'1.: - . ; , .- RG/~: 'e .~ r 2nd Rev. 8/5/74 ~ ORDINANCE NO. 971 (CCS) (CITY COUNCIL SERIES) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ENACTING SECTION 3607A OF THE SANTA MONICA MUNICIPAL C0DE PERTAINING TO TRES- PASSING IN THE AREA OF A PIER AND DECLARING THE PRESENCE OF AN EMERGENCY. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 3607A is hereby added to the Santa Monica Municipal Code to read as follows: Sec tion 3607A Trespassing (Posted Pier Areas). No person shall trespass in, upon, on, under or across any pier or portion of a pier located in the City of Santa Monica, provided that such pier shall have been posted at each of the corners of the pier and at intervals of no less than one hundred (100) feet with clearly legible signs with letters at least two (2) inches in height bearing the words "POSTED PIER-NO TRESPASS", and such other words as may be desired indicating that trespassers are subject to prosecution under this section. These provisions shall have no application to a trespass committed by any peace officer or other authorized em- ployee, agent, or independent contractor of the City of Santa Monica when in the performance of lawful duty or other legitimate business. SECTION 2. Any provision of the Santa Monica Municipal Code, or appendices thereto inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the pro- vision of this ordinance. SECTION 3. If any section, subsection, sentence, -1- ... .. -t. ; _RG/p;, e 8/5/74 2nd Rev. . .- clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or un- constitutiona 1. SECTION 4. This Council finds and determines that a potential danger exists as a result of an abandoned pier in the City of Santa Monica and that the pier endangers the public health and safety of the citizens of the City of Santa Monica. SECTION 5. This ordinance is declared to be an emergency measure adopted pursuant to the provisions of Section 615 of the Santa Monica Municipal Charter and is necessary for preserving the public peace, health, or safety, and the urgency for its adoption is set forth in the findings above. SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (15) days after its adoption. This ordinance shall become effective upon its adoption.
