light rail terminus station to the east. Also located at the southern end of the park are multiple destinations and amenities, including the Camera Obscura Art Lab at 1450 Ocean Avenue and Visitor Center at 1400 Ocean Avenue. In 2016, given the high volume of pedestrians and associated ongoing maintenance challenges, an approximately 6,600 S.F. area of lawn at the southernmost end of the park was converted from turf to a drought-tolerant garden as part of the Palisades Park Landscape Project (SP2404). Considering the underutilization of the existing petanque courts, the Palisades Park Petanque Courts Repurposing Project would convert 3.B Packet Pg. 26 4 of 7 approximately 5,200 S.F. of underutilized and often misused recreational space to a drought-tolerant garden with pedestrian pathways resembling the landscaping installed in 2016 at the southern end of the park (see Figure 2: Palisades Park – Project Location and Attachment B: Palisades Park – Existing Conditions). On January 15, 2020, the City issued an informal Request for Proposals (RFP) to obtain landscape design services for the Palisades Park Petanque Courts Repurposing Project. The RFP was posted on the City’s online bidding site and two proposals were received and evaluated based on the criteria outlined in the RFP, which included experience/technical competence, ability to meet work plan/timeline, cost of services/cost control, value added/breadth of service, and references. On February 19, 2020, the Evaluation Team comprised of staff from the Community Services and Public Works departments recommended SWA Group as the best qualified firm. In May 2020, the City executed a professional services agreement with SWA Group Los Angeles to provide landscape design services for the Palisades Park Petanque Courts Repurposing Project in an amount not to exceed $34,980. Legacy Construction, Inc.’s bid did not meet the basic requirements of the RFB, was considered nonresponsive, and rejected without evaluation. An evaluation panel composed of Architecture Services staff evaluated the remaining two bids and recommend Cinbad Industry, Inc. as the best and lowest bidder.
