ORDINANCE NO. 949

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AMENDING ARTICLE VI, CHAPTER 3A, SECTION 6335
OF THE SANTA MONICA MUNICIPAL CODE PERTAINING TO PERMITS
ISSUED WITH RESPECT TO THE SANTA MONICA CULTURAL ARTS
& CRAFTS SHOWS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION I. Art~cle VI, Chapter 3A, Sect~on 6335 of the Santa
Monica Mun~clpal Code 1S hereby amended to read as follows:
SECTION 6335. Perm~ts to be Issued. There shall be
three (3) classes of perm1ts to be 1ssued:
I} Department of Recreat10n & Parks Free
Permits. The Santa Mon~ca Department of Recreat10n
& Parks shall be entitled to a permlt free of charge
to conduct each show and may grant free perm~ts to lts
exh1bltors provided said exhibitors do not sell thelr
exhib~ts. Non-selling exh1bltors shall dlsplay a slgn
below each exh~bit, as follows: "For exh1b1t only.
Not for Sale." Those exh1b1ts not for sale should be
clearly segregated from those which are for sale.
2) Department of Recreatlon & Parks Sales
Permits. Individuals may obta1n perm~ts fro~ the C~ty
Clerk for the sale of exhlbits at shows conducted by the
Department of Recreation & Parks subJect to all requ~re-
ments set forth below for Chamber of Commerce appll-
cants and subject to the payment of a perm~t fee ~n the
amount of $5.00 per exh1bit ("exh~bit" being the work
product of a slngle artist, dlsplayed by such artist)

for sale at said show. A perm~t tag authorized and
furnished by the C~ty Clerk shall be attached to each
exhib~t dlsplayed.
3) Chamber of Commerce Permits. The Chamber
of Commerce may obtaln a permit from the City Clerk
for each show at the rate of $100.00 per day for each
such show irrespectlve of the number of exh1bitors,
subJect to the following conditions: (a) The perm~ttee
shall make available to the City Clerk, upon demand, all
records of recelpts and d1sbursements resulting from the
show; (b) Each exhibitor shall have on h1S person at
all t1rnes, all necessary state licenses requ1red for the
sale of the works of art to be sold; (c) Each exhlbltor
shall present sufficient proof to establish that 1n fact
the art obJect to be sold was individually hand produced
by the exhlbltor; (dl Each exhibltor shall furnlsh a
photograph of himself, of proper Slze to afflx to each
entry reglstration card lssued by the permlttee.
The Chamber of Commerce may impose a reason-
able charge or exhiblt fee on each participating exhlbl-
tor and shall be responsible for enforcing all requlre-
ments of thlS ordinance and regulations 1mposed by the
Chamber. Any net profit recelved by the Chamber of
Commerce from the conduct of any such show shall be
utl1lzed for the commercial development of the Central
Business District of this C~ty.
SECTION 2. Any provision of the Santa Monica Municipal Code,
or appendlces thereto incons1stent herewlth, to the extent of such 1n-
consistencies and no further, are hereby repealed or modlfied to that
extent necessary to effect the provls1ons of thlS ordinance.

SECTION 3. If any section, subsect~on, sentence, clause or
phrase of th~s ord~nance ~s for any reason held to be ~nvalid or un-
constitut~onal by a dec~s~on of any court of competent Jur~sd~ct~on,
such dec~s~on shall not affect the val~d~ty of the remaining port~ons
of the ord~nance. The C~ty Council hereby declares that it would
have passed this ord~nance and each and every section, subsection,
sentence, clause or phrase not declared ~nval~d or unconst~tut~onal
w~thout regard to whether any portion of the ordinance would be subse-
quently declared ~nval~d or unconst~tutional.
SECTION 4. Any person vlolating any of the provisions of
th~s ord~nance shall be gu~lty of a m~sdemeanor and, upon conviction
thereof, shall be subJect to a fine not exceeding F~ve Hundred ($500)
Dollars or Six (6) months ~n the county Ja~l of Los Angeles County, or
by both such f~ne and ~mprisonment ~n the d~scretion of the court.
SECTION 5. The Mayor shall s~gn and the Clty Clerk shall
attest to the passage of thlS ordinance. The City Clerk shall cause
the same to be published once In the offlc~al newspaper within flfteen
days after ~ts adoption. ThlS ordlnance shall become effectlve after
th~rty days from its adoption.
