O978 SIS4lrS 12.2.74 CA - 1 ORDINANCE NO. 978 eCCS) (C~ty Council Ser~es) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTIONS 4116 AND 4l16A OF THE SANTA MONICA MUNICIPAL CODE PERTAINING TO THE CONTROL AND LICENSING OF DOGS. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. ~4l16 of the Santa Monlca Municipal Code 1S amended to read as follows: Sect~on 4116. DogS. Licens~ng. Every person who harbors a neutered male dog or a spayed female dog wlthln the C~ty shall pay to the Clty Clerk, L~cense D1vis~on, an annual llcense tax of Five ($5.00) Dollars, and every person who harbors an unneutered male dog or an unspayed female dog wlthln the C1ty shall pay an annual 11cense tax of Ten (SID. 00) Dollars ~n the same manner. The Clerk shall dellver to the person mak1ng such payment a llcense Wh1Ch shall describe the dog, together with a seal or metall1c plate hav1ng thereon the number of such 11cense, and flgures 1ndlcatlng the year for WhlCh the l~cense has been paid, provided the person maklng the payment has filed w1th the Clerk a certif1cate 1nd1catlng the dog has been vacclnated in accordance with this Chapter and state law, otherWlse a recelpt for payment shall be lssued. Dupllcates shall lssued for lost tags for One Dollar and Flfty ($1.50) Cents upon the flllng of proof of such loss. Such metalllc tags shall be attached to a collar or harness and such collar or harness wlth the attached tag shall be kept on such dog at all tlmes, excepting as ln the Code otherWlse provlded. The llcense fee her8lh mentloned shall be due -1- SIS4IrS 12.2.74 CA e and payable on the 2nd day of January each year and shall explre on the 31st day of December next ensulng. Where a dog lS acqulred after the 2nd day of January, the llcense fee thereon shall be due on the date of acquisltlon of such dog for such calendar year and thereafter on the 2nd day of January of each succeedlng year. In the event that any person shall fall, neglect, or refuse to pay the required llcense tax before the 1st day of Aprll of each year, a penalty will be assessed through the lncrease of the license tax as follows: for every neutered male or spayed female dog, $5.00~ and for every unneutered male or un spayed female dog, $10.00. The provislons of this section shall not apply to any dog not more than SlX (6) months of age. SECTION 2. S4116A of the Santa Monlca Munlcipal Code is amended to read as follows: Sectlon 41lfu~. Refund of Llcense Fee. Any person who acqulres and harbors an unneutered male or unspayed female dog wlthln the City, and who subsequently causes said dog to be neutered or spayed shall be entltled to a refund of the llcense fee paid hereunder for the year ln WhlCh such dog is acqulred upon presentation of proof to the Clty Clerk that such dog was neutered or spayed durlng the year following ltS acqulsitlon. The provlslons of this sectlon shall apply only to a llcense fee pa1d durlng the year 1n Wh1Ch such a dog is acqu1redr and any right to refund of said llcense fee shall exp1re at the end of such year of acqU1slt1on. SECTION 3. Any prov1sion of the Santa Monlca ~lunlc1pal Code, or appendlces thereto 1nconslstent herew1th to the extent of such 1nconslstencles and no further, are hereby repealed -2- SIStlfS 12.2.74 CA e or modlfied to that extent necessary to effect the provlsions of this ordinance. SECTION 4. If any section, subsectlon, sentence, clause or phrase of this ordinance is for any reason held to be lnvalld or unconstltutlonal by a decislon of any court of competent Jurlsdlction, such decision shall effect the valldity of the rernalnlng portlons of the ordinance. The Clty Council hereby declares that it would have passed thlS ordinance and each and every sectlon, subsectlon, sentence, clause or phrase not declared lnvalid or unconst~tutlonal without regard to whether any portlon of the ordlnance would be subsequently declared lnvalld or unconstitutlonal. SECTION 5. The Mayor shall slgn and the City Clerk shall attest to the passage of thlS ordlnance. The Clty Clerk shall cause the same to be publlshed once in the offlcial newspaper within fifteen days after its adoption. This ordinance shall become effective after thirty days from lts adoptlon. The City Council finds that mun~cipal elections are mun~cipal affairs and consequently a charter city 1S not preempted by general state law from regulating contr1but1ons and expend1tures and practlces ~n local elect1ons. SECTION 4. Section 11202 is hereby added to the Santa Monica Municipal Code to read as follows: Section 11202r Definitions. A. Candidate. "Candidate" means an individual who is listed on the ballo~ or who has qualifled to have wrlte- in votes on such person~ behalf counted by electlon offLcials for the nomination for election to the Santa Monlca C~ty Council, Santa Monica Unified School District Board of Educat~on, or Santa Monica community College Board of Trustees, or who receives a contribution or makes an expenditure or g~ves consent for any ot:her person to receive a contribution or to make an expenditure wIth a v~ew to bringing about such person's nomination or election to such office, whether or not the specific elective office for which such person will seek nomi- nation or election 1S known at the time the contribution is received or the expend1ture is made, and whether or not such person has announced candidacy or flled a declaratlon of candidacy at such tlme. "Candidate" also includes any office holder who 1S subject of a recall petltion. B. Expenditure. A candldate or proponent or opponent of a measure controls a COmID1ttee if such person or his or her agent or any other committee such person controls has signlficant influence on the actions or deciS10ns of the coromi ttee. E. Independent Comrnlttee.
