R11305City Council Meeting: November 24, 2020 Santa Monica, California RESOLUTION NUMBER 11305 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR THE OLYMPIC WELL FIELD RESTORATION AND ARCADIA WATER TREATMENT PLANT EXPANSION PROJECT WHEREAS, a Notice of Intent to Adopt an Initial Study and Mitigated Negative Declaration for the Olympic Well Field Restoration and Arcadia Water Treatment Plant Expansion Project (Project) was published in the Santa Monica Daily Press and City Public Works Website on July 6, 2020, in compliance with the California Environmental Quality Act (CEQA); and WHEREAS, the Initial Study and Mitigated Negative Declaration was made available for public comment for 60-days, beginning on July 6, 2020 and ending on September 4, 2020; and WHEREAS, on November 24, 2020, the City Council, as Lead Agency, reviewed the Initial Study and Mitigated Negative Declaration. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council finds that the Initial Study and Mitigated Negative Declaration identified potentially significant impacts with respect to: Air Quality, Biological Resources, Cultural Resources, Geology and Soil, Hazards and Hazardous Materials, Noise, Transportation, and Mandatory Findings of Significance, and that these impacts would be reduced to less than significant levels with the incorporation of mitigation measures imposed on the project. No impacts would occur or impacts would DocuSign Envelope ID: 01D2DA72-0E39-4438-8BA4-43D5071DCCD5 be less than significant with respect to the following issues: Aesthetics, Agriculture and Forestry Resources, Energy, Greenhouse Gas Emissions, Hydrology and Water Quality, Land Use and Planning, Mineral Resources, Population and Housing, Public Services, Recreation, Tribal Cultural Resources, Utilities and Service Systems, and Wildfire. SECTION 2. To ensure that mitigation measures are properly implemented, a Mitigation Monitoring and Reporting Program was prepared and will be enforced during construction and operation of the Project. SECTION 3. The City Council has reviewed and considered the Initial Study and Mitigated Negative Declaration, and the Mitigation Monitoring and Reporting Program, together with the comments received during the public review process, prior to acting on the project. SECTION 4. The City Council finds, based on the whole record before it, including the Initial Study and Mitigated Negative Declaration and any comments received, that with incorporation of the proposed mitigation measures, there is no substantial evidence that the project will have a significant effect on the environment, and that the Mitigated Negative Declaration reflects the City’s independent judgment and analysis. Therefore, the City Council hereby adopts the Mitigated Negative Declaration. SECTION 5. Consistent with Public Resources Code Section 21081.6 (a) (1), the City Council adopts the Mitigation Monitoring and Reporting Program, which is included in the Final IS/MND (Section 6), to mitigate or avoid significant effects of the project on the environment and ensure compliance during project implementation. SECTION 6. Consistent with Public Resources Code Section 21081.6 (a) (2), the documents which constitute the record of proceedings for approving this project are DocuSign Envelope ID: 01D2DA72-0E39-4438-8BA4-43D5071DCCD5 located in the Public Works Department, 1685 Main Street, Mail Stop 15, Santa Monica, California. The custodian of these documents is Omeed Pour, Civil Engineer. SECTION 7.
