AN ORDINANCE OF THE CITY COUNCIL OJ:' THE
CITY OF SANTA MONICA ADDING AND AMENDING
SECTIONS 9109A4, 9109B3, 9110B3, 9133 OF
THE SANTA MONICA MUNICIPAL CODE RELATING
TO DENSITY IN RESIDENTIAL AND COMMERCIAL
DISTRICTS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. S9l09 of the Santa Monica Municipal Code
is hereby amended to read as follows:
SECTION 9109A. Uses permitted. The
following uses are permitted in the "R3"
Multiple Residential District:
1. All uses permitted in the "RI t.,
"R2-R" Districts.
2. Boarding houses.
3. Fraternity or sorority houses.
4. Transitional residential uses per-
mitting one dwelling unit for each nine
hundred (900) square feet of lot area on a
lot a side lot line of which abuts on, or
is separated by an alley from, any less
restricted multiple residential district.
SECTION 2. S9l09B of the Santa Monica Municipal
Code is hereby amended to read as follows:
SECTION 910gB. Property Development Standards.
The following property development standards shall
apply to all land and structures in the "R3" district.
Any lot existing on the effective date of this
chapter need not comply with subdivisions one and

two of this section.
1. Lot Area: Each lot shall have a
minimum lot area of five thousand (5,000) square
feet.
2. Lot Dimensions:
a. Each lot shall have a minimum
width of fifty (50) feet.
b. Each lot shall have a minimum
depth of one hundred (100) feet.
3. Lot Area Per Dwelling Unit:
a. There shall be a minimum of
one thousand (1,000) square feet
of lot area for each dwelling unit,
except, however, that in no case
shall more than one (1) dwelling unit
be permitted on a lot having an area
less than four thousand (4rOOO) square
feet.
b. On a lot a side lot line of which
abuts on, or is separated by an alley
from, any less restricted multiple
residential district,; there shall be
a minimum of nine hundred (900) square
feet of lot area per dwelling unit.
4. Building Height: Any building or
structure erected in this District shall have not
more than three (3) stories and shall not exceed
forty-five (45) feet in height, except as otherwise
provided in ~9l26.
5. Yards:
a. Front yard. A front yard shall

be provided and maintained on each
lot. Said yard shall have a minimum
depth as specified on the "Districting
Map."
b. Side Yard. A side yard shall be
provided and maintained on each side
of a main building. Such side yard
shall be not less than five (5) feet
in width, provided, however, that on
a lot or building site less than fifty
(SOl feet in width, the side yard shall
be ten CIO) percent of the width of the
lot, but not less than four (4) feet.
For three (3) story buildings such
side yard shall in all cases be not less
than five (5) feet.
For buildings more than three (3)
stories in height, the minimum side yard
shall be increased in width by two (2)
feet for each story above the second
story, provided, that the side yard need
not exceed fifteen (IS) feet in width.
When all or a portion of the lower
story of a building, all of which sa~d
portion is on the rear thirty-five (35)
feet of any lot and is used entirely for
garages, said garages in said lower
story may extend to either side lot line,
but not hath, provided that no portion of
any dwelling unit over or attached to

such garages shall extend within the
required side yard.
c. Rear Yard. A rear yard of not less
than fifteen (15) feet in depth shall be
provided and maintained on each lot.
Where any accessory hilding or
structure occupies space in a required
rear yard, the amount of space so occupied
shall be provided elsewhere on the lot,
exclusive of required yard areas. Said
replacement space shall have a minimum
dimension, either in length or width,
of eight (8) feet and shall be so located
that it is suitable for general open use
by the occupant of the premises.
6. Space Between Buildings: A yard space of
not less than' ten. (10) feet shall be provided and
maintained between main buildings where more than one
(1) building is located on a lot or parcel of land.
Said distance between main buildings shall be increased
by five (5) feet for each story above the first
story. Where variations in height occur, adjustments
may be made by the zoning administrator to bring the
space between buildings requirements in harmony with
the intent of this Section.
7. Off-Street Parking; The provisions of
S9129 shall apply.
SECTION 3. S91l0B of the Santa Monica Municipal Code
is hereby amended to read as follows:
Section 91l0B. Property Development Standards.
The following property development standards shall

