ORDINANCE NO. 952
(CITY COUNCIL SERIES)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
~iONICA M'iENDING THE SANTA MONICA r1UNICIPAL CODE BY
ADDING THERETO SECTION 8523 PERTAINING TO THE SALE OF
MOTOR VEHICLE FUELS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. The Santa Mon~ca Municipal Code ~s hereby
amended by add~ng thereto Sect~on 8523 to read as follows:
Sect~on 8523. Signs - Gasollne Sales--Volume Limits
Hours, and Prices.
Every person, flrm, partnership, assoc~ation, trustee,
or corporatlon WhlCh owns, operates, manages, leases or rents
a gasollne service statlon or other facl11ty offerlng for
sale, selllng, or otherWlse dlspensing gasollne or other
motor vehicle fuel to the publlC from such a facility abutt~ng
or adJacent to a street or highway shall post, or cause to
be posted or displayed, and shall malntain and keep current
at the pre~lses from wh~ch said retaller offers for sale,
sells or otherw~se dlspenses gasollne or other motor vehlcle
fuel at least one slgn, banner or other advertlslng medlun
WhlCh is clearly vislble from all trafflc lanes ln each
dlrection on such a street or hlghway.
a. Each sald slgn, banner or other advertls-
ing medlum shall accurately lndlcate thereon the m~nlmum and
max~~um volume lim~ts, If any, of gasol~ne or o~her motor
vehicle fuel which will be sold thereat to anyone purchaser
at anyone tlme for use In a motor vehlcle.
No changes shall be made w~th respect to the

max1mum or m1nimurn lim1ts on amounts to be sold w1thout such
changes f1rst belng shown on such posted sign, banner or
advertislng medium.
b. Each sa1d slgn, banner or other advertislng
medium shall further set forth the hours and days said serVlce
facility will be open to the public for the purpose of offerlng
for sale, sel11ng or otherwise dispenslng gasoline or other
motor vehicle fuel to the public.
No changes in such avallab1lity of gasol1ne or
other motor vehicle fuel shall be made wlth respect to the
hours or days the facility will be open as provlded above
without such change or changes being flrst shown on such posted
sign, banner, or advert1sing medium.
c. Each sald sign, banner or other advertlslng
medlUffi shall further 1ndicate thereon the actual price per
gallon, including all taxes, at which each grade of gasoline
or other motor vehlcle fuel 15 currently belng offered for
sale, sold or otherWlse dispensed, If at all, at sald facility
on 5ald date. In addition, the actual price per gallon of
each grade of gasoline or other motor vehlcle fuel, as descrlbed
above, shall be plalnly posted on top of each operatlve pump
at said faclllty on said date.
No person, firm, partnership, associatlon,
trustee, or corporat1on wh1ch owns, operates, manages, leases,
or rents a gasollne serVlce station or other such facil1ty
shall advertise, either ln connectlon w1th any s1gns, banners,
or other advertislng med1um utilized to sat1sfy the requlre-
ments of this section or otherwlse, the price of any grade of
gasoline or other motor vehicle fuel which is not 1mmediately
ava1lable to be sold or dispensed to the public at sald premlses.

d. Each sign, banner or other advertising
medium posted, displayed or maintained pursuant to requlre-
ments of this section shall not be inconsistent with the
provlsions of Artlcle 8 of Chpater 7 of Division 8 ( Sectlons
20800, et se~.) of the State of Callfornia BUSlness and
Professions Code.
SECTION 2. Any proV1Slon of the Santa Monica Municipal
Code, or appendices thereto inconslstent herewith, to the extent
of such inconslstencies and no further, are hereby repealed or
modified to that extent necessary to effect the provislons of this
ordlnance. It is not the intent to repeal any ordlnance except
to the extent that such ordinance may be lnconslstent with this
ordinance.
SECTION 3. If any section, subsectlon, sentence, clause
or phrase of this ordinance 1S for any reason held to be invalld or
unconstitutlonal by a decision of any court of competent ]urlsdiction,
such decision shall not affect the valldity of the remaining portions
of the ordinance. The City Councll hereby declares that it would
have passed thlS ordlnance and each and every sectlon, subsectlon,
sentence, clause or phrase not declared invalld or unconstltutional
wlthout regard to whether any portlon of the ordlnance would be
subsequently declared lnvalid or unconstltutional.
SECTION 4. Any person violating any of the provlsions of
thlS ordinance shall be guilty of a mlsdemeanor and, upon conviction
thereof, shall be subject to a fine not exceeding Flve Hundred
($500) Dollars or six (6) months ln the County Jall of Los Angeles
County, or both such fine and lmprisonment in the discretlon of the
court.
SECTION 5. The Mayor shall slgn and the Clty Clerk shall
attest to the passage of this ordinance. The Clty Clerk shall cause

the same to be published once 1n the off1cial newspaper with1n
fifteen days after its adoption. This ordinance shall become
ADOPTED th1s

effective after thirty days from its adoption.
