AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ADDING SECTION 6126 TO CHAPTER
1 OF ARTICLE VI OF THE SANTA MONICA MUNICIPAL
CODE TO CREATE A LICENSE REVIEW BOARD
THE CITY COUNCIL OF THE CITY OF SANTA MONICA HEREBY OR-
DAINS AS FOLLOWS:
SECTION 1. Sect~on 6126 is hereby added to Chapter 1
of Article VI of the Santa Hon1ca Munic1pal Code to read as follows:
Sect10n 6126. LICENSE REVIEW BOARD. A License
Review Board is hereby created to funct~on in accordance with
the procedures set forth herein.
A. Duties of the L1cense Review Board. The Llcense
Rev~ew Board is hereby created to review license and permit
determinat20ns in the followlng cases:
1. When a requested llcense ~s not lssued by
the City Clerk or any other officer or employee of the CltYi
2. When a permit is revoked by the Ch~ef of
Police 1n accordance w1th Sect10n 6123;
3. ~Vhen a llcense or permit has been revoked
in accordance w~th Section 6125;
4. When a llcense has been suspended or revoked
by the City Manager ~n accordance with Section 6117;
5. When a person or entity 1S aggrleved by
notlce or action taken under Chapter 2A ~n accordance with
Sect10n 6261; and
6. ~{hen a license is refused or renewal is
refused 1n accordance wlth Sect10n 6204W8;
7. When a person or entity 15 aggrieved by
any such other permit and bus~ness license dete~lnations uS

B. Members of the Llcense Revlew Board.
1. The License Review Board shall be composed
of the Chief of Pollce, the C~ty Clerk, the Director of
Adm~nistratlve Servlces, the Director of Publlc Works and
the City Manager, or their l~ec~ate asslstant.
2. In the event anyone or more of the above
has passed upon and denied or is or has been admlnlsterlng
any part of the matter sent to the Llcense Review Board,
the City Clerk shall request the Clty Manager to substitute
for such member any other department head or h~s representatlve.
C. Standards. The License ReV1ew Board may refuse
to approve the issuance of a permlt or business license
whenever in 1ts reasonable Judgment such issuance will be
materlally detrimental to the public health, morals, safety
or general welfare, or would vlolate any law of the state
of Callfornla or ord1nance of the C1ty of Santa Monica.
D. Rules. The License Review Board shall be governed
by those rules adopted by the City Counc~l for the conduct
of public hear1ngs 1nsofar as those rules are, 1n the
determlnation of the Board, appl1cable to the proceed1ngs
before it.
E. Hearlng. Any person denied a license or whose
permlt or license has been revoked by the Clty Clerk, the
Chief of Pol~ce or other City offlcer or employee shall be
entitled to a hearlng thereon before the License ReVlew Board
upon filing a wrltten request therefor w1th the Clty Clerk
not later than the fifth (5th) day fallowing malling of a
not1ce of said den1al or revocat1on by the officer or employee
of the City taking such action. The L~cense Review Board
shall hold a hearlng not later than ten (10) days followlng

Review Board.
SECTION 2. Any prov~sion of the Santa Monica Munic~pal
Code, or append~ces thereto ~nconsistent herewith, to the extent
of such inconsistencies and no further, are hereby repealed.
SECTION 3. If any section, subsect~on, sentence, clause
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of competent ]uris-
d~ction, such decision shall not affect the valid~ty of the remain-
ing portions of the ordinance. The City Counc~l hereby declares
that it would have passed this ordinance and each section, sub-
section, sentence, clause or phrase thereof, irrespect~ve of the
fact that anyone or more sect~ons, subsections, sentences, clauses
or phrases be declared ~nval~d or unconstitutional.
SECTION 4. The Mayor shall s~gn and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the offic~al newspaper
within fifteen days after its adoption. This ord~nance shall
become effective after thirty days from ~ts adoption.
