O2087 f:\atty\mu ni\laws\mjm\sen iorcommu nity2d. wpd City Council Meeting 7-8-03 Santa Monica, California ORDINANCE NUMBER 2087 (CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CHANGING THE NAME OF THE COMMISSION ON OLDER AMERICANS TO THE COMMISSION FOR THE SENIOR COMMUNITY THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS SECTION 1. Chapter2.48 of the Santa Monica Municipal Code is hereby amended to read as follows: Chapter 2.48 COMMISSION FOR THE SENIOR COMMUNITY Section 2.48.010 Commission for the Senior Community. Pursuant to the provisions of Section 1000 of the Santa Monica Municipal Charter, the City Council does hereby create a Commission forthe Senior Community. The membership of said Commission shall be appointed by the City Council and shall consist of nine members to be electors of the City. None of the voting members shall hold any paid office or employment in City Government. At least five of the Commissioners shall be over sixty 1 years of age. All non-voting seats in effect at the time of passage of this Section shall terminate as of June 30, 1989, and the City Council shall not fill any vacancies of Commission non-voting seats if any such seat is vacated prior to June 30, 1989. Section 2.48.020 Powers and duties of said Commission. The Commission forthe Senior Community shall have the power and be required to perform the following: (1) Act in an advisory capacity to the City Council in all matters pertaining to older Americans and their needs; (2) Be empowered to assemble information on problems and their solutions for older Americans through all available means including the holding of public hearings; (3) Be empowered on its own initiative to make recommendations to the City Council on matters within its purview; (4) Act to facilitate coordination between existing and proposed programs for the elderly. Section 2.48.030 Commissioner{s) Emeritus. The City Council may appoint up to three Commissioners Emeritus who may serve simultaneously on the Commission forthe Senior Community ("Commission"). The appointments shall be based upon the 2 recommendations of the Commission. To be eligible for appointment, a person must have served two full terms as a Commissioner on the Commission and must be a resident within the City. Each Commissioner Emeritus shall be a nonvoting member of the Commission, may represent the Commission at community and other functions as directed by the Commission, may serve on Commission committees and shall abide by the bylaws of the Commission. The term for a Commissioner Emeritus shall be two years, and each Commissioner Emeritus may serve a maximum of two consecutive terms. A Commissioner Emeritus shall not be eligible to serve simultaneously as a voting member on another City Commission. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. 3 SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption.
