RLeIs:mrns 9.19.74 e ORDINANCE NO. 97~, (ecs) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTIONS 4115, 4116, 4122 AND 4123 OF THE SANTA MONICA MUNICIPAL CODE AND ADDING SECTION 4ll6A TO THE SANTA MONICA MUNICIPAL CODE PERTAINING TO THE CAREt CONTROL AND LICENSING OF DOGS AND THE BOARDING OF CATS THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 4115 of the Santa Monica Municipal Code is amended to read as follows: Section 4115. Dogs. Restricted Areas. No person having control, charge or custody of any dog shall permit the same to go upon any school ground, recreation or playground, or public park, or upon those lands in the City lying westerly of that certain thoroughfare, commonly known as The Promenade or upon the beach sands lying northerly of the westerly prolonga- tion of the center line of California Avenue. Notwithstanding any other provision of this Code, any person violating this Section or Section 4114 herein shall be guilty of an infraction. Any person convicted of an infraction under the provisions of this section or under the provisions of Section 4114 of this Code shall be punishable by a fine of not more than Fifty ($50.00) Dollars. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of this Section or of Section 4114 of this Code is committed, continued, or permitted by such person and shall be punishable accordingly. In addition, any such dog found in any such prohibited place may be impounded as herein provided. -1- RL~Is:mms 9.l9.74 -;:::/ . '-' In addit~on to the penalties hereinabove provided, any condition caused or permitted to exist in violation of the provisions of this Section or in violation of the provisions of Section 4114 of this Code shall be deemed a public nuisance and may be, by this City, summarily abated as such, and each day such condition continues shall be regarded as a new and separate offense. The provisions of this Section shall not apply to dogs which have been especially trained and used for blind persons to aid and guide them in their movements while such dogs are being used for such purposes. SECTION 2. Section 4116 of the Santa Monica Municipal Code is amended to read as follows: Section 4116. Dogs. Licensing. Every person who harbors a neutered male dog or a spayed female dog within the City shall pay to the City Clerk, License Division, an annual license tax of Five ($5.00) Dollars, and every person who harbors an un neutered male dog or anmspayed female dog within the City shall pay an annual license tax of Ten ($10.00) Dollars in the same manner. The Clerk shall deliver to the person making such payment a license which shall describe the dog, together with a seal or metallic plate having thereon the number of such license, and figures indicating the year for which the license has been paid, provided the person making the payment has filed with the Clerk a certificate indicating the dog has been vaccinated in accordance with this Chapter and state law, otherwise a receipt for payment shall be issued. Duplicates shall be issued for lost tags for One Dollar and Fifty ($1.50) Cents upon the filing of proof of such loss. Such metallic tags shall be attached to a collar or harness and -2- RL~Is:mrns 9.19.74 \::::J ~ such collar or harness with the attached tag shall be kept on such dog at all times, excepting as in the Code otherwise provided. The license fee herein mentioned shall be due and payable on the second day of January each year and shall expire on the thirty first day of December next ensu~ng. Where a dog is acquired after the second day of January, the license fee thereon shall be due on the date of acquisition of such dog for such calendar year and thereafter on the second day of January of each succeeding year~ In the event that any person shall fail, neglect, or refuse to pay the requ~red license tax before the first day of April of each year, a penalty will be assessed through the increase of the license tax as follows: for every neutered male or spayed female dog, Six Dollars and Twenty Five ($6.25) Cents; and for every unneutered male or un spayed female dog, Thirteen ($l3.00) Dollars. The provisions of this Section shall not apply to any dog not more than Four (4) Months of age. SECTION 3. Section 4116A is added to the Santa Monica Municipal Code to read as follows: Section 4116A. Refund of License Fee. Any person who harbors a dog within the City which he has acquired from the City Pound after the expiration of the period of redemption provided for in Section 4124 of this Code, and who subsequently causes said dog to be spayed or neutered shall be entitled to a refund of the license fee paid hereunder for the year in which such dog is acquired upon presentation of proof to the City Clerk that such dog was obtained from the City Pound and that such dog was subsequently spayed or neutered. -3- RL~IS;mmS 9.19.74 ..: ,-.. - SECTION 4. Section 4122 of the Santa Monica Municipal Code is amended to read as follows: Section 4122. Fees for Impounding and Disposal. Any provision of the Santa Monica Municipal Code, or appendices thereto inconsistent herewith to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this ordinance. SECTION 7. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall effect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 8. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The Ci~Clerk shall cause the same to be published once in the official newspaper within fifteen days after its adoption. This ordinance shall become effective after thirty days from its adoption.
