ORIGINAL ORDINANCE NO. 958 (ees) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING AND AMENDING SECTIONS 6212, 6212B, 6212C, 6212E, 6219, 62l9A, 6225, 6226, 6236, 6240, and 6240A OF THE SANTA MONICA MUNICIPAL CODE RELATING TO THE BUSINESS LICENSE TAX, AND DECLARING THE PRESENCE OF AN EMERGENCY. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. S6212 of the Santa Monica Municipal Code is hereby amended to read as follows: ~62l2. GENERAL BUILDING CONTRACTOR AND GENERAL ENGINEERING CONTRACTOR. A contractor whose principal contracting business is in connection with any structure built, or to be built for the support, shelter and enclosure of persons, animals, chattels, or movable property of any kind, requiring in its construction the use of more than two unrelated building trades or crafts, or to do or superintend the whole or any part thereof or a general engineering contractor whose principal contracting business is in connection with fixed works requiring specialized engineering knowledge and skill including, but not limited to, irrigation, drainage, water, power, railroads, highways, streets, pipelines, powerhouse plants, industrial plants, land leveling, earth moving, harbors, and concrete surfacing. This section does not include anyone who merely furnishes material or supplies without fabricating them in the per~ormance of the work of a general bullding contractor, $50.00 per annum. Electric signs. 7. Elevator installation. 8. Excavating, grading, trenching, paving, surfacing. 9. Fire protection engineering. 10. Floodlight service. 11. Flooring. 12. Glazing. 13. Heating and air conditioning. 14. House and buildin~moving or wrecking. 15. Insulation. 16. Landscaping. 17. Lathing. 18. Masonry. 19. MLscel1aneous. 20. Ornamental metals. 21. Painting and decorating- 22. Test control. 23. Plasterin3 only. 24. Refrigeration. 25. RoofI-ng. 26. Screens. 27. Lathing and plastering combined and who holds a state license far both and who uses his own employees to do both may be issued one license covering both businesses for the license fee of ~40.aO per annum. SECTION 3. S62l2C of the Santa Monica Municipal Code is hereby amended to read as follows: S62l2C. SUB-CONTRACTORS, CONTPACTORS. 1. A plumbing contractor, $50.00 per annum. 2. A plumbing and heating contractor cow~ined or p1~~ing and sewer contractor ($1,000 surety bond required) and who holds a state license for both, $90.00 per annum. 3. A plumbing, heating and sewer contractor and who holds a state lLcense for all three, $100.00 per annum and shall furnish a surety bond in the amount of $1,000 for acting as a sewer contractor. 4. An electrical contractor, $50.00 per annum. SECTION 4. S6212E of the Santa ~1onica Municipal Code is hereby amended to read as follows; S6212E. GROSS RECEIPTS IN EXCESS OF $20.000.00. &~y person described in ~S6212, 6212B and 6212C whose gross receipts during the f~scal year (July 1 - June 30) from work performed in the City of Santa Manica, exceed $20.000.00 in -3- . . addition to the fee hereinabove set forth, shall be required to pay an additional license fee of .65~ per each $1,000.00 or fraction thereof of gross receipts in excess of $20,000.00. SECTION 5. ~62l9 of the Santa Mon1ca Municipal Code is hereby amended to read as follows: S6219. HOTEL, APART~mNT HOUSE, ETC. Hotel, apartment house, rooming house, court, auto court, auto motel, of over 3 units, furnished or unfurnished, under the same ownership or in adjoining property, the following alli,ual license fees based upon annual gross receipts of such business hereby are prescribed: For any such business where the gross annual receipts of which are less than $10,000.00, the sum of $10.00 and, in addition,-$1.25 for each SI,OOO.OO or fraction thereof of gross receipts in excess of $10,000.00. SECTION 6. ~62l9A is hereby added to the Santa Monica Municipal Code to read as follows: ~62l9A. CO~~lliRCIAL RENTAL. ~~y.person. group, associat~on, partnership, firm or corporation, whether as the owner or as the agent for the owner, who rents, leases or has available for rent or lease, one or more co~~ercial building, industrial building, offices or office building, land or vacant lots that may be ut11ized for commercial, industrial or office uses, whether at one or multiple locations, an annual license fee of $10.00 for the first $10,000.00 in gross receipts, and in addition thereto, .75i for each $1,000.00 or fract~on thereof in gross receipts "L>:tereafter in excess of $lO,OOQ.OO. SECTION 7. 