AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AMENDING CHAPTER 1, ARTICLE III,
OF THE SANTA MONICA MUNICIPAL CODE FOR THE PURPOSE
OF ADOPTING A NEW FIRE CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Chapter I, Article III, of the Santa Monica Munic-
ipal Code is hereby amended to read as follows:
CHAPTER 1. FIRE PROTECTION AND FIRE PREVENTION CODE
SECTION 3100. The document entitled "Uniform Fire
Code, 1973 Edition" by the Western Fire Chiefs Association,
Inc., and the International Conference of Building Officials
copies of which are on file in the office of the City Clerk
for use and examination by the public, is hereby adopted as
the fire code for the City of Santa Monica and shall be re-
ferred to, together with amendments as the Fire Code.
Each and all of the regulations, provisions, pen-
alties, conditions, and terms of said code are made a part
hereof as though fully set forth herein and hereat.
No person shall erect, construct, enlarge, alter,
repair, move, remove, convert, demolish, occupy, equip, use,
or maintain any building structure or land in violation of
the regulations contained in said code hereby adopted.
SECTION 310l. Definitions.
I a) Wherever the word "jurisdiction'! is used in the
Uniform Fire Code, it shall be held to mean the property within
the city limits of the City of Santa Monica.
I'b) Wherever the term "Corporation Counselll is used
in the Uniform Fire Code, it shall be held to mean the City

SECTION 3102. Establishment of Limits of Districts
in Which Storage of Flammable or Combustible Liquids in Out-
side Aboveground Tanks is to be Prohibited.
(a) The limits referred to in Section IS.20l of the
Uniform Fire Code in which storage of flammable or combustible
liquids in outside aboveground tanks is prohibited, are hereby
established as follows: All zoning districts as set forth in
the Santa Monica Municipal Code except M-l and M-2 Industrial
Districts.
(b) The limits referred to in Section 15.601 of the
Uniform Fire Code in which new bulk plants for flammable or
combustible liquids are prohibited, are hereby established as
follows: All zoning districts as set forth in the Santa Monica
Municipal Code except M-l and M-2 Industrial Districts.
SECTION 3103. Establishment of Limits in Which Bulk
Storage of Liquefied Petroleum Gases is to be Restricted. The
limits referred to in Section 20.105(a) of the Uniform Fire Code,
in which bulk storage of liquefied petroleum gas is restricted,
are hereby established as follows: All zoning districts as set
forth in the Santa Monica Municipal Code except M-l and M-2
Industrial Districts.
SECTION 3104. Establishment of Limits of Districts
in Which Storage of Explosives and Blasting Agents is to be Pro-
hibited. The limits referred to in Section 11.106(b) of the Uni-
form Fire Code, in which storage of explosives and blasting
agents is prohibited, are hereby established as follows: All
zoning districts as set forth in the Santa Monica Municipal Code
except M-l and M-2 Industrial Districts.

SECTION 3105. Appeals. Whenever the Chief shall
disapprove an application or refuse to grant a permit applied
for, or w~en it is claimed that the provisions of the Code do
not apply or that the true intent and meaning of the Code have
been misconstrued or wrongly interpreted, the applicant may
appeal from the decision of the Chief to the Building and
Safety Commission within 30 days from the date of the decision
appealed.
SECTION 3106. New Materials, Processes or Occupancies
Which May Require Permits. The City Manager, the Chief and the
Chief of the Bureau of Fire Prevention shall act as a committe
to determine and specify, after giving affected persons an
opportunity to be heard, any new materials, processes or occupan-
cies, which shall require permits, in addition to those now
enumerated in said Code. The Chief of the Bureau of Fire Pre-
vention shall post such list in a conspicuous place in his
office, and distribute copies thereof to interested persons.
SECTION 2. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent herewith, to the extent of such in-
consistencies and no further are hereby repealed.
SECTION 3. If any section, subsection, sentence, clause, or
phrase of this ordinance is for any reason held to be invalid or un-
constitutional by a decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions
of the ordinance. The City Council hereby declares that it would have
passed this ordinance and each section, subsection, sentence, clause,
or phrase hereof, irrespective of the fact that anyone or more sec-
tions, subsections, sentences, clauses, or phrases be declared invalid
or unconstitutional.

SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall cause
the same to be published once in the official newspaper within fifteen
days after its adoption. This ordinance shall become effective after
thirty days from its adoption.
