ORDINANCE NO. 968 (CCS)
(CITY COUNCI L SERIES)
AN ORDINANCE OF THE CITY COUNCI L OF THE CITY
OF SANTA MONICA AMENDING SECTION 6124 AND
SECTION 6125 OF CHAPTER 1, ARTICLE VI OF THE
SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA HEREBY OR-
DAINS AS FOLWWS:
SECTION 1. section 6124 of Chapter 1 of Article VI of
the Santa Monica Municipal Code is hereby amended to read as
follows:
Section 6124. Right of Appeal. Any person
aggrieved by the action of the Chief of Police or the
City Manager 1n suspending or revoking any such permit
or license may appeal to the License Review Board in
accordance with the procedure set forth in Section
6126.
SECTION 2. Section 6125 of Chapter 1 of Article VI of
the Santa Monica Municipal Code 1S hereby amended to read as
follows:
Section 6125. Void License or Permit. The
City shall not be bound by the mistake of any off1cer or
employee of said City in issuing a license or perm1t
contrary to the terms of this Code, or of the terms
of any zoning or other ordinances of the C1ty.
Upon a written statement of the City Manager,
Zoning Administrator or Chief of Police filed with the
License Review Board to the effect that any license or
permit has been 1ssued on contravention of this Code,

or any ordinance of the City, the Board shall fix a
date for determin1ng said facts, and shall cause
notice of the time and place of said hearing to
be served on the person to which such license or
permit has been issued or anyone of such persons
1n the event such license or permit has been issued
to more than one person or on the manager or agent
of any such person.
If, upon such hearing, the License Review
Board finds that such license or perm~t was issued
in contravention of this Code, or any ordinance of
the City, it shall order sa1d license or permit
revoked and shall tender to the person who obtained
said license or permit, the fee for the unexpired
portion of said license, Any person who obtained a
license or permit to engage in any pusiness, OCCU-
pat1on, or prOfession after such revocation, is
guilty of a violation of this Code, and shall be
subject to the penalties provided herein for the
violation of the terms of this Code.
SECTION 3. Any provision of the Saata Mon1ca Munic1pal
Code, or appendices thereto inconsistent herewith, to the extent
of such inconsistencies and no further, are hereby repealed.
SECTION 4. If any section, subsection, senten~e, clause
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of competent jur-
isdiction, such decision shall not affect the validity of the
remaining portions of the ordinance. The City Council hereby
declares that it would have passed this ordinance and each

section, subsection, sentence, clause or phrase thereof, irres-
pective of the fact that anyone or more sections, subsections,
sentences, clauses or phrases be declared invalid or unconsti-
tutional.
SECTION 5. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the off1cial news-
paper within fifteen days after its adoption. This ordinance
shall become effective after tbirty days from 1tS adopt~on.
