ORDINANCE NO. 944

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING ARTICLE VIII, CHAPTER I,
SECTION 8100 OF THE SANTA MONICA MUNICIPAL CODE
PERTAINING TO THE 1973 BUILDING CODE AND THE
1973 HOUSING CODE
WHEREAS, the Building and Safety Commission of the City of
Santa Monica has reviewed the proposed 1973 Santa Monica Building Code;
and
WHEREAS, the Building and Safety Commission has conferred
with the Building Official and the Fire Marshal concerning these codes
and the technical modification therein to the 1973 Uniform Building
Code; and
WHEREAS, the technical modifications to the 1973 Uniform
Building Code are due to recent increases in the number and size
of local high-rise buildings which have overtaxed the response capabi1-
ity of the local Fire Service;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA '
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 8100 of the Santa Monica Municipal Code
is hereby amended to read as follows:
SECTION 8100. That certain document entitled "Santa
Monica Building Code 1973, II three copies of t"hich are on file
in the office of the City Clerk for use and examination by the
public, is hereby adopted as the Building Code for the City of
Santa Monica, and shall be referred to, together with amend-
ments thereto, as the "Building Code."
That certain document entitled "Santa Monica Housing
Code 1973," three copies of which are on file in the office of
the City Clerk for use and examination by the public, is hereby

adopted as the Housing Code for the City of Santa Monica,
and shall be referred to, together with amendments thereto,
as the "Housing Code."
Each and all of the regulations, provisions,
penalties, conditions, and terms of said Building Code
and said Housing Code are made a part hereof as though
fully set forth herein.
No person shall erect, construct, enlarge, alter,
repair, move, remove, convert, demolish, occupy, equip,
use or maintain any building or structure or fixture attached
thereto, in violation of the regulations contained in said
codes hereby adopted.
SECTION 2. The City Council finds and determines that the
technical modifications to the 1973 Uniform Building Code proposed for
the 1973 Santa Monica Building Code are due to recent increases in the
number and size of local high-rise buildings which have overtaxed the
response capability of the local Fire Service.
SECTION 3. If any section, subsection, sentence, clause or
phrase of this ordinance is for any reason held to be invalid or un-
constitutional by a decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions
of the ordinance. The City Council hereby declares that it would have
passed this ordinance and each section, subsection, sentence, clause
or phrase hereof, irrespective of the fact that anyone or more sec-
tions, subsections, sentences, clauses or phrases be declared invalid
or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall

attest to the passage of this ordinance. The City Clerk shall cause
the same to be published once in the official newspaper within fifteen
days after its adoption. This ordinance shall become effective after
thirty days from its adoption.