apply to all land and structures in the "R4"
district. Any lot existing on the effective date
of this chapter need not comply with subdivisions
one and two of.this Section.
1. Lot Area: Each lot shall have a minimum
lot area of five thousand (~,OOO) square feet.
2. Lot Dimensions:
a. Each lot shall have a minimum width
of fifty (50) feet.
b. Each lot shall have a minimum depth
of one hundred (100) feet.
3. Lot Area Per Dwelling Unit: There shall be
a minimum of seve1a 'hunlitre.Gl fifty 1750) square
teet of lot area for each dwelling unit, except,
however, that in no case shall more than one (1)
dwelling unit be permitted on a lot having an
area less than four thousand (4,000) square feet,
and except that for lots or building sites having
ten thousand (10,000) square feet or more of area,
the minimum herein stated may be waived subject
to the issuance of a conditional use permit in
accordance with the provisions of S9148 of this
Chapter.
4. Building Height: Any building or structure
errected in this District shall not exceed one
hundred twenty (120) feet in height, except as
otherwise provided in S9126.
5. Yards:
a. Front yard. A front yard shall be
provided and maintained on each lot. Said

provided and maintained on each side of
a main building. Such side yard shall be
not less than five (5) feet in width,

of the width of the lot, but not less than
four (4) feet.
For three (3) story buildings such side
yard shall not be less than five (5) feet.
For buildings more than three (3) stories
in height, the minimum side yard shall be
increased in width by two (2) feet for each
story above the second story, provided,
that the side yard need not exceed fifteen
(15) feet.
When all or a portion of the lower story
of a building, all of which said portion
is on the rear thirty-five (35) feet of any
lot and is used entirely for garages,

provided that no portion of any dwelling
unit over or attached to such garages

7. Off-Street Parking: The provisions of 59129
shall apply.
B. Off-Street Loading: The provisions of 59130
shall apply.
SECTION 4. 59133 of the Santa Monica Municipal Code
is hereby amended to read asfollows:
SECTION 9133. Any provision of this code
to the contrary notwithstanding, the following
rule shall be followed in any district in which

multiple residential uses are permitted in computing
the maximum number of units:
If, upon dWiding the total building site area
by the minimum lot area per dwelling unit, the
remainder is seven hundred fifty (7501 square feet
or more in the "R2" District; seven hundred fifty
(750) square feet or more in the "R3"District, or
five hundred (500) square feet or more in the uR4"
"CA", "CP", "C3" or "C4" Districts in locations or
under conditions wherein residential uses are
permitted, then the next higher number of units
shall be permitted.
The foregoing shall in no way modify the
requirements of S910BB3a, S9l09B3a, Or S9110B3a,
insofar as these sections prohibit more than one
(ll dwelling unit on a lot of less than four
thousand (4,000) square feet; further, said four
thousand (4,000) square feet minimum shall be
computed without the inclusion of any abutting
alley.
SECTION 5. The provisions of this ordinance shall
not apply to any building or project for which either tentative
tract map approval or a building permit has been granted prior
to the effective date of this ordinance.
SECTION 6. Any provision of the Santa Monica MunXipal
Code, or appendices thereto inconsistent herewith, to the
extent of such inconsistencies and no further, are hereby
repealed or modified to that extent necessary to effect the
provisions of this ordinance.
SECTION 7. If any section, subsection, sentence,

clause or phrase of this ordinance is for any reason held to be
invalid or unconstitutional by a decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of the ordinance. The City
Council hereby declares that it would have passed this ord~nance
and each and every section, subsection, sentence, clause or
phrase not declared invalid or unconstitutional without regard
to whether any portion of the ordinance would be subsequently
declared invalid or unconstitutional.
SECTION B. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause tne same to be published once in the official
newspaper within fifteen days after its adoption. This ordinance
shall become effective after thirty days from its adoption.
