A special meeting of the Santa Monica City Council was called to order by Mayor McKeown at 2:00 p.m., on
Saturday, October 17, 2020, via teleconference pursuant to the Governor’s Executive Order N-29-20 at

CONVENE
On order of the Mayor, the City Council convened at 2:00 p.m., with all
members present except Mayor Pro Tem O’Day.
CONSENT CALENDAR:

arrived at 2:03 p.m.)
All items were considered and approved in one motion unless removed by a
Councilmember for discussion.
There were no members of the public present to comment on the Consent
Calendar.
At the request of Councilmember Winterer, Item 3.A. was removed from
the Consent Calendar.
3.A. Approval of Separation/Retirement Agreement No. 11097
(CCS) for Chief of Police, was presented.
Recommended Action
Staff recommends that Council:
(1) approve the agreement with Cynthia Renaud for her
separation/retirement from her position as Chief of Police; and,
(2) authorize the Interim City Manager to sign the
separation/retirement agreement on behalf of the City.
This item was pulled to ask questions of staff including: Why was four

months decided for the severance pay; would the Chief be required by the
severance agreement to participate in any interviews stemming to review
the events of May 31st above and beyond the OIR report; is there any
reason to believe she would not respond favorably to being asked to
participate in any subsequent interviews; and, would it be possible to add a
requirement to include participating in sworn statements.
Considerable discussion ensued on topics including, but not limited to:
would like to have some assurance as part of the severance agreement, that
the Chief will participate in any investigation that stems from the incidents
of May 31st;
Motion by Councilmember Winterer, seconded by Councilmember Jara, to
approve the staff recommendations that the agreement include with the
modification some language about cooperating with any additional
investigation about the events of May 31st.
The City Attorney read the proposed amended language to the proposed
agreement. “To include in the obligation, that she participate in interviews
with and provide materials reasonably requested by the city in connection
with the OIR group review of events leading up to and including May 31st,
any subsequent investigations, and any litigation.”
The motion was approved by the following vote:
AYES: Councilmembers Jara, Winterer, Davis, Himmelrich,
McCowan, Mayor Pro Tem O’Day, Mayor McKeown
