O929 "'" ,.-" \ , ..... 9-4-73 RLK. ~ e ORDINANCE NO. 929 (CITY COUNCIL SERIES) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING CHAPTER 6C TO ARTICLE VI OF THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH A TAX ON THE CONSTRUCTION OF SINGLE FAMILY KESIDENCES AND DECLARTNG THE PRESENCE OF AN EMERGENCY THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY O~AIN AS FOLLOWS: SECTION I. There is herewith added Chapter 6C to Article VI of the Santa Monica Municipal Code which chapter shall read as follows: CHAPTER 6C. Tax on the Creation of Residential Dwellin3s. /)It- Section 6675.] Residential Dwelling Tax. A single family residential business license tax is imposed solely for revenue purposes on the development and construction of all single family residential structures in the sum of $1,000. per planned salable unit. No such tax shall be imposed upon the development or construction of any such single family residential unit for which a completed sale has occurred or for which a condominium license tax has been paid pursuant to Chapter 6B. Each of the provisions of Chapter 6B relating to condominium tax law for tax an condominiums shall be applied equally to single family residences. This tax shall not be applicable to any person constructing no more than one single family residential structure during anyone year period for his own personal residence. SECTION 2. The City Council of the City of Santa Monica hereby declares that the taxes required to be paid by this chapter are assessed pursuant to the taxing power of the City of Santa Monica and are solely for the purpose of producing revenue. SECTION 3. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent herewith, to the extent of such incon- sistencies and no further, are hereby repealed. SECTION 4. If any section, subsection, sentence, clause or phrase of this ordinance is far any reason held to be invalid or uncon- stitutional by a decision of any court of competent jurisdiction, , ~~ f-1 B-30-73 RLKehr - 'f such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional. SECTION 5. The City Council of the City of Santa Monica finds that an emergency exists for the adoption of this ordinance by reason of the fact that increased demand for public service& such as police, fire and sanitation and the like, have created an urgent need for revenue. The construction of new single family residences creates permanent residents of the City who utilize the urgently needed civic services imposing a hardship on the present citizens of Santa Monica. SECTION 6. This ordinance is declared to be an emergency measure adopted pursuant to the provisions of Section 6lS of the Santa Monica Municipal Charter and is necessary for preserving the public peace, health, or safety, and the urgency for its adoption is set forth in the findings above. SECTION 7. The Mayor shall sign and the City Clerk shall attest to the passage and adoption of this ordinance and shall cause the same to be publiShed once in the official newspaper within 15 days after its adoption.
