ORDINANCE NO. 974 (CCS)
(CITY COUNCIL SERIES)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SECTION 6261 OF CHAPTER 2A
OF ARTICLE VI OF THE SANTA MONICA MUNICIPAL CODE
IN CONFORMITY WITH THE PROVISIONS FOR THE LICENSE
REVIEW BOARD
THE CITY COUNCIL OF THE CITY OF SANTA MONICA HEREBY
ORDAINS AS FOLLOWS:
SECTION I. Section 6261 of Chapter 2A of Article VI
of the Santa Monica Municipal Code is hereby amended to read as
follows:
Sect~on 6261.
Appeals. Any person or entity
aggrieved by finding notice or act~on taken under the
prov~sions of this chapter may appeal to the L~cense
Review Board for a hearing upon filing a written request
therefor with the City Clerk not later than the f~fth (5th)
day follow1ng ma1l~ng of a notice of said find~ngs or
action by the officer or employee of the City taking
such action. In all such cases, the provis1ons of Sect~on
6126 shall apply I w1th the exception that the burden of
proof shall be upon the applicant to show that there
was no substant~al ev~dence to support the find1ngs or
action taken by the Department of Pub11c Works.
SECTION 2. Any provislon of the Santa Monlca Municlpal
Code, or appendices thereto incons1stent herewith, to the extent
of such inconsistencies and no further, are hereby repealed.
SECTION 3. If any sect~on, subsection, sentence, clause
or phrase of th1S ord1nance 1S for any reason held to be invalid or
unconstitutlonal by a decis10n of any court of competent JUrlS-
diction, such deC1Slon shall not affect the va11dity of the

remaining port1ons of the ordinance. The C1ty Council hereby
declares that 1t would have passed th1S ordinance and each sect1on,
subsection, sentence, clause or phrase thereof, irrespective of
the fact that anyone or more sections, subsections, sentences,
clauses or phrases be declared 1nva11d or unconst1tutional.
SECTION 4. The Mayor shall s1gn and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the offic1al news-
paper within fifteen days after its adoption. This ord1nance
shall be come effective after th1rty days from its adoption.
