R11259DocuSign Envelope ID: 76F463B9-F204-47CA-A410-EE78D9A771EC 1 City Council Meeting: June 23, 2020 Santa Monica, California RESOLUTION NUMBER 11259 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO ADOPT THE INNOVATIVE CLEAN TRANSIT ROLLOUT PLAN. WHEREAS, in 2018, the California Air Resources Board (CARB) adopted the Innovative Clean Transit (ICT) Regulation, which requires public transit agencies to transition to a 100 percent zero-emission bus (ZEB) fleet, such as battery-electric or fuel cell electric, by 2040; and WHEREAS, the ICT includes the following requirements for bus purchases for large public transit agencies such as Big Blue Bus: • starting in January 1, 2023, twenty-five percent of the total number of new bus purchases in each calendar year must be zero-emission buses; and • starting in January 1, 2026, fifty percent of the total number of new bus purchases in each calendar year must be zero-emission buses; and • starting in January 1, 2029, all new bus purchases must be zero-emission buses; and DocuSign Envelope ID: 76F463B9-F204-47CA-A410-EE78D9A771EC 2 WHEREAS, under the ICT regulation, a large public transit agency is required to submit to the CARB Executive Officer a Rollout Plan that is a living document intended to guide the agency’s conversion to a ZEB fleet; and WHEREAS, the Rollout Plan must be approved by the transit agency’s governing body through the adoption of a resolution prior to submission to CARB, and this approval must be submitted to CARB along with the Rollout Plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council, as the governing body of the Big Blue Bus, a large public transit agency, hereby approves the Rollout Plan attached to this resolution as Exhibit A. SECTION 2. The Big Blue Bus is authorized to comply with all conditions and requirements set forth in the Innovative Clean Transit (ICT) regulation adopted by the California Air Resources Board (CARB) and codified at Cal. Code Regs., tit. 13 §§ 2023, 2023.1-2023.11. SECTION 3. The City Manager or designee is authorized to execute and cause to be submitted to the CARB all documents required for the Big Blue Bus to comply with the ICT regulation. SECTION 4. If any section, subsection, sentence, clause, or phrase of this Resolution is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining DocuSign Envelope ID: 76F463B9-F204-47CA-A410-EE78D9A771EC 3 portions of this Resolution. The City Council hereby declares that it would have passed this Resolution and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of this Resolution would be subsequently declared invalid or unconstitutional. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: George S.
