O941 l2-1l-73 RLK:mh - e ORDINANCE NO. 941 (CITY COUNCIL SERIES) CONTRACT NO. 839-J (CCS) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING AN AHENDMENT TO THE CON- TRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND DECLARING THE PRESENCE OF AN EMERGENCY THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION I. That an amendment to Contract No. 839 (Commissloners' Serles) between the Clty Council of the City of Santa Monica and the Board of Admin1stratlon, Callfornia PubllC Employees' Retirement System, lS hereby authorlzed, a copy of sald amendment belng attached hereto, marked "Exhibit A," and by such reference made a part hereof as though set out in full herelnafter. Said contract lS amended by thlS ordlnance to include the provisions of thel'2% at age 50" and "~ contlnuance" benefits for pollce personnel. SECTION 2. The City Manager of the City of Santa Monica lS hereby authorized, empowered, and directed to execute sald amendment for and on behalf of sald Agency. SECTION 3. Thls ordlnance lS declared to be an emergency ordlnance pursuant to Section 615 of the Santa Monlca Clty Charter, the i~~edlate passage of Wh1Ch 1S necessary for preserving the public peace, health or safety in that a Memorandum of Understandlng has been entered lnto with the Santa Monlca Police Offlcers' Associatlon contlngent upon the approval and effectlveness of the above referred to retirement plan by the flrst of the year. If th1S ord1nance were not passed as an emergency measure thlS term of the memorandum of understandlng could not be effectlvely complied wlthi the fallure to approve th1S plan and make lt effective as provided ln the Memorandum of Understanding would adversely affect employee (~r ' I' " , L ' i ,! l2-~1-73- RLK:mh - . morale in the Pol~ce Department and would ~nterfere w~th the recru~tment of high caliber pol~ce officers: and the public health, safety, and general welfare are d~rectly 1nfluenced by police morale and the availab~lity of h1gh cal~ber pol~ce officers and any delay 1n complying w1th the memoran- dum of understanding would be detrimental to tre people of Santa Mon~ca. SECTION 4. The Mayor shall s1gn and the City Clerk shall attest to the passage of th~s ordinance. The C~ty Clerk shall cause the same to be publ~shed once 1n the off~cial newspaper w1thin f1fteen days after its adopt1on. This ord1nance shall take effect upon adoption pursuant to Sect10n 615 of the Charter of the City of Santa Monica.
