ORDINANCE NO. 955 (CCS)

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AMENDING SECTION 3350 OF CHAPTER 3, ARTICLE III
OF THE SANTA MONICA MUNICIPAL CODE TO CHANGE THE PERIOD
DURING rlliICH BICYCLE RIDING IS PROHIBITED ON THE
PROMENADE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION I. Section 3350 of Chapter 3, Article III of
the Santa .Honlca Municipal Code is hereby amended to read as follows:
Sect~on 3350. Bicycle R~ding or Coasting
Restricted. It shall be unlawful to ride a b~cycle or to
coast in any veh~cle upon any public s~dewalk, except that
blcycle rlding shall be permltted on The Promenade, pro-
vided that durlng the period from May 15th through
September 15th of each year, blcyc1e ridlng shall be pro-
hibited after 10:00 a.m. and before 5:00 p.m. The rlder
of a blcycle upon a roadway shall rlde as nearly as
practlcable withln five feet of the rlght-hand curb or
edge of the roadway except when passing a vehicle or
maklng a left-hand turn at an lntersection.
SECTION 2. Any person v~olating any of the provls~ons
of this ord~nance shall be guilty of a misdemeanor and, upon con-
vict~on thereof, shall be subject to a fine not exceeding Flve
Hundred ($500) Dollars or Six (6) months in the county Ja~l of Los
Angeles County, or by both such fine and lflprlsonment in the
dlscretion of the court.
SECTION 3. Any provlslon of the Santa Monica Munlclpal
COde, or appendlces thereto incons1stent herewith, to the extent of

such inconsistencies and no further, are hereby repealed or modif1ed
to that extent necessary to effect the provisions of this ordinance.
SECTION 4. If any sect1on, subsect1on, sentence, clause or
phrase of this ordinance is for any reason held to be ~nvalid or
unconstitut1onal by a decision of any court of competent ]urisdic-
t1on, such decision shall not affect the validity of the remaining
port~ons of the ordinance. The City Counc1l hereby declares that it
would have passed this ord1nance and each and every section, sub-
sect1on, sentence, clause or phrase not declared inva11d or unconsti-
tutional without regard to whether any portion of the ordinance would
be subsequently declared 1nvalid or unconstitutional.
SECTION 5. The Mayor shall sign and the C1ty Clerk shall
attest to the passage of this ord1nance. The City Clerk shall caUSe
the same to be published once in the official newspaper w1thin
f1fteen days after its adoption. This ordinance shall become effec-
t1ve after thirty days from 1ts adoption.
