ORDINANCE NO. 938

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING SECTION 9146A OF CHAPTER 1,
ARTICLE IX OF THE SANTA MONICA MUNICIPAL CODE PER-
TAINING TO USE PERMITS FOR HOSPITALS, SANITARIUMS,
AND REST HOMES
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION I. Section 9146A of Chapter 1, Article IX of the
Santa Monica Municipal Code is hereby amended to read as follows:
SECTION 9l46A. Notwithstanding any provision of
this Chapter, the following uses may be permitted, if a Use
Permit therefor is granted by the Zoning Administrator as here~
inafter provided:
1. Hospitals, Sanitariums, and rest homes, ex-
cept those for the care or treatment of mental patients or
liquor or drug addicts, and except animal hospital; churches
and synagogues; elementary, junior high, and high schools;
libraries; child care centers; office and meeting rooms for
charitable, youth, and welfare organizations, and such uses
as are incidental thereto, may be permitted in the R2, R2A,
R3, R3A, R4, and R4A Districts, and except that alcoholic
care or treatment may be permitted in a CP District subject
to the issuance of a Conditional Use Permit in accordance with
the provisions of Section 9148, et seq., of this Code.
SECTION 2. The City Council finds and determines that the
public necessity, convenience, general welfare, and good zoning prac-
tice require that the amendment in Section I, above, be made.
SECTION 3. Any provision of the Santa Monica Municipal Code,

or appendices thereto inconsistent herewith, to the extent of such
inconsistencies and no further are hereby repealed.
SECTION 4. If any section, subsection, sentence, clause, or
phrase of this ordinance is for any reason held to be invalid or un-
constitutional by a decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions
of this ordinance. The City Council hereby declares that it would
have passed this ordinance and each section, subsection, sentence,
clause, or phrase hereof, irrespective of the fact that anyone or
more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall cause
the same to be published once in the official newspaper within fifteen
days after its adoption. This ordinance shall become effective after
thirty days from its adoption.
