R11308City Council Meeting November 24, 2020 Santa Monica, California RESOLUTION NO. 11308 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING THE WASTEWATER CAPITAL FACILITY FEE WHEREAS, the City Council may establish, amend, or revise from time to time by resolution the City's Wastewater Capital Facility Fee to be charged for any net increase in wastewater discharge pursuant to Section 7.04.460 of the Santa Monica Municipal Code; and WHEREAS, the City desires to amend the Wastewater Capital Facility Fees that recover the cost of increased demand on the City’s wastewater system from new development; and WHEREAS, the City is required by the City of Los Angeles to collect and transmit Amalgamated System Sewerage Facilities Charges (LA ASSFC) established by the City of Los Angeles per Contract 7473 (CCS) Section IIC for any net increase in wastewater discharge arising from new development, changes in land use, or increases in discharges from Industrial Dischargers within the City limits. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Wastewater Capital Facility Fee Calculation Factor Capital Facility Fee $4,589.00 Per EDU Notes: 1. EDU = Equivalent Dwelling Unit 2. The wastewater capital facility fee shown here is only for the City of Santa Monica’s wastewater system and does not include LA ASSFC fees. The Wastewater Capital Facility Fee is calculated based on wastewater flow and strength. For any other land use not listed above, the Wastewater Capital Facility Fee shall be calculated based on the rate of $4,589.00 per Equivalent Dwelling Unit (“EDU”) times the LA ASSFC sewage generation factors for the type of land use. The EDUs assigned to a given customer is a measure of expected impact on the wastewater utility relative to the customer’s expected discharge flow and wastewater strength. One EDU is equivalent to one single family dwelling unit as defined by the LA ASSFC. DocuSign Envelope ID: FA1D4721-C40E-4384-BA4E-DC4AD7C4E0CE Whenever a user of the sewer system changes from one land use to another, the Wastewater Capital Facility Fee shall be that of the new land use less that of the old land use. If the new land use has a lower fee than the old land use, no fee shall be imposed, and no refund of any previously paid fee shall be granted. Whenever a user of the sewer system causes a significant increase of either the flow or strength of sewage discharged to the system, even though there may be no change in land use, an additional Wastewater Capital Facility Fee may be imposed. SECTION 2. The amount of the LA ASSFC charged to owners or developers of a property will be based on the City of Angeles' Annual Report of Wastewater Flow and Strength Loadings and the Amalgamated System Sewage Generator Factors. Funds collected from owners and developers will be transmitted to the City of Los Angeles on a bi-monthly basis. SECTION 3. Effective March 1, 2021, Resolution 10306 CCS shall be repealed in its entirety. SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM ______________________________ GEORGE S.