56225 of the Santa Monica Municl.pal Code 1.S hereby al".ended to read as follm-ls: 56225. MERCFJU~TS-RETAIL, OTHER BUSINESSES. GROSS -4- . . PECEIPTS. Manufacturing and selling any goods, wares or merchandise at retail or selling any goods, wares or merchandise at retail and not othenvise specifically licensed by other provisions of this code, or not specifically exempted from the payment of licenses by this code, the annual license fee shall be $25.00 minim~~t plus .60~ per each $1,000.00 or fraction thereof of gross receipts in excess of $10,000:00. In no event shall any license fee, required to be paid pursuant to this section, be in excess of $2,000.00. SECTION 8. S6225 of the Santa Monica Munic~pal Code is hereby amended to read as follows: 56226. ~~~UFACTURERS-WHOLESALERS. GROSS RECEIPTS. Manufacturing and selling any goods, wares, or merchandise at wholesale or selling goods, wares, or merchandise at wholesale and not othenqise specifically licensed by other provisions of this code, or not speclfically exempted from the payment of a license by this code, the annual license fee shall be $25.00 minimum, plus .50~ per each $1,000.00. or fraction thereof of gross receipts in excess of $20tQOO~OO~ In no event shall any license fee, required to be paid pursuant to this section, be in excess of $5,QOO.OO~ SECTION 9. ~6236 of the Santa Monica Municipal Code is hereby amended to read as follows: ~6236. PROFESSIONAL. Any person, group, association, partnership, f~rrn or corporation engaged in a profession, vacation or calling, listed hereinafter or not specifically provided ir in any ether sections of this code, the business tax shall be $20.00 far gross receipts of less than $6,000.00, and in addition thereto, .65~ per each $1,000.00 or fraction thereof of gross receipts in excess of $6,000.00. -5- . Whenever a State of California license is required to entitle a person to practice a profession, the City Clerk ~ay require, before issuing a license pursuant to this section, the applicant to exhibit an unexpired and unrevoked license entitling said applicant to practice in the State of California. SECTION 10. S624Q of the Santa Monica Municipal Code is hereby amended to read as follows: S6240. SERVICES. selling or providing for pay, any service which is not otherwise specifically licensed by other provisions of this code, or not specifically exempted from the payment of licenses by this code, the annual license -7- -~.. ::;,~-~~ . . v fee shall be $20.00 minimum, and .65~ per $1,000.00 of gross receipts or fract~on thereof in excess of $6,000.00. The services referred to herein, includef but are not limited to, the following: 1. Advertising, publicity or public relat~ons agency. 2. Alarm. 3. Animal care or leasing. 4. Auto service station. 5. Auto wash. 6. Auto wrecking - a permit is required prior to licensing (see ~56l20 and 6122). 7. Barber shop, beauty parlorf or any other establishment engaged in tonsorial arts, manicuring, shampooing, hairdressing, shaving or facial massage. 8. Bath house or bath treatment - a permit is required prior to licensing (see SS6120 and 6122). 9. Bookkeeping. 10. Booking or theatrical agent. lO.a.Brokerage, stocks and bonds. 11. Caterer. 12. Check cash~ng. 13 . Collection Agency. 14 . Corn.mercial Art~s. 15. Consultant. 16. Data Processing. IE.a.Employment Bureaus. 17. Garden~ng and landscaping. 18. House, corr~ercia1 building, industrial plants, etc., cleaning, lncluding janitorial, household -8- . . :/ furnishings and window-washing services. 19. Illustrator. 20. Institutions, schools, or persons engaged in the business of providing for pay instruction in such matters as art, aviation, beauty culture, self-defense, trade or business or other accomplishment. A permit is required for dance and physical culture instruction prior to licensing. (See SS6120 and 6122). This sub-section shall not apply to any gymnasium conducted in connection with any private club or any public or private school where other courses of instruction are given. 21. Letter ~~iting or addressing agency. 22. Lithographer. 23. Masseur or masseuse a permit is required prior to licensing (see SS6l20 and 6122). Before a license can be issued, every applicant must file with the Chief of Police at least five (5) letters as to character and reputation, also a physician's certificate as to the applicant's health. 24. l-iortician. 25. Odor control. 26. Private investigat1on, patrol or security agency. 27. Public stenographic service. 28. Rental of vehicles, trailers, appliances, etc. 29. S6240A of the Santa Monica Municipal Code is hereby amended to read as follows: ~6240A. In no event shall any license fee required to be paid pursuant to ~6240 hereof be in excess of $2,000.00. SECTION 12. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed. SECTION 13. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not effect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 14. This ordinance is declared to be an emergency measure adopted pursuant to the provisions of S6lS of the Santa Monica Municipal Charter and is necessary for preserving the public peace, health, or safety, and the ur- gency for its adoption is set forth in the findings above. SECTION 15. The Mayor:-.shall sign and the City Clerk shall attest to the passage of this ordinance. This ordinance shall become effective upon its adoption.
