AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SECTION 6120 OF CHAPTER 1
ARTICLE VI OF THE SANTA MONICA MUNICIPAL CODE
IN COI~OmlITY WITH THE PROVISIONS FOR THE
"FLIPPER" HACHINE ORDINANCE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA HEREBY
ORDAINS AS FOLLOWS:
SECTION I. Section 6120 of Chapter I of Article VI
of the Santa ~lonica Municipal Code is hereby amended to read as
follows:
Section 6120. Permlts requlred.
Any person requlred to obtain a license to engage in any
bUSlness, call1ng or pursuit mentioned in Sections 6204A,
6204C, 62Q4D, 6204E, 6204F, 6204H, 6204J, 6204K, 6204M,
6204N, 6204P, 6204Q, 6204R, 6204T, 6204U, 6204N, 6207,
620B, G20BA, 6210, 621B, 6220, 622l, 6222, 6224, 6231,
6233, 6233A, 62338, 6233C, 6233D, 6239, 6240(6), 6240(B),
6240(20), 6240(23), 6241, 6244, of thlS Code shall first
obtain a permlt to conduct such business from the Chief
of Police. In order to obtaln such a permit, a wrltten
application shall be flIed with said Chief of Pollce,
WhlCh appllcation shall contaln a statement of intention as
to the location and extent of the premises to be occupled,
and in additlon such application for a permit to engage ln
any of the businesses requlring a permit shall contain the
name of any person flnancially interested in the bUSlness
in any manner. The Chlef of Pollce, within a reasonable
tlme after submission of such appllcatlon, shall ascertain
that the proposed locatlon is withln the legal limlts for

for such purpose, and that the purposes for wh~ch the
premises are to be used will not be in conflict with any
laws of the State of Californ~a, ord~nances of the City
or of th~s Code. When satisfied that there ~s no apparent
danger to public health and safety of the people of the
City, that the applicant, ~ts offlcers or agents, lf any,
are morally responsible and have a good reputation, that
the conduct~ng of such business in such location will be
in conformance wlth all laws and ord~nances, the Ch~ef of
Pol~ce shall lssue a permit to said applicant. Such
permit then shall be submitted by the applicant with the
amount of the llcense fee required hereunder to the City
Clerk, who then shall lssue the license provided for in
this Code.
Permlts issued hereunder shall be effectlve for the
same perlod as the llcense issued pursuant to such permit.
Upon the explration of the permit, an applicatlon for
renewal thereof shall be filed in a l~ke manner as an
application for an orlginal permit, and such renewal permlt
shall be granted only when the requirements for the issuance
of an original permit are met. Permits issued hereunder
shall not be assignable.
SECTION 2. Any provis~on of the Santa Monica Munlcipal
Code, or appendlces thereto inconsistent herewith, to the extent
of such ~nconsistencies and no further, are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be lnvalid
or unconstitutional by a dec~sion of any court of competent juris-
diction, such decis~on shall not affect the validity of the
remaining portions of the ord~nance. The City Councll hereby

declares that it would have passed this ord~nance and each sect1on,
subsection, sentence, clause or phrase thereof, irrespect~ve of
the fact that anyone or more sect~ons, subsect~on~, sentences,
clauses or phrases be declared inval~d or unconstitut~onal.
SECTION 4. Any person v~olat~ng any of the provis~ons
of this ordinance shall be gu~lty of a m1sdemeanor and, upon
conv~ct~on thereof, shall be subJect to a f1ne not exceed1ng
Five Hundred ($500) Dollars or six (6) months in the county jail
of Los Angeles County, or by both such f~ne and impr1sonment
in the d1scretion of the court.
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this ord~nance. The City Clerk shall
cause the same to be published once ~n the official newspaper
with~n f~fteen days after 1ts adopt1on. This ordinance shall
become effect1ve after thirty days from its adoption.
